The women testified Thursday that they found out they had the virus that causes AIDS after having unprotected sex with Philippe Padieu, a 53-year-old martial arts instructor from Frisco.

Padieu testified in his defense, saying he is not a sexual predator.

On Wednesday, the Collin County jury convicted Padieu on six counts of aggravated assault with a deadly weapon for recklessly and intentionally infecting six women.

Padieu faces five to 99 years in prison on each count. The jury may decide his punishment Friday.

You’d give him the death penalty...but he already has it.

How about, no treatment except palliative in jail?

A PENIS is a DEADLY WEAPON?!?
Oh come on!
This is one reason our legal system is held in such disdain.

“Padieu faces five to 99 years in prison on each count.”

Show some leniency — 80 years per count should do.

This is what happens in a liberal society where casual sex with strangers seems to be the norm. Frankly I'm surprised a good portion of Hollywood actors/actresses don't have this disease. It appears middle aged and older people are just as loose morally as young ones.

People like to scoff at this happening, but it does, and it happened years ago also.

In college (80’s) I knew this guy named Chris West. He was from a wealthy and well connected family in Mobile, AL.

He got AIDS, I suspect from an un-admitted homosexual pick up when he was in law school at Cumberland Law School. He publicly dated women.

He went on to give AIDS to one person for sure. One girl sued him for it, can’t remember if that was civil or criminal. I do remember at the time that over 100 people, men and women came forward to say that they had had unprotected sex with him.

He committed suicide a few days after the court ruled that his records from the Jefferson County Health Department (showing that yes, he’d had the AIDS test and knew he had it,) could be opened.

The girl he infected, the one that the original case had been about, was named Corrine. For some reason, I’ve never forgotten her. Chris had represented her during her divorce, and she had two small sons at the time. This was in the very early 90’s.

I guess she’s long dead now.

The case never made it to court.

The whole thing was tragic.

I think some of them do. Their deaths are just announced an pneumonia or something like "cancer."

I don’t see how they can do this legally. The CDC has not quarantined HIV people. If there is no quarantine or any kind of legal restrictions then what gives them the authority to prosecute him?

Unless there is something I am not aware of?

Well, they will have to either identify the disease in him or keep him out of the general population...otherwise, prisoners will sue and nowadays, probably win.

If you were concerned about bodily fluids YOU WOULDN’T HAVE SEX!!!

That is like people trying to check the level of fuel in their gas-tank with a lighter... DUMB, and with unsurprising results when the catastrophic-failure occurs.

It is the fault of EVERYONE involved; him for not telling, her [pl.] for having extra-marital sexual relations... it’s fairly obvious that the main culprit here is people failing to take into account the results of being promiscuous.

This case is similar to some others I've read. What I cannot for the life of me understand is how foolish some women can be with regards to certain types of men. As a man, a have a sixth sense about creeps. I can tell them a mile away. I'm right about 99%+ of the time. Some (many) women cannot distinguish between creeps and the good guys. Maybe the creeps have a flair about them. Maybe because they don't care they have aura about them. Some women will fall for this. Ask yourself a question. How many seemingly reasonable women fall for guys like this? I'm not saying all these guys have AIDS. This is an extreme case. But many men like this are around and they don't seem to have much problem finding gullible women.

Does he look like he's dying? Didi the overweight, over fifty women he fleeced look like they were dying? Does Magic Johnson look like he's dying! Come on, use your head! HIV is a harmless ubiquitous 9 kilobase retrovirus that never hurt anyone. A criminal??? Sure the guy fleeced and defrauded them. That's criminal. The fact they contracted both genital herpes and HIV is not.

You people have got to wake up. I'm not even bothering to dissect it again I've done it so many times. Pathetic!

Point of contention: The HIV/AIDS virus does not kill you... it merely makes it extraordinarily easy for some other disease to do so.

Furthermore: Has the virus been weaponized? How then can it be called “the weapon”?

When I got my Anthrax vaccine it was because of the ease of (and some precedence of) its weaponization... has the HIV/AIDS been so engineered? (And if so, I’d like to see your proof/reasoning.) Calling the HIV/AIDS virus a weapon is akin to calling the flu-virus a weapon: it could be used as one, yes, but that doesn’t mean that it [or any particular/random case] IS one.

But it is relevant. If they prosecute this guy it IS creating law from the bench.

unless there was some legal restrictions the CDC gave him a license to kill by not quarantining or any kind of restrictions against HIV people.

A bullet doesn’t kill you ... getting shot merely makes it extraordinarily easy for blood loss, or organ failure to do so.

“If Padieu were homosexual, prosecuting him would be labelled a hate crime.”

Interesting thought. This case seems to attract strong opinions on both sides. I think the legal aspects of this case are tenuous, but I have a hard time feeling bad for Padieu. I also have a hard time feeling bad for the group of frumpy women that couldn’t resist this studly looking euro-trash.

I wonder how the case would have gone had it been a hot babe sleeping with a bunch of balding fat dudes ?

You can’t just make stuff up. The CDC does not make criminal law; that’s under the purview of the states. It has nothing to do with this. What does the statute say? I take it neither of us has read it but I assure you it doesn’t mention the CDC. That’s the only thing that governs this trial.

The more interesting question, as someone alluded to before is causation. What happens if someone dies in a car accident before the opportunistic infections get them, etc.?

You're right! Christ lays this all out very simply for everyone. If we follow His rules (which are issued to give us the most joy in our lives), we don't have to worry about contracting AIDS in this fashion.

CDC doesn’t make criminal law but they can quarantine.

I don’t know what prosecutors can charge this guy with is my real question. As far as I know there is no law of any kind restricting HIV carriers. If there is no law he has to go free it is up to law makers to restrict HIV carriers.

The CDC has not quarantined HIV people.

Back in the early eighties there was a herbal nutritionist/holistic medicine guy who had the occasional op-ed piece in the local bay area papers, and was held in high esteem by the local press. AIDS then hit the news. The disease was tied to individuals who frequented San Francisco's homosexual bath houses. On hearing this news, said nutritionist guy publicly called for closing the bath houses and instituting quarantines to stem the spread of the disease. He was quickly marginalized and vilified by the local press and then SF Mayor Dianne Feinstein as being a "homophobe" wacko. Some years later he adopted a memorable nom de guerre and resurfaced as radio talk-show host Michael Savage.

HIV as the cause of AIDS is a legal presumption, but has a lot going against it as a viable biological theory. Google Peter Duesberg for more info.

It is sad that people don’t seem to care who they sleep with.

Stay celibate until marriage, then stay monogamous. Make sure your partner does likewise.

Everyone else takes their chances with the HIV date.

You’re certainly not advocating that the CDC take the place of states in deciding what’s criminal, correct? The CDC has
NO authority over what’s criminal in states, and I tend to like it that way.

He’s not convicted of having HIV. He’s convicted of assault (i.e., intentionally, knowingly, or recklessly causing bodily injury to another) with a deadly weapon. At a minimum, we can agree it’s assualt, because he was at least reckless. Perhaps you’re arguing that HIV is not a deadly weapon? It’s certainly capable of causing death or serious bodily injury. I think it makes sense.

I don’t believe AIDS or HIV is usually listed as the cause of death. The virus will weaken the immune system so that other illnesses are more dangerous than usual. A friend of mine who passed away when we were kids had AIDS from tainted blood platelets. His cause of death is listed as pneumonia.
