Massachusetts Gov. Deval Patrick (D) further fired up the political chattering class Wednesday morning when he told a local radio station he would approve a plan to appoint an interim successor to the late-Senator Edward Kennedy (D-Mass.) until a special election could be held.
"Massachusetts needs two voices," Patrick said during an interview with WBUR-FM radio, which was later picked up by The Associated Press.
Currently, Massachusetts requires a special election to be held between 145 and 160 days after a Senate seat becomes vacant. The law was first enacted in 2004 by Democrats who wanted to prevent then-Gov. Mitt Romney (R) from appointing a successor to Sen. John Kerry (D), should he have won the presidential election.
Although Kennedy himself first pitched the idea in a letter to state lawmakers last week, his efforts failed to cull significant political support. Democrats, including Patrick, remained silent on the proposed revision, while Republicans excoriated Kennedy for using the succession rule to advance a partisan agenda.
Despite Patrick's now-vocal support, it remains unclear whether the revision will clear the state legislature. Among other obstacles, the governor's approval ratings have reached record lows, and some lawmakers seem fearful of extending the Kennedy dynasty, even if by proxy.

The law was changed because of Kerry/Romney potential and now they want to go back to the old way when it benefits them.

And they fail to mention, that until 2004, the governor of Mass. would appoint a replacement if a Senate seat was vacant between elections.
That law was changed because, in ‘04, Mass. had a Republican governor, Mitt Romney, and they didn’t want him to appoint a successor if John Kerry had been elected president that year.
Geez, Ted’s been dead less than 24 hours and already partisan Democrats are taking about this issue??????

Does this not fall under the umbrella of ex-post-facto as the vacancy pre-exists the passage of such a law?
A prominent Republican needs to announce his candidacy for the seat NOW, so if the Democrats try to play games once the process is in motion the Republicans can claim that the Democrats are stealing the seat, and that they're really NOT for Democracy.

Subject: 2004 law best not be changed
To Deval Patrick,
Back in 2004 Ted Kennedy decided that it would not be in the Democrats best interest to have a Republican governor appoint someone to a seat if Kerry won his election.
Now the tide has turned and Ted Kennedy (supposedly) pleads that he now wants to change this law back so a Democrat (you) can appoint someone to his seat. Now a sympathy vote is going to be pushed on the citizens of Massachusetts and believe me, we don’t buy it.
Do not do this! You will be voted out and the backlash will be tremendous for Massachusetts. We are already a laughing stock and this will have a far reaching impact on not only you, but the citizens for even allowing this to happen.
How dare you even consider signing a bill that will reverse this law since it would benefit one party over another.
I will speak out and make sure that everyone I know, knows about this decision if you make it.
My family has been located in this state since 1630 and I will not allow this government to take over the citizens. You work for the citizens. I will vote you out and every person that believes they can change laws to benefit their party. You vote for the citizens and the citizens alone. This I demand from you as a public servant.

This one falls under the “Sure it’s unconstitutional. We’re going to do it anyway. So sue us and see what it gets you.” provision of Massachusetts jurisprudence.
Dose anyone, beside me, really doubt that Teddie actually wrote the letter to Deval?
The big difference between then and now is that:
1) New Jersey did that on he heels of national discontent over Bush v. Gore, and felt the public would let them get away with it, and
2) Massachusetts has to deal with general voter dismay over Obama's nationalization plans, the Democrat control of Congress and how they're operating (corruption, not reading bills, rushing bills through without suport, etc), and the public's attitude as shown in tea parties and town halls.
Pulling a fast on in Massachusetts could be the straw that breaks the donkey's back.
