Remember, the Constitution first setup the VP as the person who came in 2nd in the presidential race. There was no intention for that person to be in the Executive branch.

The 3rd in line, in the Constitution is also in the Legislative branch: the Speaker of the House

Yep - between the two attorneys (Obama and Biden) they have half a legal brain.

I’m no Constitutional genius, but it just seems common sense to me that a member of the executive can in no way no how vote in the legislature. The simple fact that the VP on occasion votes as part of the Senate leaves no doubt in my mind that the VP is technically part of the legislature. It also follows common sense that their can only be one executive and CiC- the President.
