Officials: Harris Man Fatally Shoots Teen at Home (Crack Head Teen)

A homeowner who had twice ordered a teenager to leave the property — once while holding a rifle — shot the teen dead after the boy refused to leave and walked toward him, authorities said.

“He feared for his life,” said Harris County sheriff’s Lt. Rolf Nelson.

Dwayne Austgen, 69, was inside his north Harris County home in the 5500 block of Susanna around 10:30 a.m. Wednesday when he noticed a teenager in his front yard, officials said. The man went outside, confronted 17-year-old Vidal Herrera, and told him to leave, authorities said.

Texas, the “he needed killin’” state. It a lot of other places the homeowner would have been in deep dutch for this, especially if no threat had been uttered.

The shooting aggravated an already anxious neighborhood. Residents in the rural cluster of tidy homes and trailers said that over the past four months, burglars have taken all-terrain vehicles, tools, bicycles, and navigation and stereo equipment. Janie Witcher, who lives a few doors down, said she and other neighbors have been nervous for their safety since the rash of crimes, worried the burglars might become violent. Witcher said another neighbor pulled a shotgun on a burglar about three months ago and had a difficult time scaring him away.

“I’ve had my kids sleeping in my room,” she said. “My son is constantly looking out the window.” Her son, Kyle, has been sleeping with a baseball bat for weeks and plans to keep it that way for a while.

Sounds like a wonderful neighborhood

Self-defense shootings are going to be common as druggies and other moochers have their benefits cut off. Lock and load.

No worry there. My 120 pound black faced German Shepherd can hear a twig break 400 yards away, and she has no fear of *anything*.

This story had a happy ending, but it sounds like there’s a few more characters in that neighborhood who need to meet the same fate.

The excerpts give a slightly different impression of the chain of events than the source article. Despite one's interest in protecting property, confronting a trespasser outside your domicile is not always going to receive a positive legal result. In this case the offender was ordered to leave, left, and then returned. That is going to help the victim justify his actions in the eyes of the law. (Yes, I know he shouldn't have to justify his actions, but that doesn't help if he still ends up in prison.)

The source has the following statement.

Residents in the rural cluster of tidy homes and trailers said that over the past four months, burglars have taken all-terrain vehicles, tools, bicycles, and navigation and stereo equipment.

This type of crime in indicative of drug users looking for items easy to fence. I would bet this crack pipe discovered by the victim is not the only paraphernalia that has been found lately in this neighborhood.

Good work old timer. Now we have one less crack head scumbag to commit future crimes. You may have saved someone’s life by putting that little creep to sleep.

No worry here either we have a 90lb German Shepard / Chow mix who can hear a leaf blowing at 408yds. And a 170lb Newfoundland who doesn’t seem to have a clue about anything. I’m still not sure he even knows his name. But he gives moral support to the other one in a “whatever” kind of way.

So the whole “opening a dialog” thing doesn't always work. Somebody call the White House.

Hey! My 2 dobermans ( 100 pounds and 130 pounds) can hear me open a package of cheese from 40 feet away when they are in a deep sleep in “their room”. If I open a ziplock that has cheese in it, they come bounding down the hall. Not the case with carrots. Just cheese. Sometimes they seem to ask for a reason to go into full watchdog mode, like when they are one run short of enough exercise for the day. They like their job. Opps one of them heard me typing and came in the room. Passed out next to me, all 130 pounds of him, the lovable fuzz ball.

The key here is that only one testimony is available. The scumbag could have been reciting the Gettysburg Address but he won’t be testifying......
