BOISE, Idaho - A federal appeals court delivered a stinging rebuke Friday to the Bush administrations post-Sept. 11 detention policies, ruling that former Attorney General John Ashcroft can be held liable for people who were wrongfully detained as material witnesses after 9/11.
A three-judge panel of the 9th U.S. Circuit Court of Appeals said the governments improper use of material witnesses after Sept. 11 was repugnant to the Constitution and a painful reminder of some of the most ignominious chapters of our national history.
The court found that a man who was detained as a witness in a federal terrorism case can sue Ashcroft for allegedly violating his constitutional rights. Abdullah al-Kidd, a U.S. citizen and former University of Idaho student, filed the lawsuit against Ashcroft and other officials in 2005, claiming his civil rights were violated when he was detained as a material witness for two weeks in 2003.

I guess anybody can sue for anything if he finds a lawyer who is unscrupulous enough, not a stretch by any means. But if somene like Ashcroft can be hanged for doing his duty, then it will indicate that we lost both WWII and the Cold War after all— and another round is needed to get it right. ‘Twill be time to get the musket down from over the mantlepiece.

In an MSNBC report it used a quote by Judge Milan A. Smith and then claimed that he was speaking “for the majority.” One is left to assume that the three judge panel was split 2-1. However, given the usual clarity of MSNBC reporting, who knows?

Two sides to this coin:
1. Could Obama/Holder use the very same "policy" against us if there was some sort of "emergency"?
2. One could possibly use the "Japanese in California during WWII defense".
However, what was done seems to me to be a violation of the 4th Amendment, due process clause.
The key here is the guy was a citizen.

Not necessary for him to be a citizen. If subject to the jurisdiction of the United States, he is a “US Person,” and has 4th Amendment protection already. Unless he can show there is actually a chain of factual evidence that leads directly to Ashcroft the Supreme Court has already ruled in this case. I doubt he can. This is a stupid grandstanding waste of taxpayer money on the part of the three judge panel.
