Bizarre blame game

Andrea and Daniel Kelly of Philadelphia filed a lawsuit claiming their city and state caused the wrongful death of their poor, bedridden daughter, Danieal. The federal suit seeks upward of $50,000 for medical bills, funeral costs and other expenses, not for the Kellys, mind you, but for their eight surviving children.

So how did city and state kill Danieal? They left her in the care of the Kellys, who starved her. Danieal, 14, who had cerebral palsy, died Aug. 4, 2006, "while lying in her own feces, with flies buzzing around her mouth and maggot-infested bedsores ravaging her skeletal back," The Philadelphia Daily News reported.

This, according to the Kellys, was not their fault. Why, they were powerless to help her. Ask the state to take her off their hands? Get her free life-saving medical attention at the nearest emergency room? Feed her? Shoo away the flies and pick off the maggots? Are you kidding? The Kellys were only her parents. No, the welfare state killed her by not raising her and caring for her properly.

Mrs. Kelly has been charged with murder, and Mr. Kelly with child abandonment. The attorney general's office has moved to dismiss their lawsuit: "Despite their egregious denial of her existence in life, they now seek to profit by her tragic death that they caused." The Kellys' attorney, however, claims it would be unfair — unfair! — to paint his clients as "money-grubbers."

The deadly consequences of government dependency is a topic for another day. As for the lawsuit, a few attorneys might admit the case represents one of those pesky flaws in the system that can't possibly be fixed via tort-law reform to screen out the most frivolous lawsuits. But the vast majority will contend the case simply is the parents' way of seeking justice from the courts from those guilty of wrongs that kill people. We see it as sue-crazy America's latest obscenity.

Sure it could. Adopt "Loser Pays." If your suit is dismissed for no merit, you must pay all of the attorney's fees and court costs.

This would be true. Money-grubbers at least have some semblance of humanity. This [expletive deleted] has none.

I think this is a very important topic that should be discussed every single day. From Hurricane Katrina to the death of this poor little girl; government dependency, the sense of undeserved entitlement, and lack of personal responsibility are devastating.

Aw geez. The poor baby.

A friend of my sister had a girl with CP. She was tiny and was really nothing at all to care for.
Yes, she spit up what you fed her, but if you talked to her and touched her lovingly, she would beam like the sun.

And the thing is, her mind was perfectly normal. Her body just didn’t work right. When she used eye movements to type on a board, she could converse with you for hours.
