WAITER DISRUPTS JEWISH WEDDING WITH ARABIC CHANT

By LORENA MONGELLI and ERIN CALABRESE

January 10, 2009 --

Long Island waiter rebelling against his pastor father terrorized guests at a Jewish wedding reception, blasting a recording of a pro-Palestinian rally that included Arabic chants through the DJ's microphone, authorities said today.

Stephen Buttafuoco, 23, was charged with a aggravated harassment as a hate crime for allegedly blaring "Allahu akbar," Arabic for "God is great" - scaring the over 700 wedding guests who were wrapping up the party at the Woodbury Jewish Center around 1 a.m. Jan. 4., Nassau cops said.

Buttafuoco, who was arrested Friday and is not related to the infamous Long Island lothario Joey Buttafuoco, allegedly "admitted he did this with the intent of disrespecting the [Jewish] religion," according to court papers.

He was arraigned today in Nassau County District Court and released on $1,500 bail.

He's no terrorist, lawyer Thomas Spreer insisted - just a confused kid trying to rebel against his minister father.

You escort this Einstein out of the building and tell him never to return. A hate crime? You either commit a crime or you don’t. Hate is not a crime, regardless of the race involved. The kid is stupid but he didn’t threaten anyone let alone Jews in particular. Punish criminals for the crimes they commit. Tacking hate crime onto it certainly does nothing to deter the crime, and probably, in the final analysis is counterproductive, as our most brilliant Liberal ideas.

This guy might need some punishment, but a hate crime? What this person did is the equivalent of someone piping “The Beast Rules” or something equally as bad during a Christian event as a prank. Not that that’s at all OK, but if you’re going to have hate crimes, leave it for the people who kill others because of their religion or spray swastikas and threats on a jewish person’s home or something along those extreme lines. Admitting that you’re pulling a dumb prank with the intent of disrespecting your father and his religion isn’t enough, IMO. I’m sure there are plenty of other things this creep could be charged with other than a hate crime.

Oh, you mean their endurance of the hatred is proof of the existence of God.

Makes sense.

I couldn't see where you were going with it.

Not that I was sold on it, but in the book “Black Rednecks and White Liberals” Thomas Sowell attempts to show that other groups have endured what the Jews did (I recall Lebanese and Chinese), [this was in the chapter “Are Jews Generic?].

Sowell, as always, makes an interesting argument, but I think I have to concur with your assessment, that over the long road of history, the Jews have endured the most hatred and suffering.

Uh, actually, that's not the case. It's worse.

"Allahu akhbar!" is often the very last thing Israelis hear before the truck-bomb or bomb belt goes off.

This is at least on the order of yelling "Fire!" in a crowded theater.

allegedly "admitted he did this with the intent of disrespecting the [Jewish] religion," according to court papers.

NY Post ethics: Whenever it is a crime against the Jewish, Israel, or a conservative, it is an "alleged" crime, even if the perpetrator admits his actions and even if he states his motive.

The burden of proof always is on the victim in when these peoples are attacked, but it's never acceptable to actually state those who are guilty of the acts are to be held accountable for such acts, only that the charges are for "alleged" acts.

When Jews fight, hate and kill each other, which they have done, who gets to file what against the other?

I’m surprised yours is about the only post here with an element of sanity. Agreed.

Civil charges should also be filed for ruining a marriage feast which the caterer was hired to support.

Criminal charges for intent to foment a riot would also be in order, as well as intent for “hate crime”.

While a "hate crime" designation is silly, lentulusgracchus is correct in post 19 where he characterizes the "prank" war chant as tantamont to screaming fire in a theatre. At a time when terror groups have ordered their followers to murder Jews wherever they're to be found, that's an understatement.

Like a lot of other FReepers, I think, I'm not on board with the concept of "hate crime" -- it's too close to the Orwellian idea of "thought crime" for me.

And thinking back to the genesis of the idea, it was always an added punishment for offending against politically-connected, politically privileged "groups", more of that identity-political garbage Hillary is justly infamous for pushing.

The “hate crime” issue strikes me as silly, but he clearly has some criminal liability here, as well as civil. This act, which could reasonably be interprited as the beginning of an attack, could easily have caused physical injury or loss of life. As I’ve noted on threads about Synagogues, Catholic and Mormon Churches the last month or so, most states have laws against the disruption of religious services or assembies. They need to be dusted off and applied aggressively.

I'm of the opinion that "hate crimes" shouldn't be legislated against - there are already laws that take into consideration "aggravating circumstances" in "real" crimes.

On the other hand, I also believe that for those who are the victims of these "hate crimes," there should be a "free one" where you get to beat the crap (or pay someone to do so) out of the perpetrator, and he can't do anything to you, legally or civilly. This would certainly cut back on these "hate crimes."

Plus this guy couldn't object - my solution is too much like sharia law, which is something that he apparently wants.

However, there is one more thing...The kid is stupid but he didn’t threaten anyone let alone Jews in particular

This really isn't the case... The words his is accused of shouting are usually accompanied by either an explosion or gun-fire. He SHOULD at the very least be charged criminally with making a terrorist threat, and civilly with intentional infliction of emotional damages.

Mark

New York law that might be applicable:

PEN-120.14: Second degree menacing

120.20: Second degree reckless endangerment (considering 700 people and the risk of panic & stampede)

240.20: Disorderly conduct

240.21: Disruption or disturbance of a religious service, funeral, burial or memorial service.

240.26: Second degree harassment

If this were Westboro Baptist Church disrupting the funeral service of a fallen soldier at Arlington, would there be this level of quibbling over the specifics of the prosecution?
