She first made national headlines when a hangman's noose was found dangling from her Columbia University office door.

Now, Madonna Constantine, the controversial former Teachers College professor fired last year for plagiarism, is resurrecting the image with a $200 million lawsuit that charges her former employer with an "academic lynching."

The strongly worded, 92-page claim -- which veers into spy-time territory with its allegations of coverups, evidence destruction and conspiratorial "schemes" -- was filed in Manhattan Supreme Court yesterday.

A spokesman for Teachers College said the case was "totally without merit, and we intend to defend against it vigorously."

Constantine's firing is set for review by a Teachers College faculty committee starting tomorrow.

Unless the Trustees stand up to the leftist administration, Professor Massad will now be granted tenure.

With all the allegations, one key point remains, Bollinger gate Massad 3 chances for getting tenure after he had been reprimanded for abusing his power as a professor. Despite the tenure committee twice failing to give him the standard approval, President Bollinger stepped in to help the radical professor. This should come as no surprise, given Bollinger's choice of Michelle Moody-Adams to be provost of Columbia College. As we have warned before, the issue is not one of Bollinger crumbling to the left. He is a leftist, who uses his authority to turn Columbia into a institution of indoctrination.

The New York Post features an article by Jacob Gershman on the Joseph Massad tenure case at Columbia. I highly recommend it. Gershman covered this story for the now-defunct New York Sun, and he knows all the ins and outs.

Gershman reports that Massad's file has already passed muster with President Lee Bollinger, and will be presented to Columbia's Board of Trustees for a final decision in about a week. Bollinger "buckled," Gershman writes, rather than face down a determined faculty clique. "The Massad tenure battle," he adds, "is about the failure of leadership of Bollinger—whose job it is to safeguard Columbia's academic integrity." Bottom line:

Columbia's trustees must decide: Do they attempt to clean up after Bollinger and stop this absurdity—or do they confer academic legitimacy on Massad's ideas and agenda? Hesitant to insert themselves in an academic matter, the trustees would be wise to consider the consequences of silence.

For Massad, of course, Columbia's trustees are just a rubber stamp. This is why he's been telling his friends he's been tenured, even though tenure is only conferred by the Board of Trustees. Rubber-stamping may be the usual role of the Columbia's trustees in tenure decisions. But I'm also sure that whoever invented the system also imagined that one day there might arise an exceptional case, compelling the trustees to veto a recommendation. If not, why require their approval at all? If so, Massad is that once-in-a-generation case.

"I know that trusteeship is now contrived as being as passive as possible," adds Marty Peretz on his blog The Spine, but then asks: "Is the professoriat as a whole so wise as never to be questioned at all? I daresay not. And I know something about universities. At Columbia increasingly, departments and schools in the social sciences behave in the process of hiring like gangs admitting new members." Peretz goes on to compare Columbia unfavorably to "any and all of the universities in the State of Israel," not one of which "is so intellectually and politically inbred as is Columbia University."

Joseph Massad is the most deformed offspring of this incestuous inbreeding, the ultimate mutant in the Columbia freak show. Three years ago, when Juan Cole was up for a position at Yale, I wrote that "I would be surprised, and even shocked, if Yale appointed Juan Cole." I never would have said that about Massad at Columbia. Indeed, I once described Massad as "the flower of Columbia University," a thoroughly Columbia creation. Columbia gave him his doctorate, Columbia University Press published it, and Columbia gave him his tenure-track job. Massad himself recognized that Columbia couldn't disown him without somehow disowning itself. As he put it in 2005:

An attack on my scholarship therefore is not only an attack on me and on MEALAC [his department at Columbia] but on Columbia’s political science department [which graduated him], [and] on prestigious academic presses, including Columbia University Press [which published his thesis]... an opinion expressed by Martin Kramer who also condemns Middle East Studies at Columbia.

I wrote in reply: "Massad couldn't be more right. All those who have accredited, acclaimed, and published him have scraped bottom, and that applies especially to Columbia University."

Incredibly, Columbia's faculty came close to denying Massad tenure. He received only a 3-2 vote in his favor from his ad hoc tenure committee. A split vote is not a sufficient recommendation, and Provost Alan Brinkley could have put an end to the farce then. But when Massad's faculty gang brothers threatened to riot, the administration quickly capitulated and authorized an unusual second review. At the time, Marty Peretz wrote: "Even Lee Bollinger won't be dumb enough to reverse." Well, Bollinger has reversed, but it isn't because he lacks intelligence. It is a deficit of courage. Way back in 2005, Dan Miron, the long-suffering Hebrew lit professor in the Middle East department, predicted that Massad would get tenure: "Columbia is not courageous enough to say 'no' to this person and face a whole choir of people who would say, 'Aha, you caved in.'"

So is Miron about to be vindicated? Is "Columbia not courageous enough"? The question now boils down to this: does any courage reside in the Board of Trustees? Or have they been carefully inbred as well, for passivity and acquiescence? We shall see.

On the New Dean of Columbia College [Carol Iannone]

Michelle Moody-Adams, the new dean of Columbia College and vice president for undergraduate education, is the first woman and the first black person to hold the post. In February 2009, Moody-Adams co-sponsored with university funds a controversial student protest on the Cornell campus by the Islamic Alliance for Justice consisting of signs and 1,300 flags representing Palestinians and Israelis who died in the action in Gaza.

The news stories do not make it clear, but the point of the signs accompanying the flags was to show the vastly greater number of Palestinian dead, evidently without pointing out that among them were of course Gaza's leading terrorists and cowards-in-residence who hide among civilians in order to make sure that Israeli retaliation against Palestinian violence creates as many Palestinian dead as possible, the better to condemn Israel.

An administrator declared that they had financed the display in order to promote "debate."But there was no financing for the other side of the story. The signs were torn down on the same day, an action which was rightly condemned by the Cornell Israel Public Affairs Committee as a violation of freedom of expression, but which perhaps in its own way suited the quality of the "debate" initiated by the display.

Moody-Adams's response to 9/11 at a teach-in at Cornell on the "roots of terrorism" was to declare that "vengeance is not the answer here," and that the result of an American military response could be the end of everything worth fighting for, "even the end of the species." Later on in the teach-in, Moody-Adams did concede, in typical liberal doublethink, that "some military response may well be necessary."

In 2002, I warned people about Bollinger. I was told that he would look after the interests of the university and to stop blowing things out of proportion.

On Monday, the presidential search committee cut short their abbreviated search for a successor to President Rupp and selected President Bollinger of the University of Michigan. I humbly suggest that they and the Trustees take a longer look at President Bollinger's record. While he is clearly qualified for the job based on his prior positions, Bollinger's record should disqualify him. Bollinger has used his previous positions to create, implement, and defend unconstitutional codes of conduct and affirmative action policy.

In 1996 and 1997, the University of Michigan implemented a Speech code as part of its code of conduct, which can only be called Orwellian. Certain racial, religious, ethnic, and sexual groups were given protected status. Students could be brought up on charges for comments or actions offensive to members of these groups, or which other believe to be offensive to these groups. Speech codes are an affront to everything a university is supposed to stand for. They punish not actions, but certain unpopular opinions in and out of the classroom. Speech codes are an affront to free inquiry and thought, and ultimately to the First Amendment. Bollinger claims that he opposed the policy, but made no action to do so until the issue came to court. As then Dean of the Law School, Bollinger should have spoken up. Instead, this man who is considered an expert on the First Amendment helped implement the policy. Fortunately, the policy only existed for 15 months before it was struck down in District Court.

However, the University of Michigan's current Code of Conduct retains many of the features of the old code. Students are not guaranteed council during proceeding and the Administration act as both prosecutor and judge. It is an affront to the civil rights and liberties of students. Unfortunately, this was not the first time that President Bollinger tried to use his position to stifle free speech. While Provost at Dartmouth, Bollinger tried to use vandalism against the Dartmouth Review as a reason to close it.

President Bollinger's history with Affirmative Action is equally atrocious. Bollinger helped implement an affirmative action program, whereby students of certain races get additional points by admissions office. This policy was ruled unconstitutional in March, but the University is still applying it. Whether or not you agree with racial preferences, we should not install a president who has shown contempt for the law and constitution in order to pursue his ideals.

This is not an issue of conservative or liberal, black or white. It is an issue of justice and fairness. It is simply not in the interest of the students, faculty, or the University to have a president who has implemented and defended unConstitional assaults on civil liberties and the principle of freedom of thought, upon which the university stands. We do not need Politically Correct McCarthyite who uses his position to silence opposition. Please join me in urging the University Trustees to vote against President Bollinger.
