Woman Shoots Robber, Husband During Home Invasion

HOUSTON -- A woman shot and killed an intruder and accidentally wounded her husband in a northeast Harris County home invasion, investigators told KPRC Local 2 Thursday.
According to deputies, a couple found themselves staring down the barrel of a gun in their apartment in the Northshore Meadows complex in the 300 block of Audrey Lane shortly before midnight.
A man had just broken into their apartment and was making demands.
According to investigators, he wanted cash and drugs, and made the couple remove all their clothing.
Then, gunshots rang out. However, the would-be robber wasn't the one squeezing the trigger, officials said.
"The husband got into a physical altercation with the suspect," Harris County Deputy A.J. Kelly said. "The wife was able to retrieve a handgun that they had up in the room and she fired shots, striking and killing the suspect."
The husband was also shot. Deputies said he was hit in the arm. They believe he may have been hit by friendly fire from his wife.
The couple told investigators that they did not know the man or why they were the targets of a home invasion.
"Seems like, at this point, they did what they had to do," Kelly said. "They were in fear that this individual who broke into their house was going to harm them."
Deputies said they believe the intruder may not have been alone.
"We have a female detained that was in the parking lot at the time of the incident and we're questioning her know," Kelly said. "She's definitely a person of interest. We think she was with him."
According to Kelly, the woman was downstairs in the parking lot waiting in what appeared to be the getaway car.
Investigators said that the husband suffered from an exit wound to the arm.
He was taken to the hospital and is expected to recover.

I love it when one more deadbeat bites the dust. It cuts down on crime, probably saves the lives of others he’s victimize, and saves the taxpayers the cost of incarcerating him and putting him on trial, only to get released on some technicality.

I believe that you are thinking about the “Felony Murder Rule”. Most states have that. It can be summarized as follows:
If you are knowingly involved in a felony (usually only certain felonies specified in the law), and someone dies as a result of the felony, then you can be charged with first degree murder.

A Louis L'Amour novel saved my skin once. I was about to enter the house of a friend (long story cut for want of space and time) when I found the door unlocked. As I started to enter, I remembered the advice in the Louis L'Amour novel “always announce yourself when coming up to a campfire”. I announced myself, and was rewarded with a reply from the man of the house.
Later on I learned that he had accessed a .38 and was getting ready to plug whoever came in the door.
They had forgotten to lock it.

LOL!
Okay, since you and I have always had “marvelous” conversations, I’ll explain:
We live in the country and we’ve been broken into twice. We’re living in the basement while we remodel, so we don’t always see who’s coming up the drive, etc. There have been a few home invasions around in the past year (meth-heads), although it is a nice area. That’s part of the problem: They’re looking for nice stuff.
But, the sheriff is a long way away.
The wife feels more comfortable that I am “on guard.”

I wonder if the intruder came to that house in particular expecting to find cash and drugs.
Since he had a getaway driver, this was a more formal operation than many home invasions.

Here is some information about Texas law and the felony murder rule:
“The Texas Legislature chose to narrow the common law felony murder rule set out in section 19.02(b)(3) of the Penal Code in two distinct ways. First, the statute requires that, regardless of the specific underlying felony (always excepting manslaughter, of course), the defendant must commit an act that is “clearly dangerous to human life.” Instead of simply enumerating specific felonies which, in the abstract, are usually dangerous, the Legislature required that the state prove that this specific actor, under these specific circumstances, did some act that was clearly dangerous.”
