Regulatory czar nominee favors gun grab, animal rights, 'Fairness Doctrine' for Net


– The announced retirement of Supreme Court Justice David Souter could result in Barack Obama's nomination of a man who has been an outspoken proponent of tough restriction on gun sales and ownership, a ban on hunting, animal rights and what has been characterized as a "Fairness Doctrine" for the Internet.

Cass Sunstein, a law professor friend of the president and his current nominee to be regulatory czar, is on a list of eight possible names, including Secretary of State Hillary Clinton, to replace Souter in an article in Atlantic Monthly.

"Among those who might make the list of replacements: incoming solicitor general Elena Kagan, formerly the dean of the Harvard Law School, Cass Sunstein, a brilliant constitutional law prof who now works at Obama's Office of Management and Budget, Secretary of State Hillary Clinton, appellate judge Diane Wood, and Leah Ward Sears, the chief justice of Georgia's Supreme Court," reports Marc Ambinder. "A dark horse might be Judge Nicholas Garaufis of the Eastern District of New York

. Less known but equally potent candidates would be Stanford's Pam Karlan, an intellectually brilliant liberal, and Johnnie Rawlinson, an appeals court judge and the first African American woman appointed to that circuit. Of all these candidates, Wood and Karlan are probably the brightest lights, and Wood would be most palatable to conservatives. Cato's Ilya Shapiro, a former Wood student, said that she'd offer a "seriousness of purpose and no ideological ax to grind, this making her the best nominee for supporters  of constitutionalism."

I don't think it will happen. Barry doesn't want two confirmation hearing (state and SCOTUS), just for one SCOTUS opening. I could be wrong and I'm sure Hildabeast would say yes, but I'm guessing it's the dyke from Stanford Law that gets the nod.

Barry got away with saying that marriage is between a man and a woman and there wasn't a peep from the gaymafia. This would be the payback I'm sure that they were promised.

Are you referring to Kathleen Sullivan? She’s a likeable person and knows some great jokes, but she’s prety much the Left’s version of Scalia. Kagan would be a smarter choice for Obama. She’s a lot like Roberts in the sense that she’s willing to acknowledge the other side for strategic reasons even if she doesn’t ultimately support it. It all comes down to who can woo Justice Kennedy.

Yes, that's her name. I'm by no measure a "court watcher", but didn't Kegan have some confirmation difficulties just a Solicitor General?

During the campaign was stunned that the gay activist gave Obama an absolute pass for having the virtually identical position on gay "marriage" as McCain. It would just make sense that Axelrod promised them something like this to placate the vocal gay left.

It's total speculation on my part, but I think it's logical.

How are we more screwed than last week? Souter is about as leftist as one can get, it will be damn difficult to find anyo ne worse. So for all intents and purposes we are no better off.

On the other hand, if one of our conservative Judges was being replaced by oBOWma, THEN we are so screwed.

I will be very surporised if it is not hitlery, or HOLD YOUR HAT, slick.

I agree that such a person is a smart choice from their perspective, although I am still betting on Sotomayor as a three-for (Hispanic, Female and Leftist).

The reason Clinton picked Breyer is because he could influence O’Connor and Kennedy. He’s a very bright, ostensibly reasonable guy who just happens to make it up as he goes along.

Did anyone consider that whenever the Leftists try to make their wet dreams real, they make utter fools of themselves and actually lose support? Maybe the nomination of Sunstein wouldn’t be so bad - because he is SO extreme, SO off the reservation that he not only might not be confirmed, but might do so in a way that permanently damages the jug-eared one.

One of the reasons we won the US Senate in 2002 was “for the Judges”... if the GOP Senators had the cohones, they would subject the Obama nominee to a tought grilling, and expose who the real extremists are.
