I do not know if that is the law. But that is the rule. You have to find out and notify them. That is, if the IRS is receiving withholding taxes on your SS number twice, they will not tell you. If someone applies for a refund in your name, and you have already received your refund, they will not tell you. If someone applies for SS benefits in your name, fraudulently, they will not tell you. Even if you are a victim of fraud and suffer financial loss, they will not tell you. If they sue you and fine you to make you pay taxes on someone else’s earnings, they will not tell you who that person is. You have no right to know, only the right to pay.

ID theft can be quickly reduced by allowed the ID Theft victim to sue the financial institution that loans in his name. Unfortunately, Congress protected the financial institutions, so careless reigns.

but a mortgage broker got them the loan in Laras name. What happened to the mortgage broker who may have committed a crime as well. He knew the folks were not Jose Lara. Jail time too?
That mortgage banker is just as guilty as the illegal, they both need to serve a long time in jail and then be air dropped in Bolivia, where the mother can join her kid.

The DA refused to go after my ex after she took me for 10s of thousands--he said it was "community property".
After we were divorced! I worked my ass off with the credit companies and got it declared fraud, but they won't prosecute her....

If someone steals your identity and uses your identification, neither the IRS or Social Security is allowed to tell you. Not trying to be a smart @ss, but why would the IRS care? It's hard enough to get the crediters and credit reporting agencies to act in the victims favor....the IRS, to me, seems like they would add to the problem.

I had a friend who found out that someone had used her name and social to get credit cards and loans. The person had been paying on them, then stopped and that’s when she found out about it. When she tried to clear it up with the credit card companies and they figured out it was fraud, they would not give her any information about balances on the credit cards or loans or anything else because it was determined “it wasn’t her” and they could not give out information about anybody else, even though it was her name and social.

A woman I work with had her identity stolen. All sorts of shenanigans going on her name (including the purchase of airplane parts... go figure). Anyhoo, she was tracking them all down ,and ended up chatting with the customer service department of a California utility company, arranging to have the utilities that had been illegally set up under her name shut off. The customer service rep actually had the gall to ask her if she was sure she wanted to do that, since the people living in the home had kids.

Add that one to the unmitigated gall category. Did she point out to customer service that the people “WITH KIDS” should have thought about that first? Is there no limit to the number of squish-heads? I would love to know the back story of what happened when the utilities were turned off.

The IRS would care it it thought you owed taxes on income someone else was reporting in your name and SS number. Why would they bother reporting wages? If an employer willingly hires illegals with soc, sec. numbers, they are already complicate. Why would it matter to either the illegal or the employer?
They would also have better things to do with their time (like go on a shopping spree,courtesy of the victim) then to actually earn wages the honest way, right? They are criminals, after all.

Earth to Mrs. Wife, this is not rocket science, and it has been discussed at length on FR: The Social Security Administration receives 8-9 million earnings reports annually from the Internal Revenue Service filed under names that do not match the Social Security numbers. Some are from workers whose employers screwed up their personnel forms, but most are from people using a Social Security number that is not their own. A GAO study found that employers with the most mismatches represent industries that hire a lot of illegal immigrants, including agriculture, construction and food services. There is no reason for the employers to care if they are reporting false SS numbers, because the IRS imposes no penalties for the mismatches. The Social Security Administration is banned from sharing information with immigration or law enforcement agencies, or from telling the rightful owners of Social Security numbers that someone else is working under their number.The IRS cites "privacy" laws that prevent it from sharing information. The IRS knows who the guilty employers are, and it knows where the guilt workers are, but it is doing nothing about it. What about this situation do you not understand?
