Breezy winds chilled the tempertures today as eight super-heated pro-troop supporters from around the Bay Area gathered in front of the United States Federal Building in San Francisco. Jim Minder, Sherry Perussina, Bryan Weldon, Kevin Graves, Catherine Moy, myself, Ryan Gill, Danny Gonzalez, Eamon and Elizabeth Kelly (and Buddy, the dog) stood in front of a podium at the fortified entrance to the US Attorney's office.
(photo of Kevin Graves, Gold Star Father) Three television cameras, including Fox News Network, were on-hand to record our demand to Mr. Russoniello's office that any violators who are identified as harassing, intimidating, slapping, hitting, punching or otherwise harming pro-troop supporters at peaceful rallies such as we planned in Berkeley on 2/12/08 be prosecuted to the full extent of the law. All of us told stories about the lawlessness that ran rampant at our event, cited specific accounts of CodePink, their supporters, as well as truant Berkelely High school students, who were allowed to violate our rights.
(Photo Melanie Morgan, co-founder Move America Forward) Members of Funk the War, The World Can't Wait, Global Exchange and Code Pink were (allegedly) involved in taking peace signs and hitting elderly women over the head, sending one man to the hospital for treatment after being shoved to the ground, and leaving a huge bruise on the arm of Deborah Johns, whose son William has served four tours of duty in Iraq.

We were informed that the office would be in touch with the FBI to discuss the situation, and our letter would be passed around to lawyers in the civil division for consideration. Speaking as Chairman of Move America Forward, I thanked Mr. Frentzen and we left. Fantastic report! It's refreshing that the U.S. Attorney is going to look into peace-thug assaults on peaceful citizens. Hopefully that will include pressing charges for property damage/destruction and flag burning, too.

The applicant pleading for the writ of mandamus to be enforced should be able to show that he has a legal right to compel the respondent to do or refrain from doing the specific act. The duty sought to be enforced must have two qualities:
It must be a duty of public nature
The duty must be imperative and should not be discretionary.
Move Move America Forward over to the City Hall, but leave code pink in front of the Marine Office.
This particular member, Wozniak, is the most positive towards the Marines, but still does not speak out against the anarchist actions which are the real problem for the businesses in Berkeley.

Something to the effect, "Perhaps Mr. Wozniak could recommend moving Code Pink "in front of the City" where downtown businesses are less affected, and then they wouldn't constantly degrade and harass Marines!"
We know that won't happen... at least yet. Wozniak is among the minority on the Council.
It was interesting to learn while reading comments at a YouTube video that Master Bates wife is a member of Code Pink. Isn't that just lovely! An activity they can do together. /sarc/
I sincerely hope the U.S. Attorney does follow thru with the investigation and charges are filed.

The comments section, which became a discussion, at Police "Neutrality" in Berkeley is where MondegreenMom, a Berkeley resident, states "BCC [Berkeley City Council] listens to those who speak up. A lot of reasonable people remained quiet and polite WAY too long. I didn't take the Pinkos seriously. Didn't know the Mayor's wife was one. To make up for my mistake I have written BCC several times, posted comments wherever appropriate, baked brownies, gone to the protest at 5:00. What if all the quiet people spoke up?"
Before we get too excited over alleged new info about Bates wife, we need more than one comment on a YouTube video to confirm Hancock's membership with Code Pink. JMO. It stands to reason, however, since her husband has demonstrated with Code Pink and he openly stated that he "supports Code Pink" that his wife would also.
Looking at Master Bates profile page it concludes "He is married to Loni Hancock, former Mayor of Berkeley and currently a member of the State Assembly." Check out her Photo Albums, maybe you've seen her with/around Code Pink. Loni Hancock's Blog has a few videos posted that I'm in the process of watching just in case she mentions Code Pink.
I'll check that stuff out later.

The police themselves are documented with evidence from their own words that they were not "professional and doing their best to enforce the law." From Moy's quote above, the police hung up on Ms Moy when she called with those complaints."Some of the pro-troop folks were hit with skateboards, hit with signs or placards, or spit upon. Rocks were thrown on (at)them," Moy said.
Berkeley City Councilmember Gordon Wozniak said that the group's complaints were not valid.
"The city has received complaints from both sides," he said. "The Berkeley police are very professional and doing their best to enforce the law."
Mr. Wozniak is in effect hanging up on them also.

Wozniak is definitely practicing "Political Posturing" in front of the media. He's been pretty consistent in his position regarding Code Pink, and he's in the minority. Maybe he's the most 'available' besides radical Dona Spring whom we're sick of (she's so predictable) hearing from.
Since "The Californian" didn't quote him saying "the groups complaints are invalid" they may have taken that out of context from a longer conversation. The press is good about doing that to spin a story. However, he is dead wrong in saying "The Berkeley police are very professional and doing their best to enforce the law." They were neither very professional nor doing their best, while law enforcement was practically non-existant. Laws clearly were not being enforced. It's a miracle that no one, at least that we know of, was dreadfully injured on Feb 12.
While reading a blog late last-night about this video, one person replied "Code Pink violated a number of Californa laws including section 602.1 (Obstruting or Intimidaing Business Operators) and section 647c (Obstruting Streets and Sidewalks), the BPD officers should have known better." So, now we know of still another source of laws that Berkeley PD failed to enforce. *SHEE*
Berkeley Council and Police Department will be closely scrutinized if the U.S. Attorney follows through with the investigation requested. Hopefully the investigators will work quickly (and thoroughly) to find cause to file serious charges.
