Why a felony? My guess... the theft was over a certain dollar amount... perhaps $500.

"The property has been recovered and I'm hoping it was nothing more than a youthful prank and I suspect the village will act accordingly," Schofield said. I hope the village makes an example of her and publicizes it as widely as possible. There've been too many of these. Our parish no longer sets the creche up by the road for passers-by to enjoy, but right in front of the church. I remember an announcement a couple of years ago that our Infant had been taken.

“Why a felony?” In most jurisdiction, this would be trespass and theft of something worth more than (fill in the blank) which takes it from misdemeanor to felony. These are usually pled down to misdemeanor and the perp given probation. She might even get diversion and eventually have the record expunged.

Why a felony? Read the article. Its over $1000. Nice touch including the price of the GPS tracker in the charge.
To: NYer
Is there any evidence to believe that she would have returned it after a time? That is the difference between a “prank” and theft.
