Mohamed gets 15 years in terrorism case

TAMPA -- Former University of South Florida student Ahmed Mohamed got a 15-year sentence today for providing material support to terrorism.
"I still wonder why this young man in front of me at his age, at his intelligence, how he has become committed to this path," said U.S. District Judge Steven D. Merryday, who gave Mohamed, 27, the harshest penalty allowed by law

Many terrorists have been young and well educated. This kind of statement from the judge just shows how accepted the "poverty causes terrorism" lie has become.

So he was sentenced for the technical video on YouTube? Sounds a little questionable. Do any instructional videos on firearms now fall into this catagory? Or the people at gun shows who sell copies of the
Anarchist's Cookbook?I think being found with explosives in SC are going to be the real deal. Of course, this didn't help:
Prosecutors also gave more details about letters Mohamed had written while being housed at the Hillsborough County jail.
In a letter to a guard, Mohamed wrote, "You guys are seriously pathetic." He taunted them by calling them desperate housewives and housekeepers.

The video explained how to remotely detonate an IED. That's hardly in the same class as any video I can imagine one would make about guns. He admitted the video was intended as instruction for jihadis fighting American military (and other "invaders"). I find this disappointing:
Mohamed's guilty plea to the one count of providing material support to terrorists spared him from facing a life sentence in the prison on other charges.

It was a plea deal. You don’t pick what you plead to like a buffet dish. That’s my point. It means plenty because he’ll do short time and still be a young jihadi when he’s released as opposed to rotting in prison for the rest of his natural life.

What's your point?
I stand by the statement that what he did that got charges brough - making a 'how to blow stuff up video' - is somewhat suspect to me given I want to know how to blow stuff, use a sniper rifle, etc. I'm not for or against the conviction, I'd just like to hear more opinions on it.

My point is that he was allowed to plead guilty to what is apparently a lesser charge since they compare it to life in prison for (some of?) the other charges against him. We are talking apples and oranges since your issue seems to be about how the law applied to what he did, whereas my complaint is he could have been locked up for a lot longer. Understand his plea included not just that he made the video, he plead to intent. Without reading the text of the law, proving intent would logically be part of it. I don’t see it as being too different from a conspiracy to murder charge.

I had to go back and read up on the case. Initially the two were charged together but later the judge (after first denying) separated the (Count I?) of the indictment for the terrorism charges from the Count II which was the explosives charge.
I think I have it right in that the plea deal just reached and sentenced for Mohamed was for (charges including) “providing material support to terrorism, carrying a destructive device relating to that support of terrorism, and two counts of possessing a firearm in violation of his visa rules.” So he pleaded to the material support portion, which basically he admitted what you said, he provided al-quaida type training. I have to think the weapons charge (easily provable) and then tying the explosives they had to terrorism (more difficult to prove) were something Mohamed did not want to go to trial for. Or perhaps with the second (easier proved?) trial the prosecutors felt it would be better to offer a deal.
So there is going to be a second trial which will be for “illegally transporting explosives and illegally possessing destructive devices”, and they are joined for that case. I would think that is a slam dunk but I do not know what the possible sentence is.
I understand what you are saying about the video but I do think it relates to intent. When you add the video with the other issues- where they were caught, the stuff in the trunk etc etc, the anti-American poem the guy wrote, the stuff he said to the guards, then you start to get a clearer picture.

Meh. Yeah, the explosives charges are *kind* of a slam dunk, but only in the same way speeding is - so many people do it. Correct me if I'm wrong, but these were fireworks, right?
re: the youtube video, hell, I don't know why he plead guilty. Needed a better lawyer, I think.
What this calls for is an extrajudicial solution, like this non-citizen disappearing in the middle of the night, rather than trying a case in a way that arguably subverts the 1st amendment.

I have to wonder what the deal really was with the “fireworks”. Dynamite it wasn’t. Maybe these guys are just jihadi wannabes. They were up to something though. Fireworks are easy to come by in SC. No need to go to a lot of trouble to make the pseudo pipe bombs.
I think he plead guilty because perhaps the weapons charge had a longer sentencing guideline. Who knows.
I’m not sure that an extrajudicial solution is better than a case that steps a fine line regards the 1st amendment. Is denying somebody due process better than making a prosecutor prove his video was not protected speech?
That said, if we were more “judicious” in who we allow into the country then maybe we wouldn’t have to step on the edges of the first amendment.
However we are fighting a war with people who have no rules regards warfare so we are in a bit of a damned if we do, damned if we don’t position.
