This is out-and-out greed. Viruses are opportunistic. There is no way to predict 100% who will fall ill.

Yeah, healthcare costs are high because doctors like to perform unnecessary surgery for profit.

Has nothing to do with greedy lawsuits.

Nah, we don’t need tort reform.
Lawyers are our advocates.

He worked in a NYC city school system which means hard core union lib. Sad about this man getting sick but we oddly had no swine flu outbreaks when "Bush-hitler" was President.

I wouldn’t expect this to win, but there might be a settlement on the Q.T. in the low $100Ks.

This is beyond stupid!

One of the perfect examples of how screwed up our country is.....

Crap like this should be thrown out before it gets anywhere near being trial. We need a ‘firewall’ of sorts against frivolous lawsuits.

Complications besides the virus likely played a part in his death, officials said

That is the obligatory statement in each and every death. If the person had an ingrown toenail, they would still say it was the underlying cause.

That’s because teens are easier to be indoctrinated.

I regret the man’s death but his surviving family is grasping at straws hoping to win in our lottery justice system. Perhaps his family has a claim against his doctors for misdiagnosis. I doubt that his care was substandard. He was unlucky in the manner that the flu impacted him. Most have not had this experience.

His death was an unavoidable tragedy, not much different than a lightening strike. Blaming the school or doctors is a symptom of our bankrupt justice system and victim mentality. This family is just trying to cash in as many others have done.

"I wouldn’t expect this to win"

I wonder how many tobacco, automotive and pharmaceutical company execs uttered those same exact words over equally frivolous lawsuits only to eventually lose the case and get slapped with a multimillion dollar judgment.

Any practicing attorney will tell you that every case, and especially a civil case, is a crap-shoot when it comes to a trial by jury. Johnny Cochran didn't get to buy his G4 because juries are sensible finders of fact and culpability.

I'm guess, and it's only a guess, that the city won't settle the claim, even at it's nuisance value. It's sets too dangerous a precedent.
