US deserter in Canada wins stay of deportation (Hinzman)

A U.S. Army soldier who fled to Canada after learning his unit was being deployed to Iraq won a last-minute stay of deportation Monday.

Federal Court Judge Richard Mosley ruled Jeremy Hinzman can stay in Canada while the court decides whether he can appeal his deportation order.

"We're elated," Hinzman said moments after the decision was released. "(But) we're not out of the woods at all. We just have a stay of removal."

In his three-page ruling, Mosley wrote, "Based on the evidence and submissions before me, I am satisfied that the applicants would suffer irreparable harm if a stay were not granted."

Good God - as a Canadian I am distressed that our judiciary is this political.

Applicant would “suffer earned consequences” is more like it. But that seems to the the latest heretofore unknown amendment to surface in constitutional penumbrae worldwide, “the gubermint shall protect all citizens from the consequences of their bad acts, to the detriment of the responsible citizens.”

Instead of sending him back to the US, they will put him in a Canadian Unit, send him to Afghanistan where he will have one task he would be accountable for....

cleaning latrines with his toothbrush.

He should suffer a blind fold and a firing squad at a concrete wall........................
