Hundreds of FLDS protest land sale; judge weighing options

SALT LAKE CITY -- Hundreds of members of the Fundamentalist Church of Jesus Christ of Latter Day Saints (FLDS) showed up at the Matheson Courthouse Wednesday to show their opposition to the sale of land they believe is sacred.

A hearing was held in 3rd District Court, where a judge was considering the sale of several hundred acres of land known as "Berry Knoll."

After several hours of testimony and arguments, Judge Denise Lindberg declined to issue a ruling. However, she indicated she was open to the idea of opening the sale of the Colorado City, Ariz., farmland to the highest bidder.

FLDS member and spokesman Willie Jessop doesn't like it.

"She seems to just relish the idea of liquidating a trust that she, her constitutional duty was to protect it," Jessop told KSL Newsradio outside of court.

A court-appointed fiduciary who manages the United Effort Plan (UEP) Trust, which was taken over by the court in 2005, is seeking to sell the land to pay debt.

I told you so. It's always been about the land and money and a power grab. The manager of the trust is $3 million in debt to himself and his lawyers and wants to sell the FLDS land to get rich!!

This is a miscarriage of justice and a disgusting display of disdain for the U.S. Constitution.

Why should they have to buy their own homes and land? The judge apparently plans to sell to the highest bidder in secret bids.

Again, the accountant in charge of the trust - who hates the guts of every FLDS man, woman, child and baby - wants to be paid $3 million for himself and his lawyers due to the fact that he has mismanaged the trust in the first place. The courts asked him to manage the trust and now it’s $3 million in the hole.

I do not agree with the FLDS life style and religion but what is happening to them is so horrible it defies logic, common sense and common decency. But most importantly, it spits on the Constitution.

Guess you don’t believe in free speech. The “organized crime syndicate” in this case applies to the out-of-control government trying to destroy a people and their religion.

Remember, every one of the over 400 innocent children - rounded up at gunpoint at the ranch in Texas - have been returned to the families. Every one.

Twelve FLDS men are to stand trial in October. If they are found guilty, I say “hang ‘em and hang ‘em high.” Meanwhile, in this country people are innocent until proven guilty.

Furthermore, let’s say the 12 are guilty as charged. Why on earth would you want to punish the entire community, steal their homes, terrorize them, and destroy their lives? Haven’t the FLDS children suffered enough already?

Innocent until proven guilty. That’s what’s wrong with the case from the get-go. People assuming that the entire FLDS community - as a group, including children and babies - should be exterminated from the face of the earth because their religious beliefs are weird.

I don’t like Scientologists - and those weird Christians who let their children die rather than take them to the doctor - but I don’t want to exterminate them and steal their land and property.

Why did the Court suspend the trustees of the Trust?

The Court found that the trustees had breached their legal duties and were not acting in the best interests
of the Trust and its beneficiaries. The Court found it necessary to suspend the breaching trustees and to appoint
a special fiduciary in order to preserve Trust property for the benefit of the Trust beneficiaries. The trustees
breached their legal duties by, among other things:

(1) failing to defend against lawsuits which had been filed
against the Trust; and

(2) transferring valuable Trust property to the detriment of the beneficiaries of the Trust.

(1) In 2004, two lawsuits were filed against the Trust seeking an unspecified amount of damages from the
Trust. The trustees had a legal duty to defend the Trust against the lawsuits. However, the trustees
failed to appear or defend in either lawsuit. As a result, the Trust was subject to the entry of a default in
each lawsuit. Such default could have resulted in the entry of two large monetary judgments against the
Trust, and the resulting loss of substantial Trust property to satisfy the monetary judgments.

(2) Shortly after the lawsuits were filed, the trustees transferred valuable Trust property away from the
Trust. Specifically, the trustees transferred 1,311 acres of Trust property near Apple Valley, Utah, and a
large manufacturing building in Hildale, Utah, for little or no consideration. As a result of the transfers,
the Trust lost significant assets which otherwise would have been available to satisfy the debts of the
Trust and/or to be used for the benefit of Trust beneficiaries.

Because the trustees failed to respond to the lawsuit, the homes upon Trust property were at risk of
being lost to the creditors of the Trust. Accordingly, the Court intervened to protect the beneficiaries of the
Trust. By suspending the breaching trustees and appointing the Fiduciary, the Court enabled the Trust to
defend itself against the lawsuits which had been filed against the Trust. Such action also enabled the Trust to
seek the recovery of the property which had been transferred away from the Trust.

FLDS broke with the REAL Mormons over one hundred years ago. I think the FLDS call themselves “Mormons” but then Harry Reid calls himself a Mormon, too.

Anyway, this isn’t about FLDS vs. LDS!!

It’s about how an entire community is being railroaded by an out of control government.

Every red blooded American should be outraged. If they can do this to the FLDS, they can do it to you.

What has changed?

The AG of Utah helped develop a proposal to settle this nightmare but it would have returned some authority back to the FLDS so the judge threw it out.

Now, this one judge has grabbed all of the power for herself and she apparently is not interested in affording Constitutional protection to the FLDS community.

The way the FLDS have been abused by an out of control government puts us all in jeopardy. If it can happen to them it can happen to any of us.

Especially in this time when Obama and his minions are preparing to destroy our country by robbing us of our American way of life, we should all be concerned.

This thread is about how an out of control government kidnapped over 400 innocent children, dumped them in a filthy coliseum, ripped them out of the arms of their mothers, and farmed them out in creepy foster homes all over Texas. And that was just the beginning.

It’s the story of how an entire community can be treated as one big criminal without due process, Constitution be damned.

It’s about how innocent people can be treated as lepers and outcasts.

It’s about how innocent people can be accused, convicted and harassed without due process.

It’s about how American has gone to the dogs.

The only thing this is not about is whether the FLDS are Mormons. I don’t understand why you are obsessed with trying to turn this into a religious argument.

This is about our country, our Constitution, and our way of life.

I didn't see any pictures of government employees pointing guns at anyone to force them out. Got any sources for that?

This is about debt and money owed and land. Why are you dragging *the children* into it?

Hang loose. Rick Perry hasn’t gotten the NAU/TTC/NAFTA/ or whatever you want to call it ready for construction yet. When he does then look out as the land will be the first thing to be usurped by the state and then they’ll convert the facility into a huge transit stop area with hotels/eateries/recreation/etc. /sarc, lol

By the way, several adult women (from TX FLDS) were held against their will for two months. Two gave birth while in captivity. Is this America? Whatever happened to the Constitution. The thing was started on a false report.

If they can do that to them, they can do it to you.

No, although it is all in God's hands ultimately. But I'm not here defending their illegal actions against women and children - and I'm not a member of their cult either.

I watched in horror as the Branch Davidians were terrorized and burned alive - including children.

I watched in horror as the FLDS community was invaded in a military-style attack and had their children rounded up.

Similar situations and circumstances. Yet it appears that most conservatives were horrified at the former but many are not upset at all by the latter.

Go figure.

Non of the latter were burned alive. Perhaps that is the cause of the disparate reactions by Freepers.

I too wonder why you think the two incidences are so similar when they obviously are not.

The FLDS have repeatedly and continually broken the law in regards to marriage and especially to minor girls and statutory rape. There are prosecutions pending. No one has been killed or irrevocably harmed, but only inconvenienced. The arrests and investigation were warranted because of the lack of compliance to the laws of Texas and the USA regarding polygamy.

My suggestion to you and to the FLDS is this; if you don't want to be investigated and possibly arrested, then quit living in polygamy and quit forcing little girls to marry old men.

If the manager is in debt $3 million for managing the property then he has every reason to sell the property to recover the debt.

BTW, the land's not sacred. I have it on good authority ~ from the Great Maniteau Himself in fact ~ "the land is not sacred but you must cherish every reindeer and mushroom".

That's what He said. I hear you people have been abusing both the reindeer and the mushrooms. He is not pleased.

ORDER The Special Fiduciary is hereby authorized to establish a bid process and to publish it so that interested purchasers will be informed regarding how to bid on the Property. Interested purchasers must submit sealed bids with the "best and final offer" directly to the Special Fiduciary. The Fiduciary shall review the bids received, if any, and determine which offer in his business judgement, will confer the greatest overall benefit to the Trust.
