Bob Barr wants McCain, Obama off Texas ballot
Atlanta Journal Constitution ^ | 9/17/2008 | SCOTT SHEPARD

Posted on 09/17/2008 7:36:27 AM PDT by markomalley

Libertarian presidential nominee Bob Barr’s campaign filed suit Tuesday seeking to remove Republican John McCain and Democrat Barack Obama from the ballot in Texas, alleging that the two major candidates missed the deadline for officially filing to be on the ballot.

The lawsuit by the former Republican congressman from Georgia claims that neither McCain nor Obama met the requirement of Texas law that all candidates provide “written certification” of their nomination “before 5 p.m. on the 70th day before election day,” because neither had been formally nominated by their respective parties in time. The suit was filed in the Texas Supreme Court in Austin.

That would have been Aug. 25. Obama did not accept his party’s nomination until Aug. 28, McCain his on Sept. 4.

“The seriousness of this issue is self-evident,” the lawsuit states. “The hubris of the major parties has risen to such a level that they do not believe that the election laws of the State of Texas apply to them.”

Pat Dixon, chairman of the Texas Libertarian Party, issued a statement saying, “Libertarian principles require personal responsibility for your acts and failures. Obama and McCain failed to meet the deadlines. They must follow the law like everyone else.”

Hey, H. Ross Barr, sit down, shut up, and run in a few years.

WTF? Did both major parties actually schedule their conventions after state ballot deadlines started coming up?

Life imitates art, but why does it have to imitate farce?

Good grief. Is he still trying to stir this up? It was taken care of LONG ago — BEFORE the deadline.

Gee whiz Bob, could you at least have the decency to pull this stunt in a state where Obama is comfortably ahead.

Bob Barr lost it several years ago. A shame he has simply gone nuts, it seems. Used to like his common sense conservative views but now he is truely off the edge!

Did both major parties actually schedule their conventions after state ballot deadlines started coming up?

No. Some states moved their ballot deadlines to before the conventions.

All of the proper paperwork was filed. Before the deadline, the parties filed, and then after the conventions, they amended the paperwork.

I am a libertarian. I was going to vote for Barr. I live in TN where McCain will win be 20 points at the very least. I am voting for McCain now. Barr is a fraud. A libertarian does not use the government to do his dirty work. This is such blatant hypocracy that it is comical.

“I don’t undertsand - did both campaigns file paperwork?”

Yes. Both campaigns filed for extensions, that were granted by the state — all proper channels. Then when their VPs were announced, they did what they were supposed to do, finalized the paperwork, and they are on the ballot. It’s a non-issue. He’s just trying to make a stink and get his name out there. It’s stupid.

He could win this if he were in Tennessee. Nashville had a referendum on the ballot for english only for metro business. A judge ruled that the initiative could not be put on the ballot because a similar initiative was on the ballot two years ago, and, since, no initiative can be brought back again within two years. The election is on 4 Nov with the last election on 6 Nov, two days before the two year moratorium would be up.

Try, “WTF, Did Texas actually pass a law that would require the political parties to register before they even have their traditional Labor Day conventions”?

I don’t think so. My guess is that both parties registered their official elector list before the deadline.

We don’t vote for candidates in the Presidential election.

I hope Bob Barr remembered this and submitted a list of electors, rather than just his own name.

You know what? If they didn’t follow the rules, they shouldn’t be on the ballot. Rule of law is supposed to be supreme in this country.

The Rules are the Rules and a State can set their filing deadline whenever they wish and the Obama and McCain campaigns are at fault for not filing in time.
