Rahm Emanuel talked with governor's office about who should fill Obama's Senate seat.
Chicago Tribune ^ | December 13, 2008 | Bob Secter

Posted on 12/12/2008 9:31:32 PM PST by BAW

The revelation does not suggest Obama's new gatekeeper was involved in any talk of dealmaking involving the seat. But it does help fill in the gaps surrounding a question that Obama was unable or unwilling to answer this week: Did anyone on his staff have contact with Blagojevich about his choice for the Senate seat?

Blagojevich and John Harris, his former chief of staff, face federal charges in an alleged shakedown involving the vacant Senate seat, which Illinois law grants the governor sole authority to fill.

Obama said Thursday he had never spoken to Blagojevich about the Senate vacancy and was "confident that no representatives" of his had engaged in any dealmaking over the seat with the governor or his team. He also pledged Thursday that in the "next few days" he would explain what contacts his staff may have had with the governor's office about the Senate vacancy.

One source confirmed that communications between Emanuel and the Blagojevich administration were captured on court-approved wiretaps.

Another source said that contact between the Obama camp and the governor's administration regarding the Senate seat began the Saturday before the Nov. 4 election, when Emanuel made a call to the cell phone of Harris. The conversation took place around the same time press reports surfaced about Emanuel being approached about taking the high-level White House post should Obama win.

Emanuel delivered a list of candidates who would be "acceptable" to Obama, the source said. On the list were Obama adviser Valerie Jarrett, Illinois Veterans Affairs director Tammy Duckworth, state Comptroller Dan Hynes and U.S. Rep. Jan Schakowsky of Chicago, the source said. All are Democrats.

Sometime after the election, Emanuel called Harris back to add the name of Democratic Atty. Gen. Lisa Madigan to the approved list, the source said.

Though now working full-time on Obama's transition, Emanuel has yet to resign his congressional seat. Illinois law has a different process for filling vacant House seats than Senate seats. When Emanuel resigns, a special election will be held for his replacement.

If true this means that Obama did indeed lie. Is Obama really going to push the line that he did not know anything about this and that Emanuel was acting as a lone cowboy, unauthorized to make such a declaration?

If Emanuel is caught on tape stating a list of candidates that Obama directly approved of then Obama is in big do-do. Not to mention the fact that Obama and Emanuel knew there was pay-to-play scheme put forth by Blago and they did nothing about it.

If Obama and his team knew of the senate seat sale through discussions with Blago and did not blow the whistle on it, what is the crime and penalty?

I am ignorant of the law in these cases, so help me out a bit -

Is it illegal for Obama to suggest appointees to the Governor of Illinois, if there is no hint of payment or other personal compensation in the communication ? It seems to me that on the face of it that is innocuous.

The fact that Emanuel and others have spent the last few days denying that the communicated with the Governor is of course grounds for believing that even they believed that this was inappropriate, but I can’t figure out why. That, or some illegal deal was offered.

I don’t think Blago was given a single penny or guaranteed a single DC job out of this discussion. This is what I find unusual about this entire deal. He kept telling them what he wanted and they just kept talking. Blago appears to have gotten very testy and upset over the “talks”. But so far, I haven’t seen anything that would get you serious jailtime. You have to accept something of value....to make this illegal act work.

Originally Senators were supposed to be representatives of state governments to the federal government chosen by the legislatures. It wasn't until 1913 that the 17th ammendment provided for direct election of senators, with the exception,

"When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct."

My guess is a few vacancies were probably sold to the highest bidder back in 1913 too.

I think Presidential Advisor A (Rahim) and Advisor B offered Blago a package deal that didn’t have any upfront money like JJJ was promising.

It’s not that Obama’s people walked away from Blago, it’s that they were outbid by JJJ and his minions.

Blago was committing a crime - he was soliciting payoffs, and he can be convicted of that without actually having received anything. That could certainly get someone jailtime. Thats not odd.

What is odd is the other side of this.

the crime is accessory before the fact and would be fedeeral crime. The criminal code specifies that any one in government who is aware of a crime and does not report it immediately to a judge or other such authority(something close to that, not an exact quote)is subject to fines and 3 years in the slammer!

I have to disagree with you here. The crime was soliciting a bribe and. in the case of JJjr, attempted bribery. No money or goods or services need to change hands. Blago is guilty of a crime, so is JJjr. If Bozo, through his Rahm proxy, knew of his pay for play scheme then both Bozo and Rahm, and any others with knowledge for the attempts, are guilty of being accessories after the fact, a crime that carries a 3 year penalty if the person with knowledge doesn't immediately tell a judge or other legal authority about said crime. It is spelled out in the Criminal code but I forget what article and section right off hand.

Actually I don’t think the Constitution set up the Senate that way. They previously were selected by state legislatures without the direct vote of the people. And maybe they were simply appointed by the governors in some states, I’m not sure.

Emmanuel is a big baby. He stabs tables with a knife, and yells out that he’s killing nasty Republicans. That’s something a 3 year old does. He sends dead fish to people he doesn’t like. How childish is that? Why the hell do we have people like him in our gov’t in the first place? If he is forced out of Obama’s administration, good riddance. We don’t need babies throwing temper tantrums in the White House. The republic will survive if Emmanuel doesn’t get to throw his temper tantrums in the West Wing.

When Emanuel resigns, a special election will be held for his replacement.

That must be the 5th CD thingy that Blago was talking about:

-- Blagojevch was caught on tape saying that he wanted the Obama advisor in question to know what Blagojevich wanted in exchange for the Jarrett appointment.

Blagojevich said, “He asks me for the fifth CD thing, I want it to be in his head.” Emanuel represents the 5th Congressional District in Illinois. --

You stated that if “The One” didn't respond to the overtures for bribery the is innocent. Wrong. He knew of a crime and did nothing. Accessory is the crime he has committed and he knows it, hence the Clinton tactic of deny, delay, destroy. Blago and wife are getting the “nuts and sluts” treatment as we speak. Change we can believe in.

Obama hasn’t lied so far. He did slip up and say “we” have not been in contact with Blago, then corrected himself and said “I”. He’s been less than forthcoming and has chosen his words very carefully, but he hasn’t lied.

At his presser he said that no one on his staff had agreed to a pay to play scheme for the Senate seat. In Fitz’s complaint, there is nothing to indicate they did.

There is nothing illegal about Emmanuel submitting a list of candidates who might be acceptable to Obama for the Senate seat as long as they were not part of any deal.

The only one so far you might pin lying on is Axelrod who said Obama had discussed his successor with Blago, but then backtracked and said he misspoke.

There was a D.C. Adviser (we don’t know who it was) in on taped conversations while deals were being discussed. The complaint does not say if this adviser blew the whistle on the deal making. None of RE’s conversations with Blago or Harris are referenced in the Fitzgerald complaint.

See for yourself:

http://www.floppingaces.net/2008/12/11/more-questions-about-obama-and-blagojevich/

There are more wiretapped conversations in the 3 weeks following Nov. 13, but none of them are referenced in the complaint.

I’m not apologizing for Obama or his staff, just pointing out that so far, the only indication they might have been aware about pay to play is through the D.C. adviser reference in the complaint and it’s not known to what extent this D.C. Adviser was being directed by BO or someone on his staff. All you can do is read between the lines and make assumptions.

* Harris mentions how such a deal would conceal a quid pro quo
* Advisor B, who is in DC, is pleased with the notion of a three way deal, and he states that Obama should be leveraged with this deal, as it is better than Madigan as Senator and Blagojevich continuing as Governor

* Blagojevich mentions that he does not want to be Governor anymore
* Blagojevich complains that the advisors on the phone are telling him that he must “suck it up” for another two years

* Blagojevich mentions how his wife is more qualified to sit on corporate boards than a “specifically named individual,” who is most probably Michelle Obama
* Harris and Blagojevich remind advisors of the problem of Blagojevich’s financial security, and Blagojevich indicates that without something in return he will not appoint Jarrett

* They agree this is easier for Obama than for Obama to appoint Blagojevich to a position
Conversation 19:
* Blagojevich discusses the open Senate seat with Advisor B
* Blagojevich discusses the option of a 501(c)(4) with Advisor B, who says the “Change for Win” option is better, for from Obama’s perspective, there would be fewer “fingerprints” of Obama’s involvement
* Advisor B mentions that “Change for Win” is a better option, as there will not be stories in four years of how Obama bought Blagojevich off
* Blagojevich mentions how a 501(c)(4) will exist in two years, while “Change to Win” may not
Conversation 20:

Conversation 24:
* Blagojevich and Harris discuss the open Senate seat
* Blagojevich tells Harris he wants to speak directly to “President-elect Advisor” about the 501(c)(4) option and how it could be bankrolled
* Blagojevich says he wants “President-elect Advisor” to receive word of the 501(c)(4) option on that day, for when “President-elect Advisor” asks about the open fifth Congressional district Seat, it will be in the advisor’s mind

* Blagojevich thinks there is still life in Jarrett, but he also thinks there are other options

December 9, 2008 Obama Shifts Schedule Following Gov's Arrest @ 10:54 am by Michael O'Brien

President-elect Barack Obama has shifted his morning schedule amid the arrest of his home state governor Tuesday, pool reports said.

Federal authorities alleged in a complaint against Illinois Gov. Rod Blagojevich (D) that, among other things, he sought to glean political or financial benefits in exchange for his appointment of a successor to replace Obama in the Senate.

"President-elect Obama was scheduled to travel this morning to the Chicago FBI briefing before his mid-day meeting with former Vice President Al Gore," wrote the Wall Street Journal's Jonathan Weisman in the morning's first pool report. "But it has been announced that he will instead be going straight to his transition office."

It was not clear whether the change in plans was caused by the arrest of Blagojevich, but a pool spray of the president-elect will take place after Obama's meeting with Gore this morning, instead of before, as planned.

Thanks Maggie...not sure if you need to add it though...I am really just wondering why he was meeting with the FBI in Chicago the morning of the arrest?

Was this a standard thing for Zer0 to get some weekly briefing from the Chicago Field Office of the FBI? Was he called there to answer questions? Was he in on this? (Highly doubtful).
