Judge denies Polanski rape case defense bid (Dir. of "The Pianist" accused of raping 13-year-old)

LOS ANGELES (AFP) — Lawyers for fugitive director Roman Polanski lost a bid to have the Los Angeles Superior Court disqualified from hearings stemming his decades old rape case.

Polanski's defense team had filed a motion on Monda seeking the removal of Los Angeles Superior Court judges from hearings involving the Oscar-winning film-maker, who fled to France in 1978 before his case was concluded.

However judge Peter Espinoza said in a written decision lawyers had given "no legal grounds for disqualification" and was therefore "ordered stricken."

Polanski's lawyers said last month they had new evidence that the film-maker, 75, was a victim of prosecutorial misconduct in the case, in which he admitted at the time to "unlawful sexual intercourse with a minor."

Born in France of Polish parents and raised in Poland, Polanski was arrested after the parents of a 13-year-old girl complained to police. He fled the United States after a plea agreement.

The charges against him were not dropped and Polanski never again set foot in the United States, not even to receive the 2003 Oscar awarded him for best director in "The Pianist."

And he made better films for not being in Hollyweird! Had he stayed they would have had him directing Elvis Presley movies!

I guess that would be my job.

Polanski, 44, drugged a 13-year-old girl with champagne and quaaludes and then raped her. Then he ran for the border to avoid prison.

Polanski, acclaimed for "Chinatown" (1974) and "Rosemary's Baby" (1968), is still a US fugitive.

As he should be. If he steps foot in the US, he should go directly to jail to await trial.

Trial? Don't need no steenkin trials.

He already had made a plea bargain; and he openly admitted to it after the fact of fleeing; and fled to France, because they would no extradite for 'a crime of passion'..."it's just sex": something I believe we have heard elsewhere, at a later date.
