Pizza delivery driver kills attacker in Roswell
ROSWELL, N.M. (AP) - Police say a pizza delivery driver in Roswell apparently acted in self-defense in the fatal shooting of a man accused of attacking him. The driver, Dustin Eoff, says he was jumped by three men and beaten with a tire iron as he was getting out of his car to deliver a pizza at a Roswell apartment complex.
Police say 25-year-old Jay Brito was shot to death during the struggle.
Police say Eoff is not facing any charges because the gun was fired in self-defense.

Way to Go!!
Well THAT’S a little disconcerting!! I was just in Roswell a couple of weeks ago.
ping
In before DLR Ping.
I agree. OUTF***INGSTANDING!
Might of been aliens,too!
Dustin must be a strong man to survive getting beaten with a tire iron and also manage to get of a well placed shot.
I wish the article had a little info on Dustins wellbeing.
Good wishes for Dustins health.
Dustin Eoff
I thought that name sounded familiar.
Jack M. Eoff must be a relative.
Home town bump.
Roswell turned into a target rich environment since I was a kid.
The good fight continues!

One man is dead and another man and a juvenile face charges after the trio allegedly tried to rob a Domino's Pizza delivery man Friday night.
Roswell Police Department spokesman Travis Holley said Dustin Eoff, a pizza delivery man, was en route to making a delivery when he noticed another vehicle following him closely. When Eoff attempted to make the delivery, three men from the other vehicle allegedly attacked him with a tire iron and a knife.
Holley said Eoff managed to retrieve a gun from his car, which he used against the three subjects before fleeing the scene.
Holley said the RPD responded to a call about a gunshot at 9:53 p.m. Officers then responded to a call from Domino's Pizza staff at 2417 N. Main St. stating one of their delivery drivers had been in an incident.
One of the subjects who attempted to rob Eoff, 25-year-old Joe Ray Vrito of Roswell, died from gunshot wounds. The other subjects, a juvenile and Christopher Fresquez, 18, of 1405 S. Adams, have both been charged with armed robbery, conspiracy to commit armed robbery and aggravated battery.
Holley said Fresquez and the juvenile did not have any injuries.
Eoff was found to be in violation of his probation for carrying a firearm.
"He was not charged in relation to the incident," Holley said. "It was determined he acted in self defense." However, although Eoff was not charged by the RPD, he will still have to answer to Probation and Parole.
Holley explained that in the state of New Mexico a person can carry a concealed firearm in his vehicle and that if Eoff had not been on probation, there would have been no charges against him.
Thanks for the update.
I was there back in the late 80s and early 90s before the X-Files when the whole alien craze was much much smaller.
NV
looks like part of this guy’s probation was the denial
of his right to protect himself..
pretty steep terms i’d say...
Boy does that bring back childhood memories of calling barbershops and having ol Jack paged......it worked and caused laughter so hard we couldn't breathe....thanks for cheering me up before bedtime!
I know that. It was the only ET I could find on short notice.
Well, in this particular case I hope they go easy on him as he could have easily lost his life using a pizza box against a tire iron and a knife.
I’m surprised (and disappointed) that the other two perps weren’t charged with murder as well.
Roswell? I’m surprised the delivery guy didn’t say, “They shouted greetings, and then wailed on me with the tire iron.” /obscure
“Good wishes for Dustins health.”
BUMP
We used Mr. Mehoff.
I used to deliver pizzas and most of those pizza delivery companies have a policy against carrying weapons on your person or in your car. But it seems like pizza delivery guys are getting attacked more and more often.

Depends on what he did to get on probation.
Too bad they can’t be charged with felony murder for the death of the turd loser.
In Florida they would be charged...and I LIKE that law!
Take one out and sparky-the-’lectro-chair takes out the others.
Not necessarily, they may use common sense in this instance.
I believe that everyone has the right to self-defense, even criminals, it is what you do with something that should indicate whether or not a crime has been committed.
I always told my kids in school that if they are attacked to eliminate the physical threat to them. The school authorities told me that was wrong. I also told my kids that they should back away if at all possible.
You sound like you are related to him
Roswell is near Kennesaw, a town that required its citizenry to be armed. Does anyone know if that is still true
I am related to him Dustin Eoff Is my Brother
