Moberly, MO agrees to pay $2,400,000 in taser death

MOBERLY, Mo. (AP) - Attorneys say a northeast Missouri city has agreed to pay $2.4 million to survivors of a man who died after police fired a Taser at him numerous times.

Lawyers for the family of Stanley Harlan, 23, say the settlement with the city of Moberly was filed Monday in U.S. District Court in St. Louis.

The agreement includes an indefinite moratorium on the use of Tasers by Moberly police officers.

Harlan died in August 2008 after being pulled over by a Moberly police officer who suspected him of drunken driving.

The lawsuit said other Moberly officers arrived and Harlan got into brief verbal exchanges after getting out of his vehicle.

He was stunned multiple times with a Taser and lost consciousness.

The lawsuit said Harlan died a short time later.

Tasers have a place in a good officer's tool set, but some cops misuse and abuse them.

How about "quit misusing tasers"? I like that better.

I agree but I do think way too many people end up dead when Tasers are used. It’s supposed to be non-lethal but clearly that is not the case. My prediction is they will be banned from use by LEO or civis.

Night sticks are mean but how many deaths have you read about from thier use. It seems like one a month from tasers, so to me it does not matter if the situation warranted the use of the device or not, suspects are ending up dead WAY to often.

A local paper had a comment which may/may not be true, but I found interesting:

The victim was not drunk. He worked at a bar/restaurant and was coming home directly after his work shift. The Moberly PD had been harassing him for weeks because one of their own was dating his ex (mother of the child). It was flat out harassment. It continued to his family after he died. Moberly PD had better wake up and quit harassing people. They have done it to me thinking I was someone else until they pulled me over for "speeding" which I know I was not doing as I had just looked at the spedometer and had 6 minor girls in the vehicle with me. I am a mother and a very careful driver, especially with children in the car.

well I wonder what the drunk driving suspicion was based on? Did they eventually find alcohol or drugs were involved? If not, well that does not look good. And in the end a 23 year old is dead and I’m doubting he did anything to deserve that. I could be wrong but my instincts tell me something was not right with this incident and the jury acted acordingly.

Wow. Are you my twin? I used to be gungho LEO supporter, but I've been disturbed by several personal experiences, as well as reading many stories of wild overreaction by cops.

This month I watched a video of a 70+ yr old lady getting tasered for being mouthy, this by a very large cop, who could have thrown her ten feet as an afterthought. Wild overreaction. I mean just plain stupid.

See the FR thread of the Chicago off-duty cop that beat down a tiny female bartender on camera. These weren't slaps but deep blows and kicks to the torso. He was put on parole btw.

Somehow this reminds me of the Islam excuse: The bad guys are such a tiny, tiny percentage, but the good guys can't/won't clean house. Whatever.

Agree! At least stop using them multiple times, unless a cop's life is in danger. They got carried away with them, and use them in place of dialogue.

Really? Compared to what, exactly?

How many officers have died because they DIDN'T have a Taser?

How many suspects lives have been saved because they were Tased instead of shot?

You can't just take Tasers out of the equation and erase the deaths. Something else would have to be done in those situations, and that "something else" may end up in death too. Maybe the death of someone innocent.

It's a messy business, and I'm not about to blame it on the Taser.

You bet I'm serious. This has nothing to do with human life being worthless. It has to do with lawyers finding another excuse to extort money from the public.

People are murdered all over the United States. Murder/manslaughter used to be a crime, not a tort. If the a jury would find the cop's actions criminal, I would have no problem seeing him executed. He is the one responsible. Instead lawyers have turned these cases into torts whenever there is some loose association between the person who committed the crime and some entity with supposed deep pockets. The people of Moberly are no more responsible for this death than you are. But some law firm just extracted one million dollars for themselves from the people of Moberly and you see this as some sort of justice.

BTW, only legislatures were supposed to initiate public spending the way our governments were set up. Now courts do it all the time; always to the benefit of the Brethren of the Bar; and never with an eye to the damages this has done to our system of government. (Democracy by Decree by two reformed left-wing lawyers considers the damages.)

you know, its often difficult to get a conviction on a LEO, regardless of the situation. there was no other real recourse but to hit them in the pocketbook.

i dislike frivolous civil lawsuits, but i dont have a problem with this one.

40 cops at 8:00 AM pulling everybody into a parking lot for a “ DUI” check point,rarely catching a single one.

Now that would piss me off. Who's drunk at 8am?..and they're going to make me late to work for this nonsense? They would need to taser me.

the town happens to be the cop’s employer. the idea here, is that the employer of the idiot cop will modify their training regiment in order to prevent another incident of police stupidity in order to avoid another ridiculously expensive lawsuit.

Have you ever seen these HR training videos? Anyone whose behavior can be changed or conditioned by one of these is an idiot you wouldn't want to hire. The people who are not idiots spend several hours a month answering stupid computer quizzes and a equal amount of time joking about this stuff. All of this HR BS just costs the town additional money. Policemen I know seem to understand that they are not supposed to kill people during traffic stops. And I think they knew it before they were on the job.

Meanwhile, your lawyer buddies are in fat city.

wow, to be a cop i just have to sit around and watch HR videos? training is an integral part of any occupation more complex than digging holes.

this cop killed someone because he is a jack booted asshole, and because apparently NO ONE TOLD HIM that was an inappropriate use of his equipment. well i bet the people who are paying for this lawsuit will correct that deficiency. they should take the 2.4 million out of the asshole's paycheck

You know something. I don't know much about the facts in this case. I don't even know if the cop did anything wrong. 23 year-old males have a way of being @$$holes, especially when they've had too much to drink. Cops can be jerks too, but not knowing anything else I'd trust a cop over a 23 year-old male who cannot keep his car in its lane; and then becomes even slightly abusive. I don't know about you but I've been stopped several times in my 45 years of driving; once even because some cop thought I might have had too much to drink. None ever tased me.

Tasers obviously kill people from time to time. So do hamburgers. You want to run the world for the 0.00001% that are harmed by these things. I want to see it run for the rest of us; and if those 0.00001% fall by the wayside, so be it.

And if the cop in this case was the one who was drunk or out of his mind, then he is a criminal and should be charged and tried. Having your legal scumbag buddies rip off the taxpayers, who have absolutely no involvement with the cop, as if they were so concerned with the dead kid and performing a public service is just obscene.

you dont stop eating hamburgers because you might choke by accident. multiple taserings by the cop WAS NOT AN ACCIDENT.

it is too bad about the tax payers (in this case they elected incompetent people to run the police force. hopefully this episode will result in better government) or the lawyers (who i dont care for really, but you cant be wrong all the time).

I'm for the American rule of law. I've said as much here, and you choose not to read or pay attention. If the cop is a "murdering cop" as you suggest then he should be prosecuted under the laws against murder in the State of Missouri. That's how Jefferson and Madison would have had it. You apparently think the guy cannot be indicted much less convicted of this crime that is so cut and dried to you.

BUT WAIT! There's a financial opportunity. $1.4 mil to the dead guy's relatives; and $1.0 mil to some scumbag lawyers from anonymous taxpayers who had ABSOLUTELY NOTHING TO DO WITH THE ALLEDGED CRIME. Yeah. Madison and Jefferson would have loved this. And you think I'm the statist !!!

me, i am a realist. there is no chance of justice for the guy's family in criminal court, so the next best thing is civil court.

money does not make up for the loss of a family member by a idiot thug of a cop. how much money lawyers make is irrelevant.

This question boggles the mind. I would say zero cops have died because they didn't have a taser. If the situation is life threatening they have guns. Tasers were not meant to save cops lives but to take down people for arrest who might have to be clubbed silly without tasers. Tasers are misused, and people are dying because of it. Certainly no officer has ever died from lack of a taser!

It is no such thing. It's a recognition by the town's insurance company that when the unwashed, conditioned by getting half the story in cases such as that of Rodney King, get smoothtalked by slippery lawyers almost anything is possible; even getting awarded millions of dollars for buying hot coffee.

You are confusing this with cases where big corporations are sued. Yes they settle very often when its clear they were not in the wrong.

When city hall settles out of court it’s because they are guilty as sin and fear for there jobs and freedom.

I’ve done some research on this case since the last post. Those involved are very lucky they weren’t brought up on criminal charges and they still may not be in the clear.

I’m not anti law enforcement but I am pretty sure we are nearing the end of the Taser. They will be banned from use and for good reason. This case however has a serious odor to it and I suspect there was something other than legitimate law enforcement going on here. Apparently the lawyers for the city agree and no they don’t just settle to end a dispute they only settle when they know wrong doing will be proven if they go to court.
