Santa Clara County agrees to pay $1 million in lawsuit over Naked Guy's suicide

To many, Luis Andrew Martinez was simply the Naked Guy — a Berkeley fixture who gained national notoriety in the 1990s for refusing to wear clothes.

About 10 years later, on May 18, 2006, isolated and alone in a Santa Clara County Jail cell, Martinez — a diagnosed schizophrenic — tied a plastic bag around his head and killed himself.

Today — on the third anniversary of his death — lawyers for his family plan to announce a $1 million settlement reached with Santa Clara County, along with an agreement from the county to adopt a policy in how it deals with mentally ill inmates.

"Andrew was a victim of a failed system of criminalizing mental illness and warehousing sick people in jails without adequate facilities and qualified medical staffs for the treatment of their sickness," said Geri Lynn Green, attorney for Martinez's mother, Esther Krenn. "The whole safety net fell apart in Santa Clara. It was a total failure by the jail to provide necessary care."

In the wrongful death suit filed in federal court in 2006, Krenn, a Cupertino resident, accused the county of violating her son's civil rights by failing to provide the proper care for him and allowing conditions at the main jail to deteriorate to the point where they ignored his safety.

This mentally ill guy goes to school naked for years and is embraced and portrayed as some soft of hero of liberal freedom of expression. Yet when the same illness causes him to tie a bag on his head it’s all the jails fault. Go figure.

Blame squarely belongs on the shoulders of the ACLU, they forced mental institutions to close, because they thought it was degrading for mental cases to be locked up, and that they should be on the streets.

He was smart enough to attend UC Berkeley but didn’t understand that he should wear clothing?

So, if a pedophile feels rejection because a same-sex 9 year old rebuffs his/her advances and kills himself (and put in jail for inappropriate behavior), we are supposed to pay him money?

We are spinning into insanity at blinding speed.

Our schools and even the world could not produce the med staffs necessary to adequately deal with the US’s mental illnesses that you would find in our nation’s prisons, and staff half way houses and drug abuse centers and all our hospitals, and nursing homes or find enough health techs and psych techs who are dedicated enough to want to work at top effort at 8 dollars an hour average salary!

The man’s family should have taken this young man firmly in had and got him help before he ever got to this stage...screw political correctness.

When someone persists in doing something that's clearly outside the norms of society, it's a sure sign that all is not right in that person's mind. The same is true, I think, for homosexuality, despite the fact that the psychiatric profession has succumbed to political pressures and declared the condition "normal."

Yes. Why weren’t they (the family) taking care of this guy? Another reason California is broke. It is a damn jail for God’s sake. Not the Four Seasons. Or Bath England—a nurturing retreat for the sickly. It is a taxpayer funded institution. She is stealing our money. This is BS. She got paid for neglect herself.

The school didn’t even have the wherewithal to tell this idiot it was impermissible to go to school naked. But the jail was responsible for his suicide.

His parents were responsible for his suicide.

One would think his actions were a cry for help.

Then again, maybe this would be next on some people’s agenda. The arguments I hear for same-sex marriage - “religion should not be a part of the law,” “how does my nudity affect YOU?” and “if you don’t like nudity, don’t go nude” - would probably apply to indecent exposure laws. Even the name “indecent exposure” would probably be attacked as “forcing your morals on me” and “trying to tell me what to do with my body.”

Health concerns? If we’re going to give state sanction to sexual practices that are exceptionally good methods of transmitting disease, then mybe there’s no health reason to prohibit this.

No, I do not want to parade around nude in public. My (partly) tongue in cheek arguments just show how far we’ve fallen.

Maybe an Obama appointee or two or three to the Supreme Court can work on locating this “right?”

I wouldn’t doubt if some on the left have done so already.

In the beginning I was wondering how this guy was getting away without being arrested for indecent exposure or being expelled for sexual harassment. I was amazed at how long it took for people to start speaking out.

sue berekely university. they allowed his crazy behavior to set in deep by allowing him to sit in classes exposing himself. I fell sorry for any real students that had to suffer with this crap. the university leaders are real a-holes to allow this guy to do this to himself, and to make other student put up with his mental defects. The state is at fualt here clearly, not so much the jail (possibly) but the University (state run) and local police (for refusing to arrest him for indecent exposure) this guy needed treatment for mental probelms long ago. the government which is responsible for general welfare should have locked him him for his own protection and to protect others. anyone that is this wacked out is a potential danger to the general public. yeah he was truely sick. too bad this happened, we are very very fortunate he was not crazy enough to try to take out others with him. he probably did damage to others by walking around naked. how does that effect imprssionable children?? distract class time for collage students trying to learn, he should have been locked up long ago. they crtazy state of california failed him. his family could not or would not help, this is when the state does need to step up and take responsibliltiy. the state activily encouraged his behavior by ignoring laws for public nudity/indecncy. the university seems most guilty by allowing him to attend class like that. the teachers should have refused to terach him, the student shoudl have boycotted class. I would not have put up that crap in school.

I suggest that santa clara jail counter sue the city of Berkely whose police did not arrest him for nudity, they should counter sue the universtiy for allowing him to fester in his nude mental condition by allowing him to attend class 9and no university police arrest)

the tax payers of sant clara shoudl not be sued, but berkely and the university should... If they losse enough money , maybe they would expell naked “students” and arrest folks that violate public nudity, exposure laws. they all thought hahaha, this guy is naked, lets make a big deal out of it and let him show off, well they is the ones that did him in, allowing his INSANE behavior. what do you expect from ultra-liberal berkely. Berekely lost one of their children when he died. One of Berekely’s finest ‘free spirits’ doing his own cool thing in public. Yuck!!!!!!

Why didn’t his family keep care and track of this guy. They don’t deserve money for his death. The tax payers are not responsible for this. The police are not responsible for this. The family should have done more.

...this was one of my favorite stories that happened while I lived near Berkeley (I'm from Kansas). The naked guy essentially tied the campus up in psuedo-intellectual knots as they tried to decide which leftist nostrum to apply in his case: was he was a vanguard of freedom of expression and making an important indictment of societal norms? - or was he guilty of sexual harrassment by making the campus and classroom un-comfortable for females? I hoped it was all just a put-on, but, apparently, he was just a crazy dude.
