HONOLULU Stinky city bus riders soon could get soaked. The Honolulu City Council is considering a bill that would impose up to a $500 fine and/or up to six months in jail for public transit passengers convicted of being too smelly.

How smelly is TOO smelly?
In theory, this sounds like a great idea. There are few things so disgusting than someone with terrible BO - especially when you’re in a relatively confined space.
OTOH, it strikes me as though calling the police everytime a bus driver or passenger smells what they think is BO might not be practical or realistic.
Didn’t the Federal courts rule a few years back that a public library couldn’t ban a smelly bum from their premises simply because he was a smelly bum? If so,this law is sure to be challenged in court.

About 10 years ago, this POS bum in Morristown NJ used to stink up the library every day until the library told him to get lost. The POS sued and won a ton of money from the county claiming distrimination. Now he is a rich POS bum.
There's plenty of things that out right stink in this country and a great bit of it emanates from inside the beltway.
Yeah, stinkiness is annoying. But so are loud people using cell phones in public (or confined places like restaurants or buses), people who pick their noses/belch/fart/spit/scratch, people with unruly kids, and on and on.
I just don’t think we need the Official Personal Hygiene and Behavior Patrol to round ‘em all up, give them tickets and fines. What’s next, citations for not wearing a flower on the lapel?
A city in the tropics banning BO. So what if you don’t have BO when you go to the bus stop, but have to stand outside in 100 degree heat for half and hour? Are all the bus stops going to be air conditioned? Will they provide emergency right guard? Good luck with that.

Elaine's voice: God, it's so crowded. How can there be so many people? This guy really smells, doesn't anyone use deodorant in the city? What is so hard, you take the cap off, you roll it on. What's that? I feel something rubbing against me. Disgusting animals, these people should be in a cage.
1) It seems extremely subjective. How do we quantify “odors that unreasonably disturb others or interfere with their use of the transit system”? It is not like noise which can be objectively measured. Does this mean a guy who is a little sweaty, or someone who hasn't bathed or changed clothes in 3 weeks? What about a woman wearing perfume somebody doesn't like?
2) Why make this a criminal offense? Assuming some objective standards for BO could be established, why not just have the smelly individual politely ordered to leave the bus,and perhaps handed a complimentary deodorant, bar of soap and pamphlet on personal hygiene? :-). If they refuse to comply, then they could be charged with trespassing, disorderly conduct, or other such violations. To lock someone up for 6 months for body odor seems incredibly harsh and a huge waste of taxpayer dollars and scarce jail space.
3) Some people have medical conditions that could lead to “BO”. Will the government start issuing BO passes (licenses to smell) to such individuals?

If the ban works there's an obvious next step. People already can't play music loud (offensive to ears) and won't be about to stink (offensive to nose). I've been on the bus with many people who were offensive the the eyes - in a few cases worse than any music or odor.
Would not want to serve on the jury having to determine the factual basis of the evidence. Jury foreman in this case will be known as pit boss.

Damn, when I read the headline I thought they were going to ban Bozo from buses, but then he would never stoop so low as to ride on a bus.
Every bus will be equipped with a stinkometer to measure your body odor, the level will be predetermined by a panel of government experts. You can appeal directly to the stink panel and they will assess your odor in a nose on approach at the hearing(think I'm kidding? Don't be too sure).
