An Austin woman credits her handgun and her own quick thinking with saving her life after she shot a man who was trying to attack her. Leonie Burgos said the man scaled a fence outside her apartment near Barton Skyway and South Lamar.
When Burgos saw the man jump the fence, she ran inside and grabbed her .38 caliber pistol. She went back outside to see if the man had left. She said that's when he attacked her by tackling her to the ground from behind.
Bergos said she shot the man only after trying to scare him with the gun first.
"First I tried to point it up in his face so that he would see that I had a gun so he would take off running," said Burgos. "But he didn't."
Burgos said the man continued to hold her down and the two struggled. She said she pulled the trigger three times and did not know if she hit the man. He ran away before police arrived.
Thirty minutes later, a man went to the emergency room at Brackenridge Hospital with a gunshot wound to the face. Hospital personnel called police. An arrest warrant said Christopher Benavides,20, told police he intended to steal the woman's cell phone and sell it for cash before he was shot.
Benavides had two warrants out for his arrest at the time of the attack for criminal trespass and criminal mischief. He now faces a charge of robbery by assault, as well. Burgos is not facing any charges.

There are certain things that make armed citizen stories compelling, and a blond young lady with a .38 revolver saving herself from a violent robbery is one of them.

Wrong way around...I’m trying to save the video from this website to put on YouTube. I have a program which can capture certain video formats, but has trouble with Shockwave files.
If all he wanted was to steal a cell phone, there are easier ways to go about it than a home invasion with violent assault. This guy had something much worse on his mind.
I think he should be charged with criminal stupidity as well.

I would have handled the situation differently:
Stay inside "calmly" waiting for the perp to enter... aim... BANG.
right click on the link TO the video popup and select properties. see if that shows the video url or file path.
If its not flash, a lot of times you can also pluck links out of the page source
She's guilty of not packing something large enough that would save the taxpayer a trial.
This incident is chock full of lessons . Warning or attempting to scare with a gun is very often a mistake one does not recover from as well as this brave woman did .

In California, she could be charged with a crime. We have no “castle doctrine”, here. She has a duty to flee.
Go inside, arm up, call for help, let out the dog, find a place that provides concealment AND cover, and aim for the center of mass. Keep shooting until the cops show up or you run out of ammo, or the twitches from the perp are ruining the carpet.

:) Wish I had the big territorial dog. Even a sweet dog like a lab will become territorial when someone is entering their home and they know they shouldn’t be there.

True about the dog thing, had friends who lived in Tulsa, one day several of their neighbors were robbed but not them. They attributate it to their 2 doberman’s in the yard.
Having pursued other means of capture (and failed), I’ve put in a request to the channel. I received an inconclusive (but I don’t think it was automatic) response stating someone would be online to respond soon. So we’ll see.

Don’t bother calling 911 in Austin. They won’t get to you for 10-15 minutes.
Cellphones in the hands of the appropriate people are pretty easy to wipe and reprogram. Most interestingly, quite often the next stop for such a phone is overseas.
