Napolitano: Illegal Immigration NOT a Crime?
Heritage Foundation ^ | April, '09

Posted on 04/28/2009 8:48:40 AM PDT by T.L.Sink

On April 19, Secretary Napolitano went on CNN's "State of the Union" and proclaimed that crossing the border illegally is a not a crime. This statement left a lot of people scratching their heads their heads given that U.S. law - the law that Napolitano is supposed to uphold - says quite the opposite. Section 8, Title 1325 of the U.S. Code clearly states that those who enter the United States illegally are committing a crime. This "interpretation" of the law by Napolitano seems to be the latest effort by the Obama Administration to set back interior immigration enforcement efforts in the United States. As recently as March 28th, Napolitano made the decision to delay a seeries of immigration raids and other workplace actions aimed at finding illegal workers. At the same time, Obama and she have announced new initiatives intending to send the message that that they take the issues at the southern border seriously. But the administration can't fight the drug cartel while IGNORING illegal immigration. People smuggling is part of the problem, not a separate issue. Legalization will only make matters worse. Granting the people who are here illegally asylum will only encourage more illegal border crossings. Likewise, failing to enforce workplace and immigration law will only encourage more to ignore the law.

It's clear why Obama chose Napolitano to head the Dept. of Homeland Insecurity (to borrow a title from Michelle Malkin): She has every intention of advancing the admninistration's amnesty agenda. As governor of Arizona she had a dismal record on the illegal alien issue. BUT, recently she has said and done things that have many calling for her resignation. Among them: She has proved herself not only UNWILLING to uphold our immigration laws but IGNORANT of those very laws she has taken a solemn oath to uphold. Then, too, she issued her bizarre proclamation that returning veterans, those who want immigration laws enforced, or who feel abortion is inconsistent with their religious or ethical values are all potential terrorists and that law enforcement authorities should be alerted to their activities.

I guess she solved the illegal alien problem. There is now no such thing.

Illegal immigration is not a crime? Yikes. That’s like saying 2 plus 2 is not addition.

So far, She is the worst of Obama’s appointees, and that says a lot. She is at least incompetent, but more likely a Marxist dolt, actively attempting to destroy our country.

Drugs being smuggled north over the border.
Guns being smuggled south over the border.
Illegal immigrants smuggling over the border.
Department of Homeland Security is in charge of the border.
Who is to blame for America’s lack of homeland border security?

Is robbery still a crime? How about murder?

Is tresspassing still a crime? Can you define tresspassing? Isn’t that what they are doing?

“Don’t lecture ME on the Law!”

A direct quote by Napolitano to a reporter who took her to task over her flagrant ignoring of the law about renaming landmarks for deceased individuals.

Back in 2003, when Lori Piestewa was killed in Iraq, Napolitano, who was up for re-election rushed to make political capital from her death by renaming Squaw Peak in Phoenix “Piestewa Peak”. Federal law requires that there be a three year delay before honoring the dead by naming landmarks for them, the delay is precisely to stop the grandstanding that Napolitano was attempting.

But no matter, Mapolitano just ignored the law, bullied and threatened opponents, and did what she wanted anyway.

The whole episode showcased Napolitano’s ugly arrogance, thiggish bullying, contempt for the law, and her naked ambition.

Good job, Janet - everyone still calls the mountain “Squaw Peak”.

Those of you residing on our Southern U.S. border are strongly encouraged to look both ways before exiting your homes. Otherwise, you may be trampled in the rush of illegals headed North. Given, that at about this time every year illegal agricultural workers start their march across our border unopposed at a rate of 50,000 per month, this year may be especially hazardous..."Meep-beep!"

“And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because *crossing the border is not a crime per se. It is civil.* But anyway, going after those as well.”
Sayings of Chairman Janet

This gem is from her “extremist organizations will want to corrupt veterans” classic in which she also duck-speaks the usual demo-eugenicist view on infanticide.

Crossing the border illegally is a crime.

Being in the country illegally is not a crime, unless the perpetrator has previously been deported.
Being in the country illegally is a civil offense punishable by deportation.

The voters got the government they deserve.

You’re absolutely right but the illegal invasion is so massive it’s infected nealy all states, not just border states - and even rural areas when once it was confined to urban locales. It’s NATIONAL catastrophe.

Right - and maybe somebody should remind her that Obama isn’t just supporting abortion - but infanticide. This was revealed during the campaign when that nurse told the story of how she tried to protect the infant after delivery from a botched abortion.

Believe it or not, Nappy ain't too far wrong.

Legally speaking, entering the US illegally is NOT a felony. It's a misdemeanor. Like jay-walking, spittin' on the sidewalk, or not picking up after your dog.

That is precisely why the great legal minds who lead us have NEVER taken illegal immigration very seriously. Nor, my friend, are they apt to in the near future. This is what happens when your country is run by lawyers, rather than intelligent humans.

Anybody have a sense what the late night shows are doing with all the clown material coming from The Marxist Onada’s usurped administration? I don’t watch those shows.
