Marines will not seek to reinstate charges against top officer in Haditha killings
LA Times blog ^ | August 28, 2009 | Tony Perry

Posted on 08/28/2009 1:53:33 PM PDT by Sergeant Tim

The Marine Corps has decided not to seek to reinstate criminal charges against a former battalion commander at Camp Pendleton for a 2005 incident in which his troops killed 24 civilians in Haditha, Iraq.

Chessani Instead, the Marine Corps will convene a Board of Inquiry to hear testimony and recommend whether Lt. Col. Jeffrey Chessani should be demoted to major for purposes of retirement.

Even if such a recommendation is made and then accepted by the Secretary of the Navy, Chessani's retirement pay would still be based on being a lieutenant colonel.

The Marine Corps had sought to try Chessani for dereliction of duty for not ordering a war-crimes investigation when his Marines killed the 24, including three women and seven children. Chessani, who was not present when the killings occurred, reported to his superiors that the deaths, while tragic, were the result of fighting between Marines and insurgents.

A court-martial judge threw out the charges after ruling that it was improper for a Marine lawyer who investigated the Haditha shootings to sit in on meetings with the general who decided to bring the charges.

Wonder what that disgusting pig Murtha has to say about this?

[EXCERPT:]

REP. JOHN MURTHA: … on November 19th, we had an incident in Haditha in Anbar province, where a Marine was killed with an IED. Time magazine reported it, and it’s kind of a puzzling report, because they’re investigating it right now. Let me tell you what the consequences of this have been.

It’s much worse than reported in Time magazine. There was no fire fight. There was no IED that killed these innocent people. Our troops overreacted because of the pressure on them and they killed innocent civilians in cold blood. And that’s what the report is going to tell…

Good outcome, except for the reduction in grade meeting. If the scrutiny this great officer was subjected to was applied to Ted Kennedy and his ilk, we would have a lot less treasonous activity in this country. We thank the Col. for his service.

My lord, Lt. Col. Jeffrey Chessani is getting it up the shoot for doing his job, and not backing down.

Even the USMC is becoming politically influenced.

Such unadulterated crap.

Must be a profound disappointment for the military prosecutors, they so wanted to be like their brothers in the ACLU. First you get yourself all morally puffed up, then you wiggle your bottom to see if blood still circulates, then you stab your own countrymen in the back.

I would not be surprised if 1) AG Eric Holder investigates this, and 2) al Qaeda sues LTC Chessani.

Very good news ...

Well, yes and no. OF COURSE, it is good news that they won't try to reinstate the charges.

It is unconsionable that they are even considering that travesty of a Board of Inquiry.

The Colonel DID NOTHING WRONG!!!! He shouldn't have to face the consideration of a reduction of rank.

24 civilians in Haditha, Iraq

As always the media intentionally gets wrong the number of civilians, totally forgetting proof of insurgents, not just in Wuterich's squad's engagement, but involved in a general plan of attack that day throughout Haditha. It's all on the eye in the sky.

There was no dereliction of duty on Chessani's part, but I'm betting they want Chessani to contest this, so they can lay some other trap for him.

Two investigations found no dereliction. Trials have had no convictions. Charges have been thrown out.

This witch hunt is probably over because Murtha has his hands full trying to stay out of jail for corruption.

Good point, Chappie. Both Perry and Walker can’t quite come to post the truth when it comes to those killed at Haditha, some of them were armed insurgents and one of them nearly killed LCpl Sharratt.

It brings a smile to my lips that Murtha is having to worry about staying out of a federal prison, I hope he squirms and lays awake nights thinking about it.

The local police chief should send a letter to Murtha, explaining that police protection for him and his family is terribly complex and beyond the scope of the police department’s capabilities, and that because Congressman Murtha is a member of the House Appropriations Committee, and is Chairman of its Defense Subcommittee, they are therefore transferring responsibility for his family’s protection and emergency needs to the United States Marine Corps.

OK, so Christians are not being persecuted there.
OK, the Iraqi govt has offered to pay a dime of their own way.
OK, there was not just a major split in the govt over there.

Thanks for clearing that all up.

People that actually know about Islam, know that no form of “moderate” Islam is coming to the rescue as the Islamic world is getting stricter.

The Iraq war has not slowed down the march of Islam across the West one bit. The US is now more Sharia compliant than before the war. The US soldiers that I speak to online know that Islam itself is the problem and that democracy in the Middle East does not change the religious views of Muslims. Unlike you, in your look at me....look at me fantasy land, they see the truth.

But you go ahead an insult me as that is all that you have.

You will see reality when we leave.

Yes, it is great news for seven out of the eight that have so far been exonerated (for the most part) after being persecuted for doing teir jobs.

It is not a smart ass remark towards the Marines. It is called facing the reality off the Islamic world.

Non-Muslims are not going to dictate to the Islamic world what Islam is. No non-Muslims can do that.

He's clear of any further CM's but from the article:

He has ordered a Board of Inquiry to recommend whether Chessani "committed substandard performance of duty, misconduct and professional dereliction of duty" and deserves to be demoted for retirement.
