The New Employment Verification Act of 2008 is the most egregious attack on the American people and the US Constitution on the issue of illegal immigration that I have seen to this day. There are several flaws and concerns about this particular "Act," but the blatant attempt to usurp the rights and powers of State and local governments lies in Section 101(b)(2)(A) (according to Human Events). This particular piece of the "Act" states this:

(b) Enhancement of Federal Preemption Standards- Section 274A(h)(2) of the Immigration and Nationality Act (8 U.S.C. 1324a(h)(2)) is amended to read as follows:

`(2) PREEMPTION; NO NATIONAL IDENTIFICATION CARD-

`(A) PREEMPTION- The provisions of this section preempt any provision of any law of any State or political subdivision thereof or any contract entered into by any State or political subdivision thereof which--

`(i) imposes civil or criminal sanctions upon employers for actions governed by the Act;

`(ii) requires, authorizes or permits a system of verification of the immigration status of employees or employment applicants;

`(iii) requires, authorizes, or permits the use of a federally mandated employment verification system for any other purpose other than that required by Federal law, including verifying status of renters, determining eligibility for receipt of benefits, enrollment in school, obtaining or retaining a business or other license provided by the unit of government, or conducting a background check; or

`(iv) requires or prohibits the use of an immigration status employment verification system for any purpose, except as required by Federal law, including without limitation, such purposes as--

`(I) a condition of receiving a government contract;

`(II) a condition of receiving a business license; or

`(III) the basis of assessing a penalty.

Folks, not only is DC refusing to hear us and do their jobs, not only are they trying to sneak pieces of the FAILED Comprehensive Amnesty Bill into every other bill they can think of, but they are outright trying to pass a law to PREEMPT all the hard work being done by Americans on a State and local level to protect their communities. D A King has an EXCELLENT piece in the Atlanta Journal Constitution, and he also does our work for us on a daily basis HERE.

I have an announcement for our enemies in DC.

Dear Washington DC,

I will be honest with you.

We are SICK and TIRED of babysitting.

Last year- Americans made it clear that we wanted the borders under control and employers held accountable. We should not have to be organizing every week against another bill sneaking pieces of the Amnesty Bill into other bills. It is like dealing with a 2 yr old. We should not have to tell our Representatives every single week that we don't want protection for lawbreakers (illegal aliens or employers). We want the laws enforced. HR5515 is not just a slap in the face-- it is trying to usurp the rights of States and local gov't trying to protect their communities from the ourtight refusal of Federal Gov't from doing their jobs.

My 7 yr old does not need to be told "NO" this many times.

The GOP is in DEEP trouble. Heck-- Congressman Gingrey (R-GA) is a dang CO-SPONSOR of this Bill.....today was the first time in my life I actually thought to myself, enough. I have had enough. I am actually willing to vote for a Democrat.

Lou Barletta gets it. He is the only politician I hear promising to actually do his job if elected. Job one is to protect Americans. JOB ONE! Hearing someone run for office- who promises to do just that is absolutely FOREIGN to our ears.

I hope to hear from you-- and I hope it is good news, and I don't have to rally the troops to flood your offices with calls and letters. It is quite frankly getting so tiresome that the GOP just might find themselves where no one is calling anymore- and they will be packing their bags for home.

We need at least 30% of the House seats up for grabs in November.....that should be easy...all you have to do is abandon Amnesty, stop feeding the Global Warming Hoax, and get an Energy plan that will stop strengthening our enemies. At this rate-- we are going to FAIL miserably.

Sorry if this sounds tough-- but I am just trying to give you respect by being honest with you, and trying to handle this in way that helps you and keeps us from having to come out hammering the GOP Leadership once again.

It seems to me that the GOP might need different consultants- and I might just be the one for the job....

Most of the sponsors are Republicans. I think it is time for a new party to be formed. Neither party has the best interests’ of the American people or our country. Now is the time to try and build a party of conservatives. What have we got to loose with the choices put before us?

Since this law states that the Rule Of Law no longer matters I guess I’ll just do the same thing illegals are allowed to do and just start pickling and choosing which laws I want to follow. Or maybe I should ask someone in congress for a list of laws I am allowed to totally ignore. If they don’t give me a list I’ll assume its entirely up to me to make that choice.

None of these people give two cents for what we, the people, want or think. They are all too busy taking money from whoever will offer it. I thought prostitution was illegal everywhere but Nevada. These clowns could give the girls at the Bunny Ranch a few lessons.

I am done with them all. I called my Congress critters - two Rats and a RINO - and told I have had enough. I will support ANYONE who runs against them and then they can go find a real job.

The time has come for civil disobedience to the courts, Congress and local governments who would impose tyranny upon us. It starts with one person who says no.

What will happen when the Feds try to impose this on a Sherriff Joe or Mayor Barleta?

I have come to the conclusion it is too late with this current batch of leadership to do anything. I will run for Congress in 2012. I would have run this time but I would be the lone voice of dissent in a tide of socialism.

The short-term path of this nation has been chosen and it will lead to a depression that has now begun at recessionary levels and will cumulate over a three to four year span. Socialism will be used as it was during the Great Depression to stall the nasty effects of the fact that our easy credit financial system to buy now and pay later (on everything from government to households) has failed. Spending billions per year for Juan and her chiquita to have a kid at taxpayer expense has failed. If we wanted the better parts of Mexican labor, our government could have easily spoken the truth to the American public to why we needed portions of there civilization to be here in America and then got on with it. But the reality is that both parties’ leadership wants the lobbying power for there own and hence, the leadership gets the benefits of the collective group of illegals and the American people get the bill and baggage of the collective group. Same with energy, same with our financial institutions.

The people on the street are just beginning to educate themselves as to why these things are occuring as they know something is terribly wrong in America. However, enough Americans as a whole have to demand and elect good government or we get the government we elect (as is now being demonstrated).

It comes down to this: Which Americans shall sacrifice first to restore our great nation? The answer should be it’s leadership but we see the opposite occuring. We have the ways and means but not the will. Will is obtained from necessity which Americans did not feel we needed as we ignored the $13 Trillion in public and private debt. The will to restore our nation will be thrust on us like most other times in our nations history and it will be after all of us are a lot poorer.

Without a doubt, “Government is not the solution, government is the problem.” However, as this shows, it is escalating from being the problem to being the enemy.

President George has emulated King George in supporting laws and strategies which are totally opposed by middle-class America. The professional politicians in Washington, DC are becoming more and more elitist and separated from those in “flyover” country. These politicians make laws and design voting districts to assure their reelection. Then they raise their own salaries and provide Cadillac medical and retirement benefits while not quite finding the time to provide them for us. [Not that I support that.]

These same political clowns have packed the judiciary with activists so that a few, sometimes one, far Left wing judges can overturn the will, demonstrated by voting, of the American people. If we as a people can no longer expect to have our legislation stand because it will be altered or denied by those following a “living” Constitution, we are destined to lose our liberty and perhaps our country.

The Democrats who cannot even pull off a presidential primary without screwing it up are promising to fix ALL of our problems. The Republicans, who helped get us into many of our problems, are claiming the same thing. These Republicans who were so badly spanked in 2006 cannot even agree to ban all earmarks. They will get spanked again in 2008 and will deserve it.

One suggestion to get us extricated from this mess is term limits.

I would like to see a new party of true conservatives - fiscal responsibility, personal responsibility, small government (not “smaller”, that has become meaningless), term limits. The Feds only doing what the Feds are supposed to do, and the rest left up to local and state governments. I’d also like to see some substantive change to election processes so it isn’t the fracking joke it is now. All primaries should be closed for starters.

The Chamber of Commerce and the Democrats have become a political cabal. They have combined Republicans interested in cheap labor with Democrats interested in "sure" votes. And let us not forget La Raza who works with each to further the interests of illegals and Mexico. A real witch's brew!

I guess I will bite on this.

If you read the bill it is about MANDATORY VERFICATION of legal status before a person can be employeed.

If this bill is implemented, once live, it would make it almost impossible for any employeer to employee a person who is not in the country legally.

It would also make it impossible for states to override this.

So in short, the bill actually tries to solve the problem where it needs to be solved. Take the jobs away and they will leave.

Helps if you read the entire bill.

Thank you for the clarification. Once again I gave one of my most impassioned rants about a proposal I was uninformed about. [I'll clip and save for another occasion.] 8)

I began to suspect my error when I saw it was supported by our Rep. Sue Myrick. She is a real hawk on illegal immigration and I trust her actions.

Hard for me to criticize others when I make so many errors myself. Not that it stops me, of course.

I HAVE read the Bill!

There is NO confusion whatsoever that the language of this Bill is a step in the right direction— but there is also NO confusion over the fact that the “preemption” language is intended to usurp local and state laws.

For instance— in Illinoise- they have a law on the books that PROHIBITS the use of E-verify.....

But then you have folks like us in GA— who have worked hard to pass laws to protect American citizens against the problems caused by illegal immigrants.

Representative Sam Johnson- the sponsor of this bill— will have one of his folks joining me LIVE on my show to help explain the language of this bill.....

No doudt the bill does have “preemption” in it. I think that will be the only way to stop states blue states getting around the issue.

As for GA, have those law survived judicial review at the federal level yet ? I see that being an issue for state laws.

I agree with your statement, but local and state laws were often put in place to compensate for the the fact that federal enforcement wasn’t happening. The pre-emptions strip local authorities of the right to do that anymore. So, under this new provision, if the fed refuses to enforce the law (ie; our current policy) then there is nothing anyone can do about it and we are stuck with a default amnesty.
