Illegal Alien Sues, Saying NYPD Called in Feds

An unlicensed cab driver will seek to show a federal jury this week that the police department is failing to abide by Mayor Bloomberg's pledge that the city won't alert immigration authorities to illegal aliens who otherwise obey the law.

The case of the cab driver, Waheed Saleh of Jenin in the West Bank, indicates that a New York City police lieutenant casually tipped off a federal immigration officer about Mr. Saleh's immigration status, court documents in the case show.

Mr. Saleh's civil trial against the lieutenant and another police officer is expected to begin tomorrow. It may be the first time that the city has been called to account in connection with Mr. Bloomberg's Executive Order 41. Issued in 2003, that order was intended to encourage illegal immigrants to seek out help from the police department and other agencies and allay fears that the city would turn their names over to federal immigration officials.

Court records show that police officers considered Mr. Saleh to be a troublemaker who could turn violent when confronted by the minor annoyances of big-city life, such as a dispute over a parking spot or the high price of cigarettes. In one instance, officers responded to a 911 call from a bodega employee who claimed Mr. Saleh threw a pack of cigarettes at him after a dispute over its price, according to court documents. In another instance, police officers broke up a fistfight between Mr. Saleh and another man over a parking spot, according to depositions. Police believed that Mr. Saleh, earlier in the fight, had tried to use his vehicle to ram a person standing in the street, the documents say.

The mayor urges his employees to disregard federal laws. Too bad nothing will come of this except some court will give some illegals some dinero.

Let’s assume for a minute that Mayor Bloomberg policy is legal.

It doesn’t sound like this guy was obeying the law.

This is an ultimate example of what the malfeasance and irresponsibility of the Federal government has brought upon our nation. And it goes way back. But the Feds CONTINUE to allow the problem to run out of control, and they even pander to it.

What country does OUR government work for?

Issued in 2003, that order was intended to encourage illegal immigrants to seek out help from the police department and other agencies and allay fears that the city would turn their names over to federal immigration officials.

The police did not tip ICE off to the bodega employee (doubtless an illegal immigrant himself) who called emergency services.

They tipped the Feds off to the illegal immigrant who assaulted the man who called emergency services.

Clearly the intent of Mayor Bloomberg's utterly ridiculous and contemptible executive order was not disregarded.

Let’s see if I understand this:

1) Being in the USA without the proper visas or rights is a federal crime.
2) The Mayor of NYC has pledged to obstruct this law and pervert the course of Justice by instructing his employees not to report criminal activities like being in the country illegally
3) A NYC employee ignored this unlawful instruction and alerted authorities to the presence of an illegal alien
4) The illegal alien is suing???

Why is Mayor Bloomberg not being charged with obstructing justice, perverting the course of justice, and harboring illegal aliens?

Why is your civil courts even permitted to sit on such a frivolous lawsuit?

Do you not have District Attorneys in NYC capable of pressing these charges? If so, why have they not done so?

Do your citizens not have the right to take out a private prosecution for criminal matters that the authorities decline to prosecute? (In NZ we do)

Shivers! What a system!

Isn’t an unlicensed taxi driver braking the law so he is here illegally and, illegally running a business so is breaking the law twice so, reporting him would be within the policy.

Policy however, is not the law.

Probably the same reason they haven't charged Gov. John Elias Baldacci of Maine. The US Department of Justice is after bigger fish, like Mr and Dr. Brown over in New Hampshire for income tax evasion.

Where in the U.S. are illegals penalized for breaking the law? Mostly, they’re just ticketed and let go, free to break the law again, and never paying up on the ticket.

You're right. Bloomburg might fire the cop for insubordination, but he didn't break any law. And as for the illegal alien suing the cop, I don't see how an illegal alien could have any expectation that at any time or any place or for any reason he wouldn't be caught.

Under section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, a “Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.”
