Ethics Complaint Filed Against Johnny Sutton

Don Swarthout, President of Christians Reviving America's Values (CRAVE) has filed an ethics complaint with the Texas Bar Association against Prosecutor Johnny Sutton. In this complaint Swarthout charges Sutton's office willfully misled the jury in order to convict Border Patrol Agents Ignacio Ramos and Jose Compean for simply doing their jobs.

Swarthout has asked the Texas Bar Association to investigate Johnny Sutton for actions strikingly similar to Prosecutor Mike Nifong's mishandling of the Duke lacrosse rape case. The evidence suggests Johnny Sutton is just as guilty as Mike Nifong of unethical prosecutorial behavior.

Swarthout said, "This whole case stinks to the highest parts of heaven. How is it possible in America to convict two Border Agents for simply doing their jobs and send them to prison for 11 and 12 years? How is it possible for Johnny Sutton's office to ruin the lives of two of our Border Agents based on the word of a known Mexican drug smuggler? Why did Johnny Sutton's office twist the facts of this case and hide evidence simply to get a conviction?"

More than 90 U.S. Senators and Congressmen have reviewed this case and have asked President Bush to pardon Border Agents Ramos and Compean. These 90 elected officials represent both Democrats and Republicans. All of them agree Johnny Sutton's prosecution leaves a lot of unanswered questions.

Known drug smuggler Aldrete Davila was portrayed by Sutton as almost an "innocent bystander." In fact, he was involved in a second drug delivery to the United States during Sutton's prosecution of Ramos and Compean. This fact was covered up by Sutton's office.

It may be possible for reasonable people to disagree about whether Sutton's statements constitute "outright lies." However, the facts now in the public domain make it abundantly clear Sutton's statements were willfully misleading to the jury and that is the basis of this ethics complaint.

Hopefully this will be pursued in the same spirit and tenacity that Sutton persecuted Messrs. Ramos and Compean.

After the Alberto Gonzalez flame-out I suppose whoever wins (McCain or Obama) all Federal appointed judges and prosecutors will be fired on January 21st. All the new ones will be dems. I don't see any positive changes coming with that. Isn't there an appeal coming up?

For his appearance before Senator Diane Feinstein and Senator John Cornyn, Sutton was not sworn in. During his answers to their questions he regularly misrepresented the facts and even lied. Edd Hendee at KSEV radio Houston has been on this story for two years now. Even the Department of Homeland Security spokesman lied to members of Congress about the case. At a latter date the Deputy of HS admitted the lie.

The appeal was heard last year (Nov?). and the three judge panel has yet to rule. Normally, there is a 60-90 day period before ruling. With the delay being this long, it is believed that the judges are dotting every I and crossing every T before they rule. Either that or the Bush Justice Department (formerly headed by Alberto Gonzales) is putting pressure on them BIG TIME. Sutton was part of the Bush transition team and a member of Gonzales’ advisory board.

I don't expect it to go anywhere. The press doesn't give crap, what with their pro-illegal slant. And anyone that expects loyalty from the US government is seriously naive.

Another example of people not only abandoned by the government, but thrown under the bus.

However, the facts now in the public domain make it abundantly clear Sutton's statements were willfully misleading to the jury and that is the basis of this ethics complaint.

Actually, the complaint should be against Debra Kanof and her sidekick prosecutor for their statements in front of the jury.

Sutton made no statements to the Jury. He did however run a dishonest PR campaign and lied to the American public in interview after interview. I think a complaint on that basis is warranted.

Hallejulah! ‘Bout time. Has anyone asked our wonderful candidate McCain, if he would pardon Ramos and Compean? I rather doubt it. His Hispanic outreach director Juan Hernandez would frown on it.

As a great American, McCain would much rather have Mexican support rather than supporting plain old US law enforcment citizens. Why, drug runners get kinder justice than border patrol agents! /s

There is a video out there where someone tries to ask Juanito a very pointed illegal immigration question.

Juan had them ousted from the room. How dare anyone bring this issue back up and question his authority.

Thank you for the ping, calcowgirl. It is nice to have some good news as we await the outcome of the Agents' appeal. Now we can evaluate Sutton's twisting of the facts to make his position seem better; pretty much what he accused Ramos and Compean of. It will be nice to see the shoe on the other foot.

Since his style seems to parallel that of Mike Nifong, let's hope there is a disbarment in store for Sutton, too. But, I will not hold my breath!

Me, too! [And for at least as long as Ramos and Compean have been there.] However, Sutton is a pal of the President, and unless the conviction is after GWB leaves office, the President will pardon him just like he pardoned Scooter Libby.

But, more than anything, I really want to see the Agents released from prison. This Administration has simply failed in its Constitutional duty to secure our borders. Kudos, BTW, to the National Guard which has done a great job of defending the US-Mexican border, but they are now apparently being pulled out. Perhaps, to be available for Iraq?! The locals want them; I believe the Border Agents want them; but, Pres. Bush's flack in the Border Patrol says he doesn't need them anymore.

While Bush steals US Border Agents away to defend Iraq, with the offer of higher pay, Ramos and compean, who defended us from a multiple drug smuggler, are in jail because they violated Johnny Sutton's PC views of Mexico. In my mind the poison that Davila was delivering kills our kids just like a gun, just slower. So he was, in a matter of speaking, “armed”.

Go back and find some of the threads after the sentencing. All kinds of justification for Sutton. It’s hard to believe that there are people who agree that these guys should be in jail.

Since they cannot justify what Johnny Sutton did, they resort to lies and to slandering Sutton's victims. They write long posts whose content makes me believe they come from the same source. Maybe Johnny or one of his groupies is lurking here.

BTW, for one professional directory I saw a while back, Johnny refused to answer questions regarding marital status and religion. Wonder if he has a spouse, and if he does could she have Mexican connections.

So long as the pernicious concept of “prosecutorial immunity” exists, there will be more of such cases.

Why?

Because there is no direct chain of responsibility making possible feasible litigation against an out of control prosecutor or prosecutrix.

Well, wait a minute - as a prosecutor, I’m happy for the immunity, as it keeps everybody who gets acquitted (admittedly not many) from suing my happy a**, and no, that doesn’t mean I don’t vet my cases well. Beyond a reasonable doubt is a tough standard, and my job under the Texas Code of Criminal Procedure is “not to convict, but to ensure justice is done.” Without prosecutorial immunity, the justice system would be even more stacked up than it already is.

More information on Johnny Sutton is needed - he appears to have an agenda. Is he married to somebody with links to drug cartels or Mexico? Who are his friends, if any? Etc. He has crossed the line just like Nifong.

You are right. I wonder just what is their relationship. Bush is even supports him to the extent that he lets innocent men be framed and kept in prison. The question remains - what is Johnny Sutton's agenda?
*Is he carrying out Bush's orders?
*Does he also have a fetish for illegal aliens?
*Is he a sociopath who gets a kick out of going after innocent people?
*Is he bribed or blackmailed?
*Is he involved with drugs?
*Does he hate BP agents?
*Is he mentally ill?

Their friendship goes back at least to Bush’s time as Governor. One poster said that it goes back much farther than that, that they attended the same high school, or prep school.

I think Sutton’s agenda is no more complicated than that he is carrying out Bush’s policy of appeasing Mexico. Someone in the Mexican gov’t was very upset with Aldrete getting shot in the butt and complained to the US. This complaint set in motion Sutton’s “investigation” and the prosecution of R & C.

Ramos and Compean are “littel people”, just like the Travel Office people were to the Clintons. “Little people” don’t count, and they are expendable to those who rule like kings and queens.

It really does not matter if he was sworn in.

Sutton is not above ethical standards, and he should be fired from his position on that basis alone. After Bush is out of office, he'll basically be on his own, with his co-conspirators running for the tall grass. Some might even come clean.
