Stuart, Fla. (AP) --
A South Florida hospital that quietly chartered a plane and sent a seriously brain injured illegal immigrant back to Guatemala over the objections of his family and legal guardian did not act unreasonably, a jury ruled Monday.
Health care and immigration experts across the country have closely watched the court case in the sleepy coastal town of Stuart. They say it underscores the dilemma facing hospitals with patients who require long-term care, are unable to pay and don't qualify for federal or state aid because of their immigration status.
Deputy Court Clerk Carol Harper said the unanimous 6-member jury found in favor of the hospital.
Jack Hill, an attorney for the legal guardian of 37-year-old Luis Jimenez, would not immediately comment on the verdict.

I agree with the decision, but I have to wonder, where the hell is that drunk that put that poor guy in that condition? Illegal or not, nobody deserves what happened to him. I hope that he gets what he needs in Guatemala, it’s really sad.

IMO,it depends on the details of the incident (which I haven't heard).If the comatose guy was,in fact,a truly innocent victim (in the wrong place at the wrong time) then I agree that he should get all the care he needs in his homeland.But if he played any kind of substantial role in his own injuries (he provoked the incident,for example) then I'd argue that he's already gotten what he had coming to him.That may sound cruel but,IMO,actions have consequences...for legal *and* illegal residents of this country alike.
It is important that all of these people be given an opportunity (nudge) to return to those superior health care systems from which they came. Then the 0ne can stop apologising and screwing with ours.

I guess I’m on a rant because I have no sympathy whatsoever with drunks who “accidentally” kill someone else. I can’t visualize this “victim” agitating someone to purposely hit him, but I don’t know the whole story, you’re right. I just wish that these people who drive drunk get no leniency whatsoever. None. There are no second chances for their victims who are killed or left to be tended like a vegatable garden after the “accident”.

But what I *do* know is that regardless of his level of "guilt" or "innocence" in this case neither the taxpayers of this country nor any given health care facility in this country have a moral obligation to provide him with a single minute's worth of care.

It seems that the Dims want to build a system for every exception, no matter what it does for the normal cases. The GOP should be building a system for normal cases and let the exceptions be handled as exceptions.
That is one of the reasons that I BARF when politicians (of either party) or the media make a big deal out of exceptional cases. Speeches or Town Hall meetings that highlight tragic cases are not indicative of how every case needs to be dealt with.
It's two separate issues we're discussing.1)To what degree,if any,did the comatose guy "have it coming"? and 2)Is he morally entitled to free care on the taxpayers' dime or at the expense of a particular hospital/nursing home?
Every once in a while, honest people sit on juries and good news makes it’s way onto the web. Don’t expect this to receive much coverage though.
I’m not arguing that point, I agree with you 100%. It’s the softie in me that gets upset when anybody over 70 is saddled with a burden like that son of hers. Hey, I get your point, his decisions brought him to where he is today, if he hadn’t broken our laws to come here illegally, he’d be up and walking around, poor for sure, just a heck of a lot healthier.
It’s just a sad situation for him moma is all I’m saying, innocent or guilty. He, on the other hand, is paying dearly for his crimes, whatever they are. Let’s pray for him, shall we? He’s gone, and not our problem anymore. Plus, his attorney has inadverdantly given us a gift.
Hey, now there’s the makings of some new jobs! Call it Adios Air and offer one-way only fares to all hospitals. Way cheaper on the hospital and taxpayer alike.
I have compassion for the man who needed treatment. But for the grace of God go I. I thank God every day that I won life’s lottery by being born in this great country. In my own life, I do what I can to help people.
However, our compassion is destroying this country. We have seen what it has done in California. We have tried to be so compassionate that the entire system is on the verge of collapse, and we will be able to help no one.
Had this been decided any other way, U.S. taxpayers would have been bankrupted. All a person in this condition would have to do would be to get someone to get him over our border. Then we would be responsible for them. We cannot afford to provide health care for the entire world.
Don’t think that Hospitals are not going to do this more often. There are a tons of these type case around.

Yes, it is sad what happened to this man....but does not take away the fact that he broke the law....and his law-breaking may have took away health care or quality of care from a US citizen....possibly someone’s child.
