Aftershocks of ruling ripple right through New Jersey

The U.S. Supreme Court ruling recognizing an individual right to bear arms set off an immediate debate on how it will affect New Jersey's gun laws, which are among the toughest in the nation.

State Attorney General Anne Milgram saw minimal if any impact, noting the District of Columbia handgun ban that was invalidated by the high court is unlike anything in the Garden State.

"We regulate the possession of handguns; we don't ban handguns," Milgram said. "We believe the court affirmed the right of states to regulate gun ownership to protect public safety and endorsed common-sense licensing of firearms and concealed-weapons restrictions like we have in New Jersey."

Where the rubber meets the road is when the DOJ issues guidelines concerning the effects of Heller v DC.

Meaning now the “second wave” becomes so important, what will Bob Mueller issue? That will set the de facto precedent for the US...

Yeah, sure, the pre-existing gun and weapons ban at Virginia Tech really helped the thirty-three dead last April. Perhaps Mr. Lautenberg should focus more on properly controlling the deer population in his state, preferably with guns, so that tourists like myself don't hit deer on major roads in the middle of prominent college campuses in New Jersey.

Words fail me when thinking of Lautenberg. I live in NJ. I try not to think about Lautenberg. Or, for that matter, most of the other human rejects that get elected to office in this state.

It's a little tough to tell but it sounds to me like Evan is taking the same view I am. It's all about the 14th amendment and incorporation now. Then it's no more smart guns, no AWB, and the "bear" portion could be addressed with that procedural prohibition on concealed carry permit for non law enforcement officers.

It'll take time, and money and effort, but we are in a good position to fight the fight now.

Personally I'm going to start arguing for some "common sense" "tough but fair" restrictions of speech in New Jersey. It would all be worth it to get Frank Lautenberg to shut his pie hole.

The next battle is showing that the 2nd Amendment is applicable to the states via the 14th Amendment. DC is federal land; therefore, some might argue that the decision does not incorporate the 2nd into the 14th yet. Not all of the Amendments (or portions of the Amendments) have been found to apply to the states. e.g., right to grand jury indictment.

Look, the Boy Scouts of America won the right to practice the First Amendment Right to Freedom of Assembly from the US Supreme Court and it became the target of the ACLU, the American Library Association, the City of Philadelphia, etc.

So don’t hold your breath that the Second Amendment will be tolerated in a world of ACLU harassment, etc. The media will be right behind the ACLU and the like pushing the big lie..

For those who have not studied the complex language used by the left to obscure the truth and confuse the populace, “common sense” is the term used when political actions are not Constitutional, not rational, not based on evidence, and not for the good of the people. If the action were any of these things, the politician would say so.

“Common sense” gun laws are, well, not.

The left is moving fast to argue they are not in violation of the 2nd amendment despite decades of infringements. They are trying to twist logic to justify their laws and even justify more infringements. Be absolutely intolerant of attempts to eliminate your rights as an American and a human being. There is, among these politicians, no honest desire to prevent gun violence, only gain political power.

I grew up in NJ. They made a bb gun a real gun. They made a slingshot illegal. A pellet rifle is a real rifle. An Airsoft is a real rifle. A co2 pistol used to be a toy, now it is prison. I ran from that hellhole and I will never go back. I gotta send money to the NRA tomorrow for lawsuits.

Obviously Herr McKeon was educated in government schools. He wasn't taught that states do not have rights, they only have specific powers delegated to them by the PEOPLE, who do have rights. And despite the best efforts of Herr McKeon and his like-minded Naziesque accomplices to deny and obfuscate the truth, those rights are unalienable according to the wisdom of the great men who founded the nation in which he resides but doesn't appreciate. One of those pre-existent, unalienable rights that are guaranteed to the people by the U.S. Constitution is the individual's right to keep and bear his or her privately owned arms. A right which 5 members of the SCOTUS finally recognized and said so this past week via a binding decision.

Live with it Herr Squealypig, uhhh Herr McKeon, the shoe is on the other foot now. Lawsuits against your unconstitutional gun laws are being drawn up even as I write this, and if justice is finally served after all this time spent enduring your unconstitutional gun laws, the days of you and your porcine pals stomping on the rights of N.J's law abiding people are nearing the end of the road.

The SCOTUS agreed that the RKABA is an individual right of the people and not a corporate right of the states as the D.C. government claimed. But unfortunately, and probably due to the need to get Kennedy's vote, the decision allows serious infringements on that right by state and local governments to continue denying the majority of law abiding Americans the full enjoyment of that unalienable human right. Further appeals to the federal courts, and ultimately the acceptance of another 2nd Amendment case by the SCOTUS, will be necessary in order to correct that situation.

Here is just a little more on how New Jersey is viewed from the outside and on Senator Frank Lautenberg. An excerpt:

They say the most dangerous place is Washington is anywhere between NY Senator Chuck Schumer and a news crew. But for that, and the fact that his geologic age is beginning to slow him down a bit, Frank Lautenberg would no doubt be known as the most vociferously anti-gun politician in the country.

very astute, and of course you are 100% correct. It does not give these idiots an out because they are of course still idiots or in NJ case they are all useless, I grew up in NJ, and left when I enlisted, vowing never to return, and we of course know that 28 years later that is the only place I could find work, but that madness only lasted 5 years (still long, I was there when Lautenburg was elevated to what ever he is supposed to be doing), he of course is like most Politicians from NJ (similar to Gov buttercup) a criminal enterprise that is never ending.
