The design was approved during a: Liberal Presidency..a liberal state of Minnesota Governor, a liberal state senate and congress.

There was an environmental assessment performed but because no Federal funds were involved, it did not have to comply with NEPA. Most of the EA was devoted to skewing the numbers to show how badly the project was needed (NOT!). The EA was completed in August of 2007 and they just went ahead and started construction.
