Murtha-Inspired Charges Against Marine Collapse

The government has decided to give up on an existing case that had subjected a Marine commander to a criminal trial for his supervision of a team of soldiers attacked by insurgents in Haditha, Iraq, in 2005.

But it remains possible the case will be re-filed against Lt. Col. Jeffrey Chessani, according to lawyers with the Thomas More Law Center, which has been working on his defense.

WND reported just days ago when the Navy-Marine Corps Court of Criminal Appeals denied without comment the government's motion to reconsider the case against Chessani. The decision followed a ruling from a three-judge panel there that unanimously endorsed a decision by Col. Steven A. Folsom dismissing the case against the officer.

Now the law firm said it has been notified by the government it will not file an appeal with any higher courts, including the U.S. Supreme Court.

It’s amazing how people who claim to love America can demonstrate such vitriolic hatred towards Americans - John Murtha and his ilk should be ashamed of themselves for the damage they have done to this nation’s image around the world - And, Obama wants to continue blaming the Bush Administration for what his cronies in Congress created.

This POS is my congresscritter due to redistricting. Most of his constituents get all of their info from the msm and their union newletter. They are of the “demonrats=working man, republicans=robber baron mentality. There is no getting through to them.

Run such ads in Marine / Navy / Army times / VFW / Legion. Get the candidate on the shows with talk radio circuits - I bet Hannity would support a campaign just to get rid of Murtha. Rush and a few other just might give him an hour to get the word out.

We could ask the Freeper community first to donate, then to send emails and snail mails to 10 of their military friends and personally ask them to donate as well.

Yes it is a negative campain but hey, if it gets Murtha out and we get even a halfway conservative candidate then it will be one more district that will swing to our side come 2010.

And how many years did you spend in combat in Viet Nam?

That's what I thought...you've spent too much time watching John Wayne movies.
FYI, I hate to burst your bubble but John Wayne was an ACTOR who wore a girdle and a toupee and NEVER saw a day of combat...

Being a Viet Nam combat Marine myself who has spent years exposing Murtha, I have no love lost for him but “fragging” is a crime and anyone convicted could be sentenced to death. But of course, you, being an old crusty war veteran, would already know that. Murtha is not worth spending one day in the brig much less being executed over. People in PA just need to get off their rears and vote this clown out of office next year and he'll be about as consequential as a pimple on an elephant's ass.

There are entirely too many keyboard clowns on FR who never spent a day in combat advocating actions that they know nothing about.

Well if we are going to give Murtha the boot, we need a candidate to rally around. It would be great if we could get one of the Marines involved to run against Murtha. Frank Wuterich is the one who filed the suit and may have enough of a chip on his shoulder to go after Murtha’s seat.

If we can’t get one of the Marines, then any Marine would do in a pinch. Whoever the candidate is they would have to meet certain qualifications:

1) Have to live in the district
2) Have an upstanding background
3) Be of good moral character

Eagle6, since you live in the district, any chance you can pull point on this and find a good conservative pro-military Marine who is willing challenge Murtha? VFW and Legion might be a good starting point.

The government could have pursued the case to the civilian Court of Appeals of the Armed Forces and then the Supreme Court. However, because the dismissal of the charges came without prejudice, the government could restart the case from the beginning, the law firm said.

If that is to happen, the Marine Corps must appoint a new convening authority that was not involved in the earlier case, since Folsom's ruling was based on "Unlawful Command Influence," which would remain an obstacle to the case should any of the same prosecutors be involved.

if the government at some later time tries to pull of some shit regarding the colonel, they will only be showing their true colors. The case should be closed forever at this point.
