Christian law group loses fight with Hastings

(03-17) 16:51 PDT SAN FRANCISCO -- UC Hastings College of the Law can deny recognition and funding to a Christian student group because it excludes gays, lesbians and non-Christians, a federal appeals court ruled Tuesday.

The San Francisco law school is entitled to require official student organizations to "accept all comers as members, even if those individuals disagree with the mission of the group," the Ninth U.S. Circuit Court of Appeals ruled. It said the school's policy is "viewpoint-neutral" and does not violate the rights of theChristian Legal Society.

The brief ruling cited the court's decision last year allowing a Washington state high school to deny recognition to a student Bible club that required members to endorse its religious creed. Last week, the club asked the U.S. Supreme Court to review that case.

Both rulings allow public schools to "require religious organizations to include people in their groups who disagree with what the religious groups believe," said attorney Jeremy Tedesco of the Alliance Defense Fund, a Christian legal organization that is involved in both cases on behalf of the student groups. "That's a violation of the First Amendment, free speech and freedom of religion."

Ethan Schulman, a lawyer for UC Hastings, said Tuesday's ruling allows the school to apply its nondiscrimination policy to any group seeking recognition and a share of the funding that goes to organizations from mandatory student fees.

I’ve been reading Catalyst, from the Catholic League, and Donohue says that Obama’s new “Faith Based Program” proposes to do something similar. He didn’t want to say that religious organizations have to take anyone who wants to join, but evidently he says that each instance will be decided on a case-by-case basis by lawyers. Donohue thinks it will be necessary to bring a test case in order to force the issue.

Yes, of course this violates the Civil Rights Act, Section 702a, which exempts religious organizations from the rules.

in the meantime, the Christians should join the Gay and Les student union and discuss homosexuality from a biblical viewpoint at the meetings. Loudly.

That's my initial thought as well. But man do we ever have to pray for the health of the conservative Supreme Court Justices over these next four years. It wouldn't take much for the balance on the Supremes to tip and decisions like this to be upheld. With Obama in the White House, we're on the brink.

No, they can’t do that, because if they try, the tolerant gays scream in their face, throw things at them, call them vile names, engage in insinuated sexual acts in front of them and with them, and run them off, like they did in the Castro district for just trying to pray.

They would not rule this way if a liberal group excluded conservatives who disagreed with the mission of the liberal group.

Try getting the same ruling for a conservative who opposes abortion or homosexuality trying to get into a group promoting abortion or homosexuality. Would never happen.

Stand the ruling on its head: have masses of conservative Chrisitan students (and they better go in groups) join the gay, non-Christian, and other groups and openly and loudly challenge the group’s ideologies and practices. When the school acts to remove them, sue them for discrimination and cite this ruling.
