Sources: Feds moving enemy combatant to Ill. court

WASHINGTON – Federal prosecutors plan to move an alleged al-Qaida sleeper agent out of a Navy brig in South Carolina and send him to federal court in Illinois to face trial.

Two people familiar with the case of Qatar native Ali al-Marri said Thursday the government plans to transfer him to the civilian court system. The two people spoke on condition of anonymity because it's a pending criminal case.

The transfer could avert a Supreme Court hearing in April and a subsequent ruling that would govern other cases against accused terrorists. To justify holding al-Marri, the Bush administration claimed the president has the wartime authority to send the military into any U.S. neighborhood, capture a citizen and hold him in prison without charge, indefinitely.

One of the people familiar with the al-Marri case said prosecutors plan to charge al-Marri with providing material support to terrorists, a charge similar to what he would have faced if tried by a military tribunal.

Putting al-Marri into the federal court system follows a similar move made by the Bush administration with another enemy combatant, Jose Padilla. Padilla, once held at the same brig as al-Marri, was eventually convicted of terror-related charges in federal court in Florida.

The decision on al-Marri was reported separately Thursday by the Web sites of The Washington Post and The New Yorker magazine.

Al-Marri was the subject of one of President Barack Obama's first official acts, signing an executive order for "a prompt and thorough" review of al-Marri's continued detention.

Now, according to those familiar with the case, that review has resulted in a decision to put him back into the civilian court system.

In 2002, Ali was charged with making false statements to the FBI and to financial institutions, identity fraud, and credit card fraud.[1] Al-Marri was alleged to be in possession of more than 1750 credit card numbers, along with the names of the account holders, none of whom were Al-Marri. He was also alleged to be in possession of falsified identification documents. Additionally, he was alleged to have used a Qwest calling card to call a number in Dubai linked to the reputed al-Qaeda financier Mustafa al-Hawsawi.

After searching al-Marri's computer, folders were found labeled "jihad arena" and "chem," which (according to the government) contained information on hydrogen cyanide, a poisonous gas produced in large quantities by several industrial processes in the U.S. and listed amongst chemical warfare agents that cause general poisoning,[2] along with lectures by Osama bin Laden and links to Web sites related to weaponry and satellite equipment.[3] Al-Marri's initial charges were dropped when President Bush classified him as an unlawful combatant in 2003. Unlike other foreigners, al-Marri was not transported to the Guantanamo Bay detainment camp but was instead transferred to Naval Consolidated Brig, Charleston in South Carolina. What's everybody worrying about? In Lodi, Ca, we have a convicted terrorist driving the ice cream truck all over town selling to our children.

His son is still in prison, but I am sure one day he will be here again also.

But Taj Khan, who was just appointed to the Delta College Board in Stockton, was quoted in the Lodi News Sentinel after 911 "We just have to understand what motivated them to do it."

To me there is no excuse they can give me that will make me understand their perverted thinking. But Taj got the coveted college board spot over many more qualified applicants. He is always running for city office, but we have not yet elected him, so he just finds a bunch of bleeding heart liberals to appoint him.

According to CBS, June 23, 2003, al-Marri is a citizen of Qatar, not the US.

So AP, as is their frequent practice, probably got their Bush-hating America-despising prejudices in the way of doing their job.

Ali Saleh Kahlah al-Marri (b. 1966/1967?) is a citizen of Qatar who was arrested while studying at Bradley University in the United States.[1]

I hope they had more than that.

That could be a criminal who was fascinated with or fantasized about Jihad and made one call trying to join Al Quaida.

Now, probably he is either a terrorist or a wannabe terrorist but I don’t any reason to strip him of his right to a trial with the right to put on a defense.

He trained for two years under the Islamic Jihad's Egyptian chemical engineer Midhat Mursi al-Sayid 'Umar [aka Abu Khabab al-Masri aka Abu Khabab]... the guy who was featured in an al Qaeda video gassing dogs.

Al-Marri shares the same list of contacts as Mohammed Atef, a US citizen who worked out of Barack Obama's family's country of Kenya, and who was involved in the 1998 US embassy bombings that occured there and in Tanzania. Some of the perps in that bombing plot, such as Wadih el Hage, were involved with IARA [another agency with offices in Chicago] and also ran and worked for a Kenyan terror charity called "Help Africa People." El Hage [and another individual, the woman Siddiqui, that was part of al Qaeda's post 911 follow-on ops as was al Marri] was also involved in the gem trade. That leads to Liberia and Sierra Leone, and the battles over the gemstone mines there, which brings to mind all the liberal hysterics about Bush taking down Charles Taylor, the best buddy of Illinois' favorite loudmouth Jessie Jackson.

There are a lot of politicians who received goodies from these terror charities so there is probably a strong desire in Washington and particularly in "Crook county" Illiois to handle the al Marri matter creatively...in such a way that not too much of what and who he was actually involved with gets exposed.

al Marri wasn’t in the credit card theft business for personal gain like some sort of common criminal. He was in it on the instructions of his commanders, at the request of a declared foreign enemy of the US, and his activities benefitted them. [al Qaeda declared war on the US before the 1998 US embassy bombings,and al Marri trained in their camps and indeed, was sworn to them, even went so far as to request to become a martyr for them against US targets, though his bosses had other things in mind for him.]

In other words, al Marri is not a criminal, he’s part of an invasion force of enemy combatants.

That’s enough to convince me that he is almost certainly a terrorist sympathizer and probably a terrorist.

But I don’t see anything that should would justify taking his right to a fair trial away.
