This morning, prominent Philadelphia attorney and former Deputy Attorney General for the Commonwealth of Pennsylvania Philip Berg filed a Motion for Leave to File an Amended Complaint in his ongoing case against Illinois Sen. Barack Obama and others, arguing that Obama is in fact not a natural born United States citizen and, pursuant to Article II, Section 1 of the U.S. Constitution is ineligible to serve as president of the United States of America.
Now, this does not mean that the amended complaint has been filed. Rule 15(a) of the Federal Rules of Civil Procedure permits amendments by leave of court, which means essentially that the judge must sign off on this type of pleading before it is filed.

All the reading I've done shows that the place (and time) to determine eligibility to serve is when the Electoral College acts to not only declare a winner, but to affirm eligibility. This, of course, is a little late in the game and could (heaven help us) lead to a constitutional crisis the like this country has never seen. All because of simple stubbornness or the reality that Barry is ineligible.
If he waits until after the election and ruled inelegible, then there will be racial unrest/rioting all over the country.....maybe that is what obama wants.

Also, he was adopted in Indonesia by his Indonesia stepfather and his school records show his name to be Barry Soetoro, but oddly his name changed back to Barack Obama Jr. when he was registered at a private school in Hawaii. No government public records of Barack or Barry in Hawaii. Except that Birth Certificate he put online.

Obama’s legal team filed a motion to dismiss. One of the Lawyers filing the motion was Joe Sandler (sandler@sandlerreiff.com) of the Washington law firm Sandler, Reiff, and Young (see the document below).

This has been explained at least 20 times over the last 6 months. Someday it may sink in, but I doubt it.
I’m beginning to doubt it because of all the Obama/Citizenship threads there is always one person who says “His mom was a citizen, case closed” or something and has to go back into it. I was just too tired to go into the 10 years/5 years issue.

William Ayres is a child psychiatrist who was arrested last year in California for molesting young boys.

I am NOT being a smartass, I just want to know why does someones mom being 18 have anything to do with being a citizen or natural born? Even Mac was not born in the US, al-be-it both his parents were American. For assumptions here, if an 18 yearold gets pregnant by a Brizilian while on vacation, comes back her and has the baby is that baby not a US citizen? I’m confused or maybe missing something, please help me understand. I say that he is hiding something (in the words of my teenagers “du- uh”)

Natural born is born on US soil. If an American mother has a child on foreign soil for the child to be a citizen the mother must have been a US citizen for 5 years after her 16 or 18 birthday if I understand it correctly. His mother a citizen was only 18.
If Obama is found ineligible before Nov 4th - then Hillary goes on the ticket, right?

Not court records, but there is proof that he went to school as “Barry Soetoro”, Soetoro is his stepfather’s name and also it was/is law that you cannot go to a government/islamic school unless you were a citizen (or adopted by one).

Because, for whatever reason, it is in the constitution that you are not a “natural born citizen” unless you were born here, or were born of two parents who had been living here for 10 years, five of which over the age of 16.
Don’t ask me why they got all specific, but they did.
The judge can if he wants order the defendants to supply the requested information while he decides to dismiss it or not but the legal brief submitted today seeks to stop any consideration of that.
We can only hope at this point for the sake of the truth the judge does not entertain their motion.

How about Obama openly campaigning for his communist cousin Odinga who signed a pact with Muslims to enact Sharia Law if elected and started riots when he lost. Obama campaigned for an openly Anti-American candidate in a foreign country in 2006.
The better question is whether there is proof anywhere that Lolo Soetoro adopted Barry -- or whether Cong. Eni Faleomavaega (D, Amer. Samoa) successfully had all of the records supressed or destroyed last July.

Looks like they knew what they were doing. We haven’t seen this infiltration from within get so close and most still can’t see it. Looks close to 50% of America hates Republicans and/or Bush so much, they’d let this nut in the White House.

Well, it still goes back to the “natural born” and “citizen”. So yes, those anchor babies would probably be eligible to run for POTUS.
The question on Obama is if he really was born in the US. If he was born in Hawaii, case closed, no issue except the Indonesian and Kenyan citizenship. But if he was born elsewhere, his mother’s citizen status is not enough to make him “Natural born”.
Obama is not using Sandler.
The DNC is using Sandler.
Sandler has been the DNC's General Counsel since before Berg filed his suit.
Remember, Berg named both Obama and the DNC as defendants in his suit. The motion to dismiss is a joint filing of Obama and the DNC, which is why Sandler's name appears among the attorneys.
The FEC is already a defendant in Berg's suit and have been served their subpoena.
Except that is a state issue, not a federal issue, and doesn't belong in federal court.
November 4th is not a federal election. It is 50 separate state elections and one election in the District of Columbia (which isn't a state).
When we go to the polls on November 4th, we are not electing a President, we are appointing our state's electors. And according to Article II of the Constitution, the appointment of electors is left entirely up to the states.
So any issues as to who appears on the various state ballots is a state issue and should be taken up in state courts. Not federal court.
So what do you think he’s doing?
Personally I think he's just trying to take advantage of the court to garner publicity. I think he figures that a filing in federal court makes it appear "official" and that the press will take notice of it. I think he never intended for this to be played out in a court of law but rather in the court of public opinion.
I think this may also be a money making scheme.
File this suit, get a bunch of people worked up about it, then on your website, say you're in desperate need of money to continue the case and solicit donations through PayPal.
This may be nothing in itself, but it's worth noting that in 2006, Berg filed for Chapter 13 bankruptcy. Shortly after that he filed to have his Chapter 13 filing changed to a Chapter 11 filing. And shortly after that he filed to have his Chapter 11 filing changed to a Chapter 7 filing.
Berg's suit was little more than a cut-and-paste job of stuff he'd scrounged up on the Internet. He exercised absolutely no due diligence and was so sloppy about it he even included a Canadian birth certificate that was made up as a joke and was signed by cartoon character Dudley Doright.
Much of it came from two anonymous bloggers, "Judah Benjamin" and "Techdude."
Techdude was found to be a fraud who fabricated his evidence regarding Obama's birth certificate being a forgery. Techdude was the one who claimed that Obama's certificate was forged using his sister Maya's certificate and that you could see the remains of his sister's name in the scanned image that the Obama campaign published on the Internet.
This was mentioned on Berg's website and Berg's assistant said publicly that Techdude was not one of their experts.
However previously on his website, Berg wrote an article claiming Techdude was one of his experts and gave a link to Techdude's "Final Report" over on Atlas Shrugs.
They tried to cover up this direct association with Techdude by deleting the article. However it can still be seen in Google's cache.
Yet even though they're trying to claim to not have any direct association with Techdude, in Berg's latest filing, his amended complaint that was filed with the court just yesterday, Berg says:
Obama was well aware the Government issued COLB was altered and forged as the original document was in the name of Maya Kasandra Soetoro born in 1970.
That's straight from Techdude's fabrications.
So in my opinion, Berg is being wholly disingenuous and is trying to take people for fools.
