Attached is Philip J. Berg's Opposition to Defendants, the DNC and Obama's Motion for Protective Order Staying Discovery pending Decision on their Motion to Dismiss. If the Protective Order were granted, discovery could not occur until the standing issue has been resolved and only if it is in favor of the plaintiff.

Following is an excerpt from the response:

The more Obama and the DNC fights this the worse it looks for him. I began just thinking that he didn’t want a copy of his vault long-form birth certificate released because it contains a notation regarding his religion being “Muslim,” but given how much cover the Media has given him thus far I cannot imagine that he’s really afraid of that coming out. After all, all he has to do is get his willing accomplices in the press to say: “That’s what they did in 1961 ... put down the religion of the father. It doesn’t mean anything.” and 50% of the public will accept that without question.

These legal maneuvers to keep from producing 3 very EASY to find and publish documents is RIDICULOUS .... unless ... unless there are no such documents in existence. I used to not think this ... but I’m beginning to suspect that such is the case.

If the judge rules against Obama/DNC, and they refuse or appeal to stall for time, it will be bad. The media will pick up the story then. I can't see them admitting, at that point, that they don't have the documentation because such documentation doesn't exist. They're not going to admit to the facts that meekly. They'll appeal. but that appeal will catch the attention of the media.

I heard Berg on an interview today. Toledo OH radio station. There is a point where the Judge can be forced to issue a ruling, by going to the appeals court.

I agree. Obama and the DNC are tying up the court system for nothing if they have the proof. I still think McCain can approach the issue from that angle. McCain should tell Obama to quit screwing around with the courts and give them what they want.

I do not understand how we can have requirements to be President, and there is not some government agency or committee to verify all requirements are met.

Having requirements with no official verification is worthless.

There is the “official” one in Hawaii, if he was really born there, but he has to ask for it from the Honolulu authorities himself, because both his parents are dead, so he is the only living person with “Standing”.

Even if his mother lost her copy of it, the original vault copy should be on file with the government in government records in Hawaii. Eventually all that kind of stuff will be digitized, but as of right now I'd bet you dollars to donuts that they still have the physical copies of all BCs for all living people born in Hawaii. If so, the Hawaii records dept should be able to produce it. If not, then it wasn't "lost" ... it either never was or it was removed from records because its standing was revoked when he and his mother became citizens of Indonesia.

No. According to the stipulations of the original lawsuit all he has to produce is "1) a certified copy of Obama’s “vault” (original long version) Birth Certificate; and (2) a certified copy of Obama’s Certificate of Citizenship; and (3) a certified copy of the Oath of Allegiance taken by Obama taken at the age of majority." 1. Is required to prove he was a natural born US Citizen. (a specific requirement of the US Constitution) 2. Is required to prove that he is still a citizen ... required because he once had dual citizenship (by his OWN admission) with Kenya and, by the records uncovered by others, also in Indonesia ... where it could NOT have been "dual" but had to have been superseding (i.e., Indonesia didn't allow dual citizenship with the USA in the 1960s, and visa versa). 3. Is required to demonstrate how he would have re-instated his citizenship on or after his 18th birthday, revoking his Indonesian Citizenship. This is NECESSARY because if he didn't, then he's still a citizen of Indonesia and NOT of the USA. It's not a problem for him to have done this, however ... since it was his mother who became an Indonesian citizen, and that status was conferred on him, when he reached his 18th birthday the option would remain with him ... he could remain an Indonesian citizen OR he could pick up his US Citizenship through an Oath of Allegiance. Today the laws and policies of the US Government -- and the Government of Indonesia -- have changed and dual citizenship is allowed. That wasn't the case in the 1970s. If he never did sign an Oath of Allegiance he does still have the option of doing this -- thanks to the changes in US law and State Department Policy -- and re-acquiring his US Citizenship. Perhaps he's waiting for the Election to be done and then plans on doing this prior to his inauguration and THAT is why he's fighting this? Who knows?

In the very least it would be politically damaging for him to have to admit that he has (1) dual citizenship (which would call into question for MILLIONS of people the veracity of his undivided loyalty to the US -- FAR WORSE than an unwillingness to salute the flag!), (2) lacked US citizenship for a portion of his adult life due to negligence on his part in not signing an Oath of Allegiance. If there is a cloud on his US citizenship today due to any of the above, it may have more than just political ramification ... it may disqualify him for the office until he can get the cloud removed. And, that would mean that it behooves him to clear the cloud NOW, rather than wait ... but it may be political inexpedient for him to do so (it may result in him losing the election). So, he'd rather wait and run the risk of being declared ineligible AFTER the election (meaning that we would be getting President Biden and a Vice President Clinton (probably) ... which, furthermore, would mean that, after two years and 1 day in office, Biden would have a mysterious "accident" and Hillary would become President ... the delay in this succession being timed so-as to allowe Hillary to run for two of her own terms and not run afoul of the 10-year limit).

they could be produced within a day and that would end this argument and embarass Berg and all making the claim that 0bama is not Constitutionally qualified.

The more we see of 0bama and his plans for the country, the more I would welcome a President Hillary over a President Barry.

And Berg's point is that, since Obama is placing himself forward for an office which has, as one of its Constitutional requirements, Natural-born US Citizenship, the entire American Electorate has "Standing" to see that he meets the qualification. Berg is right, as far as that goes. So long as Obama remained a private individual he could keep those issues to himself, but when he placed himself on the ticket for the Presidency he opens himself to scrutiny on wether he qualifies ... and, to this point, he has not proven his qualifications. The "Certificate of Live Birth" that is posted on the Daily Kos and has been accepted by Factcheck.org is demonstrably a forgery ... and even if it were NOT a forgery, it wouldn't satisfy the question of his current US Citizenship status relative to his history of dual citizenships in two countries during his childhood years.

Agreed ... which is what has caused me to change my mind on this matter. I sued to believe that this was just nonsense ... there was NO WAY that the DNC would allow a non-citizen, or a person who has a shadow on his citzenship, to run for office. Given how the DNC and the Obama Campaign have been fighting this, however, I have come to believe that there MUST be something they're trying to hide ... something they don't want the American people to see. Could it possibly be something as silly and simple as the box for religion on his BC long form containing the word: "Muslim" ??? If so ... while I can understand his desire not to have to address the political damage that would do him in some circles, he response to the revelation would have been easier to stomach 3 months ago. Today it just raises more questions. SO ... I don't think it's JUST that. I think there's something wrong with his citizenship standing due to his having obtained Indonesian citizenship thanks to his mother's naturalization. He either failed to sign the oath of allegiance, failed to sign up or the Draft, or SOMETHING ... something that would come out if his BC, his Certificate of Live Birth, and his Oath of Allegiance were revealed. Something that might not disqualify him from office, but which would so harm him, politically, that enough people wouldn't vote for him to throw the election to McCain.

Why would they clamor over that when they knew this was going on during the primary and ingored it! Just listen to each 3 to 4 minute video! These would make great campaign ads for McCain against “the one”.
