Biden screws up the constitution

Biden just failed the constitutional exam. He said the pwers of the vice president are defined in article 1 when in fact it is article 2. He further misrepresented the constitution because article 2 states the VP shall be president of the senate but will not have a vote unless there is a tie. The powers of the president of the senate are not otherwise limited or defined.

I’d prefer Biden have the less power the better.

I too thought this was weird since the legislaure is in Article 1 and the executive in article 2. But I double checked and article 1 does state the VP’s role as president in the senate so perhaps he was referring to that? Wouldnt surprise me though if he just screwed up ... he has never known or cared what the constitution really says

Biden’s interpretation of the Constitution is pretty weird. It’s not the same Constitution I’m familiar with.

No, it’s in Article I. Article II is about the president, not the VP, though the VP is mentioned WRT impeachment .

Art. 1 Sec. 3
The Vice President of the United States shall be President of the Senate, but shall have no vote, unless they be equally divided.

The Senate shall choose their other officers, and also a President pro tempore, in the absence of the Vice President, or when he shall exercise the office of President of the United States.

He is lucky this time

What? Did Biden study in an Obama Constitution class?

You know the same class where Obama thinks

1) He can alter the Presidential Seal (illegal under Title 18 U.S. Code Section 713 Paragraph (a)).

2) Obama doesn’t put his hand over his heart during the National Anthem as described in Title 36.

The powers of the President of the Senate are defined by Senate rules - I’m guessing the rules of the Senate would allow for the VP to be there as the presiding officer whenever they wanted to, and not just be there to break ties.

You’d think of ALL people, Sen. Biden would realize that the VP presides over the senate, which is more than simply deciding a tie. Granted, president of the senate is nothing compared to Speaker of the House, but it’s still a significant position more than breaking ties.

My husband and I had a similar thought --- he can spout it when he needs to, the rest of the time it just doesn't exist as written.

It sounded to me like Sarah has every intention of exercising all Senate functions she can. They need a watchdog.

My sense is that if you did a fact check on all of his statements (where he was throwing out “facts”) you would find that he was wrong or lying at least 75% of the time.

Constitutionally, the VP has the power to break ties and preside over the Senate. Of course the presiding is incredibly boring and the president of the Senate has no power compared to the Speaker of the House, but it IS a constitutional position the VP holds that is more than ‘ONLY ONLY ONLY breaking ties,’ as the good senator said.

Biden also made reference to it being a constitutional right for people of same sex unions to be able to visit each other in the hospital, share their properties, etc. I was shaking my head......wondering if I heard that right??

yes but I think his role as president of the senate is included along with the senate in article one... as i posted above, it is article 1, section 3... anything else of the position would be in article 2

I was really hoping at first it would be a huge screwup by Biden but once I looked it up, i guess it wasn’t

The office of Vice President was defined back when it was assumed that the VP would be a member of the opposition party of the President. And the powers of the Executive branch rest solely upon the President.

Nor mine. Mine has a 2nd Amendment, but old Hairplugs' copy skips from 1st to 3rd. In all his years in the Senate he has never seen an anti-2nd Amendment bill he didn't vote for.

True that. Two duties: preside over the Senate and break tie votes. I understand that changes to the Senate rules some years ago have made the first duty nearly powerless.

Indeed. And that's the problem with these debates. My wife, who's a political neophyte, watched the debate and her reaction was, "how do I know which one's lying?" Fortunately, she had me there to point out Joe's whoppers. :-)

As much as Obama is an empty suit.....Biden is a "cheap" suit...and it shows. I've watched him over the years during hearings on a variety of issues. He reminds me of a sleazy nightclub act....with his speech, mannerisms and thought processes. He is a serious fake and liar.

I thought this was really his biggest screwup, not the bit about the duties of the president of the senate. When he said what you refer to I immediately looked at my wife in stunned amazement to see if she caught it. He was making up constitutional references that don’t exist.

The VP is as much a part of the executive branch as the president will allow him to be. The truth is, vps have no official executive duties outside of assuming office upon the president’s incapacity. What gives Cheney credence and what makes Biden look like a hair-splitter is the fact that the vp’s only constitutional authority while the president is alive and well is legislative in nature.

By the way, have we reached the point where Bden can call the outgoing vp “dangerous” without anyone batting an eyelash? In my opinion, that was outrageous.
