The Oregon Court of Appeals reversed a decision this week by a controversial Clackamas County judge whose rulings prompted Attorney General John Kroger to block her from handling child-welfare cases.
The appeals court said Circuit Judge Deanne Darling erred when she ordered an infant, who Department of Human Services claimed was physically abused, returned to the mother.
It is not clear whether the appeals court case was among those that led to Kroger's extraordinary action.
Darling came under fire earlier this year when she ordered DHS to help seek the release of a man accused of having sex with underage girls. Darling said the state offered no evidence that the man was an unfit parent and that it should aid him so he could care for his 13-year-old son who had been placed in foster care.
The appeals court ruling involved a mother who had custody of a 7-month-old child and a father with limited visitation rights. After an unsupervised visit by the father, a medical examination found the child had a broken leg and evidence of previously broken ribs.
Darling granted DHS temporary custody in January. She later ordered the child returned to the mother, declaring the state "failed to establish (its) allegations" that the child was in danger.
The state appealed, arguing that there was ample evidence of physical abuse and a reasonable likelihood of future harm.
The appeals court agreed that the child was endangered and reinstated DHS authority over the child. But the court left it to Darling to decide whether the child is placed under DHS supervision with the mother or in foster care. Darling will remain as judge in the case.
The Oregon Court of Appeals temporarily blocked a judge's order requiring a state agency to provide bail for a child-rape suspect so the man could help plan care for his 13-year-old son.
The Department of Human Services filed the appeal after Clackamas County Circuit Judge Deanne Darling ordered the state to pay $50,000 bail or otherwise arrange Russell Paul Hamblen's release from jail.

Looks like we have an activist for child abusing perverts on the court. Yuck! She ought to go to jail.
I am pleased but very surprised that ultimately the appeals court stopped this in Oregon.
She was just reelected to a 6 year term in 2008, the people should get her off the bench.

I think part of the problem is that we don’t know who we are electing to the courts here in Oregon. Every election cycle we get voter guides that list judges, but they neglect to tell us anything about the judges. I have no idea who is liberal and who is extremely liberal and who will legislate from the bench. Unless I know that someone is somewhat moderately conservative I don’t vote for the judges. It’s frustrating.
It would seem if there is a reason to impeach a judge, this would be it. But short of that how can the attorney general judge-shop any more than a private citizen can?

We should be able to see their political leanings. That’s the only thing that makes sense.
BTW, since I don’t know their political leanings, and I know Oregon to be CA liberalified, I vote against the incumbant every single time.
