A man was shot and killed by a California Highway Patrol officer following a car chase that ended early this morning next to an elementary school in east Fresno.

The car was pulled over on Chestnut. As the CHP officer approached the car on foot, the driver got out of the car, Solorzano said, and the officer fired. Solorzano did not know whether the driver was armed, and gave no other details of the shooting."

Officers Poncherello and Baker were not available for comment.
I suppose someone will try to sue. The initial report came in at 0144 hours so I think the incident happened long before school started.

He couldn't have possibly been armed....he was in a gun free zone!
Thus says the media. He probably just wouldn't talk to them, so they assumed the former because of his lack of statement. Police consider a car a deadly weapon if used in such a manner as to do others harm, thus, the statement 'not knowing he was armed' I would bet would be an editorial comment, not a parenthetical statement.
I will try to keep up with this story. In this instance, the driver stepped out of the car, thus giving the image that he was not using it as a weapon at the time he was shot.

Also- the officers didn’t have a choice as to where the perp drove and where the perp stopped.
You think that will stop the suits... the kids “heard about it being nearby” - that is enough.
"The suspect in the vehicle exited, charged toward the two CHP officers, yelling and refusing to obey commands the officers had given the suspect," Cardinale said.
Movements made by the suspect led officers to believe he was armed and getting ready to attack.
Both CHP officers fired their handguns, (at the suspect) who was struck in the upper body.
He died a short time later."
