On Nov. 5, the presidential election winds up in a electoral-college tie, 269-269, the Democrat-controlled House picks Sen. Barack Obama as president, but the Senate, with former Democrat Joe Lieberman voting with Republicans, deadlocks at 50-50, so Vice President Dick Cheney steps in to break the tie to make Republican Sarah Palin his successor.
"Wow," said longtime presidential historian Stephen Hess. "Wow, that would be amazing, wouldn't it?"
"If this scenario ever happened, it would be like a scene from the movie 'Scream' for Democrats," said Democratic strategist Mary Anne Marsh. "The only thing worse for the Democrats than losing the White House, again, when it had the best chance to win in a generation, but to do so at the hands of Cheney and Lieberman. That would be cruel."

I thought that the new House and Senate are sworn in before the new President is inaugurated, and since the Democrats are (as of the last time I read anything on the subject) supposed to strengthen their lead in both bodies, I don’t think that would help the GOP and McCain at all.

Twelfth Amendment. House picks the Prez, Senate picks the VP. If the House Deadlocks, the VP becomes president. If the Senate deadlocks, Prez names new VP under rules for 25th Amendment.

Unfortunately, it's 27-21-2 in favor of the Democrats.
I have the same question about delegations, though. I think we may have 27 house delegations, but I’m not sure.
My Guess is that Arlen Specter, Susan Collins, Chuck Hagel and Olympia Snow would not vote for Palin.
According to Wikipedia, dems control 23 state’s legislature, GOP controls 13, 13 are split and on is nonpartisan (Nebraska).

So winning on this basis is NOT a safe GOP prospect. Call this Plan B.
So scratch Plan B, go back to Plan A and win it outright.

The 12th Amendment clearly authorizes the Senate to pick a VP if no candidate wins a majority of the electoral college.
That's a list of who controls state legislatures. What I needed was a list of who controls each state in the US House. In the 109th Congress the good guys controlled 29-21. In the 110th someone posted that the Dems have 27. However, I don't think either number matters, because won't the new House be sworn in before the votes are counted? Just have to win the House back.
According to my stochastic analysis of Rasmussen, today's battleground state polls that he released puts the Electoral College vote at 271 McCain. Swinging 1% of polling from Obama to McCain puts the count at 297 McCain.

Dems currently have 27, GOP 21 and 2 unaccounted for in Wikipedia tabulation. I would classify prospects for GOP going from 21 to 26 as slim.
Bush has done more harm than good, for the GOP in his terms. He has been the party leader.
McCain has a better chance to win outright, than to retake 5 states’ for GOP majorities. IMO.

Okay, I’ll play. Obama is elected Pres and Palin is V.P. under this scenario. Then it is proven that Obama was not born in the U.S.A. and Palin becomes Pres. Wow, that would be cool!
This wouldnt work since the Dems will almost certainly gain seats in the new session of the senate giving them plenty of room for error.
They apparently do not understand how the House picks the president. There are 50 votes. Each state gets a vote.
Deleware for another example has only one and he belongs to the GOP. So I would presume he would vote McCain, but who knows. The current count is 26 Dim, 20 GOP and 4 split now. But there are lots of one Rep states that could change.

We could also lose one of the Maine Senators. They would be offered a TON for it in exchange for their vote. Possibly G. Smith too.
The current contract at Intrade is at 4%. If anyone thinks the chances are greater than that and they’re right, they can make money. Of course, there’s money to be made shorting it as well, but not much.
