"Police are investigating a brick with an offensive message thrown into the window of an East Austin home.
The brick, thrown through a 4-year-old boy’s bedroom window, read “Keep Eastside Black. Keep Eastside Strong.”
The homeowner, Barbara Frische, who is white, said she has lived in the home for 10 years.
“It’s the first time anything like this has ever happened to me,” she said.
Police have not classified this incident as a hate crime, said Austin Police Sgt. Richard Stresing, because hate crimes target an individual specifically because of an identifying characteristic, like race. Police say the incident has been classified as criminal mischief and deadly conduct.
Incidents found to be based on race, sexual orientation, ethnicity, disability or gender are flagged as hate crimes, Stresing said, so they can be referred to the Department of Justice.

Was the brick Mirandized? Was the brick allowed to talk to a lawyer? Did the brick come from a poor and disadvantaged set or circumstances which would explain the brick’s behavior?

Huh? It says on the brick "Keep Eastside black," and it was thrown through the home of the only white family. What else do they need?
Someone please explain to me why this incident would not be considered a ‘hate crime’ under the definition. The message is clearly race related and because it was attached to a brick thrown through a window, it is clearly intimidation and criminal.
This is not being prosecuted because the victim is white. Are whites excluded from the hate crimes laws?

The answer to your question is yes. I don't mean any criticism of you personally but anyone who doesn't realize this is totally unaware of the reality out there. Hate crime laws are meant only to target whites.
This is clearly a hate crime and the authorities should throw the book at the brick.

Ahhh, but the brick wasn't stamped, nor addressed to anyone other than occupant; and had no return address, so that just makes it a pre-sorted, second class solicitation from a non-profit organization, soliciting participation in a new painting and paving project, utilizing blacktop and black paint, delivered by non-traditional means.
If this gets the desired response, the sponsoring organization may attempt to take it viral.

No surprise here. Hate crime laws were created for the express purpose of putting Whites in jail for anything they might do or think, or not do or not think, while letting non-Whites go free for any crime committed against Whites.
Change the colors and the headline is something like “police investigate racial incident” and the article keeps repeating “the homeowner, who is black...” and “keep the neighborhood White” two or three times until everyone gets the point.

It is only politically-correct to consider something a "hate crime" if it is against a member of a "traditionally oppressed" group by a member of the "dominant culture".
Just as academia has defined "racism" as something only white folks can be guilty of.

These people are playing with fire and they know it. I have been seeing alot more of this black on white racism lately. It is bubbling up everywhere and the media gives it a complete pass....just like they gave the racist rants of Obama’s preacher for 20 years a pass. Let’s be clear here...it was blacks that voted for Obama 98-1...not whites. THAT is racism on parade.
I truly believe that Obama is stoking this fire. Eric Holder is stoking this fire and they are doing it on purpose. A race war would be just what Dr. Ayers ordered.

What got the various "Civil Rights" laws passed, what stopped segregation, what got slavery ended in the first place, was that the majority of white folks thought it was the right thing to do.

Look, if this had happened to a black family in Hyde Park with the message "Keep Hyde Park white", the Rev Je$$e J@ckSon and @l $h@rpton would be on an airplane to Austin. Barbara is lucky it was only a brick, not a bullet or Molotov cocktail.
I agree. My mother was a civil rights worker in the south during the worse of the civil rights era. She was a Goldwater republican and worked very hard on the front lines to secure the rights of blacks.It was mostly the republican party in those days working for civil rights in the south. The democrat party was made up of Klansmen and bigots. I have never understood how the media gets away with painting conservatives as racists in light of the facts....but they do.

Some do-gooder friends of mine thought they’d move into Detroit and help improve the city.
Their house has been on the market for a year. They keep getting broken into. People who visit have their wheels stolen. They learned their lesson the hard way and now want to get out, but can’t.

No bias in that statement. Just because the brick mentioned keeping the area black and was thrown through a white person's house doesn't mean it was racist, no siree. The police are right on top of that aren't they? Does anyone believe they would have made it a hate crime if the roles were reversed?
Do away with hate crimes, they are unconstitutional, they are thought crimes and have no place in a free society. It is a crime to throw a brick through the window of a house and try to run people out of a neighbor hood. The hate part should be understood, all crimes are crimes of hate in one form or another.
