Robert Haberlein is a 19-year-old charged with first-degree murder, but the grin on his face Friday in Wyandotte County Juvenile Court belied the gravity of that charge.
And it didnt sit right with the judge.
Wyandotte County Judge David W. Boal surprised the courtroom Friday when he interrupted an attorney and focused his attention on Haberlein. In a stern and frank voice, he demanded to know what the Kansas City, Kan., teen found funny about a premeditated murder hearing.
The young man couldnt answer.
Well, then, why dont you wipe the grin off your face and get serious, the judge said. This is all going to get serious real quick.
Minutes later, Boal denied Haberlein and 17-year-old Amber Russell of Lenexa permission to leave police custody.
Both are charged with first-degree murder, aggravated kidnapping and aggravated robbery in the 2005 beating death of Robin K. Bell, a Tonganoxie woman who was working as night manager at a Bonner Springs store.
Haberlein and Russell were charged in juvenile court because they were 17 and 15 when the crime happened, prosecutors said. John W. Backus, 20, of Bonner Springs is being held on the same charges. His bond has been set at $1 million.
Authorities allege that the three murdered the 44-year-old woman on Nov. 11, 2005.
Right, the judge’s behavior was “shocking”. (Not the grinning murder defendant).

Why is he grinning??? Your honor ... he is in juvie at age 19, soon to go free no matter what you do to him. Whatever prevented him from facing charges as an adult is what caused the chit-eating grin.

You are right, he’s being charged as a juvenile and knows that at most all he will get is a slap on the wrist.
wipe the grin off your face before I knock it off. Oh well, that wouldn’t have been PC would it? Could have hurt the feelings of the perp.

An article on Wednesday said there had been no decision on whether to charge the Haberlein and Russell as adults. If this is still true, that s***-eating grin might have some influence on that decision.

Does being charged “in juvenile court” specifically mean they aren’t being charged as adults?

The hearing for two of three people charged in the 2005 beating death of a Bonner Springs woman is set for today.
A judge postponed the hear for 20-year-old John Backus of Bonner Springs and 19-year-old Robert Haberlein of Kansas City, Kansas.
They, along with 17-year-old Amber Russell of Lenexa, are accused of beating Robin Bell at the Dollar General store she managed.
For a long time, there were no suspects in this case. The break came last week when officers were interviewing Haberlein about an unrelated crime.
Backus is being held in the Wyandotte County jail on a one million dollar bond.

I’m thinking the Kansas juvenile court still has the ability to determine whether he is to be tried as a juvenile or as an adult.
But I’m not a lawyer either. Like you said, maybe one will weigh in.
The 19th century had better justice than now. Whatever the negatives, they were worth it.

Most of the perps of this type of crime seem to have that look.

Just stared him down daring him to look into my eyes, punk didn’t have the gonads too and he knew I was glaring at him.
Nowadays, it IS shocking to see a judge who doesn't coddle defendants!
These three are accused of beating to death a poor working woman 44 years old at a Dollar General at night. Her husband called the police and asked them to check on her when he couldn’t reach her. It happened in Bonner Springs KS. All three perps were teenagers when they did it. They are beyond help.
Then show us a picture of some perfectly good .45 ACP.
Too big, too heavy, too much knockdown power...the perp would die too fast.
How about a few hundred rounds of .22 C/B caps, instead? And stand back just far enough that they only penetrate *a little*? Kneecaps alone, could be made to soak up 20-30 rds., a piece!
I guess most people are lucky enough not to have to deal with creeps like this, but when you face them there is no doubt that they will hurt or kill you, if they get the chance. There is no love or kindness in them. If they are decent to someone, it is because they want something.
This punk isn’t near as evil looking as some I’ve seen, but if they don’t lock him up for good, he will likely get worse.
One thing is for sure, these aren’t two yutes.

Hmm. If the woman the little p.o.s. killed was a relative of mine, I would want him released immediately. People who depend on police and lawyers and courts and judges, etc., for justice are pathetically naive. It’s okay when all that stuff works, but way too often it just doesn’t work.

Look, I'm neither judge nor jury, but when a 19-year-old is picked up by the police and questioned for 3 counts of felony theft, and then he provides credible evidence in a 2-year-old murder-by-beating case -- evidence credible enough to charge all 3 suspects -- and then he shows up in court to be formally charged with premeditated murder -- and he stands there grinning... that tells me something. It tells me in no uncertain terms that, whatever his relationship to that particular premeditated murder, he's a scumbag.
But maybe, since you regard that nice boy as so “innocent,” you won’t object if we invite him to spend a couple of weeks staying in your home?

Exactly my solution. One night take him out back of the courthouse, kneel him down in the grass and shoot him in the head.
I don’t know anything about this guy. He may be guilty as sin. I do know that I have a son that gets what looks like a grin on his face when he’s nervous or upset. He can’t help it. It’s just what his face does. It has gotten him in trouble before.
