They should try asking a few victims of rape. It’s amazing how many wish their attacker a lingering, painful, HUMILIATING death.

Bingo, we have a winner. Those who forcibly molest a child are almost always multiple offenders before they are caught the first time. Post incarceration depending on what study you look at shows the recidivism rate is right around %80.

However, for the victim of a child rape to be raped and murdered is a lot worse than to be raped alone.

I was raped as a child and from my point of view it would have better if I was murdered after the fact. But from my families point of view that is obviously not the case. At least in death there is peace.

I don't see how death is cruel and unusual for one of these subhuman vermin. However, for the victim of a child rape to be raped and murdered is a lot worse than to be raped alone. Before approving such a law as a legislator, I'd have to be fully convinced that it would nor have a horrible unintended consequence: many more child rape victims being murdered so they couldn't testify against the rapists.

I think we are in basic agreement.

I get sick to my stomach to even write this; but the reasoning is that while rape may be relatively easy to cover up, as inconceivable as that is, a missing child is not.

Most child predators are serial offenders, as I understand it. But there is no "serial" aspect to killing a child, being found out, and going to prison would end their "run".

Someone will miss that child.

I have very mixed feelings about this law, but I'm not sure that it is automatically going to lead to murders.

If it turns out that it in any way endangers children more, I would be against it.

One thing that is disgraceful and completely inexcusable is that the penalty for harming a child isn't life in prison to begin with.

Why that has been allowed to stand is totally beyond me and makes me deeply angry.

There is strict criteria that has to be met in order to be considered a capital crime. It's not just something that someone who simply fondles or is accused of fondling would be charged.

Louisiana Aggravated Rape Law

LA R.S. 14:42

A. Aggravated rape is a rape committed upon a person sixty-five years of age or older or where the anal, oral, or vaginal sexual intercourse is deemed to be without lawful consent of the victim because it is committed under any one or more of the following circumstances:

(1) When the victim resists the act to the utmost, but whose resistance is overcome by force.

(2) When the victim is prevented from resisting the act by threats of great and immediate bodily harm, accompanied by apparent power of execution.

(3) When the victim is prevented from resisting the act because the offender is armed with a dangerous weapon.

(4) When the victim is under the age of twelve years. Lack of knowledge of the victim's age shall not be a defense.

(5) When two or more offenders participated in the act.

(6) When the victim is prevented from resisting the act because the victim suffers from a physical or mental infirmity preventing such resistance.

B. For purposes of Paragraph (5), "participate" shall mean:

(1) Commit the act of rape.

(2) Physically assist in the commission of such act.

C. For purposes of this Section, the following words have the following meanings:

(1) "Physical infirmity" means a person who is a quadriplegic or paraplegic.

(2) "Mental infirmity" means a person with an intelligence quotient of seventy or lower.

D.(1) Whoever commits the crime of aggravated rape shall be punished by life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence.

(2) However, if the victim was under the age of twelve years, as provided by Paragraph A(4) of this Section:

(a) And if the district attorney seeks a capital verdict, the offender shall be punished by death or life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence, in accordance with the determination of the jury. The provisions of C.Cr.P. Art. 782 relative to cases in which punishment may be capital shall apply.

(b) And if the district attorney does not seek a capital verdict, the offender shall be punished by life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence. The provisions of C.Cr.P. Art. 782 relative to cases in which punishment is necessarily confinement at hard labor shall apply.

God indeed grants me peace, every day. It is only by His glorious Grace that I get through each day. The sad thing is that I have a very nice life with a family of my own, but I know that some of my behaviors and thought processes are completely out of whack from how I chose to deal with the abuse. And yes it is sad because I do not know how to enjoy my family and they deserve the very best.

The beauty of the cross is that my attacker has also met Jesus and is being healed. We each had to face Christ and have the sin exposed and forgiven. (Anytime we stand before Christ there is no doubt about His justice and holiness and forgiveness.) Jesus was more than pleased to forgive each of us, that's why He had to die. The pain is no longer there, but the damage will not be removed until I get to heaven.

Will this be the same justice system that just released a Man from Dallas after 23 years in Prison for a Rape he did not commit? DNA evidence has cleared him of the Crime. FYI 450 cases are under review for false convictions. I am deeply worried that our corrupt judicial system in a hysteria will put to death Innocent Men. Low income Men who cannot afford Pricey Legal Representation. Who cares though Men are disposable Right?

Bet they wish they were in Yemen (or any other ME/Arabian/Persian Gulf state). Then all they would have to consider is whether to grant a divorce to the victim. Easy.

I believe prison rapists should also be executed. Prisons are lunatic asylums. Inmates should learn to follow rules, not rape the weak.

I'm not sure which justice system you are referring to...the one proposed in the original article, or the justice of God.

I agree with you wholeheartedly that our current justice system is incredibly corrupt. Unfortunately it will only get worse on a whole as this world winds down to its close.

I am glad that we have the ability to use DNA to convict the actual perpetrators of crime. It saddens my heart for all the innocent that are in prison for crimes the did not commit. Yet God, for His glory, can use ALL things for the good for those who love Him and are called according to His purpose (which is to know Him and receive His love.) Even Joseph was imprisoned for a crime (alleged rape) he did not commit and was later exonerated.

However the justice of God is completely perfect and just. He values ALL mankind which He made evident on the cross. The pardon He offers is like no other pardon any human judicial court could present, and it's available for any who would call on Him and receive it.

I agree with what you said. I would hope that this would be used only for the perverted types of rapes.

hese days I am not even sure what qualifies as rape. No, I am not asking anyone to give us an explicit definition.

Rape my daughter, no death penalty! No! I do NOT want public service workers injecting the rapist with medicines that will put him to sleep then numb him so that his brain is not capable of knowing what is happening to him.

Oh NO, I want him wide awake and fully aware that I am castrating him and shredding his penis with a weedwacker using stainless steel wire. Yes, I want him aware that his death is still at least 24 hours off in the distance.
