PORTLAND, Ore. - Two provisions of the USA Patriot Act are unconstitutional because they allow search warrants to be issued without a showing of probable cause, a federal judge ruled today.
U.S. District Judge Ann Aiken ruled that the Foreign Intelligence Surveillance Act, as amended by the Patriot Act, "now permits the executive branch of government to conduct surveillance and searches of American citizens without satisfying the probable cause requirements of the Fourth Amendment."
Portland attorney Brandon Mayfield sought the ruling in a lawsuit against the federal government after he was mistakenly linked by the FBI to the Madrid train bombings that killed 191 people in 2004
Good for the 9th Circuit! That entire POS act needs to be scrapped. If you like the Patriot Act now, you're gonna love it even more when the Democrats are in charge.
Enough said!!!!

Agree. As I posted on an earlier thread of the same subject, the P/A was the brain child of the Clinton administration.
LOL, another 9th Circus Court decision that will be overturned. Meanwhile the Admin. will continue to use these tools while they appeal.
You seem to think that the very same people who illegally abused their powers in “File-gate” (one of so many crimes) are so “law-abiding” that they would ONLY eavesdrop on Americans if the Patriot Act (which does NOT permit such eavesdropping) is in effect.
Such a “thought” requires a willful suspension of disbelief...
Or world-class naivete...
True, but that’s not why the Act should be scrapped. It should be scrapped because it’s unconstitutional.
You seem to think that the very same criminals who brought us “File-Gate” would NOT eavesdrop on Americans if there was no Patriot Act to make such eavedropping “legal”.
LOL!
Your naive “faith” that Democrats are actually restrained by the law is “touching”. Foolish, but “touching”...
I know it’s a far-left talking point, but I think a little effort on your part would confirm that the Patriot Act does NOT permit the CIA to eavesdrop on Americans.
So, are you a far-left troll, who has no interest in the truth?
Or just a lazy learner?
And your naive faith that Democrats are not going to further abuse this awful piece of legislation is also touching. Foolish, but touching... The only difference will be that now Hillary won't have to make any effort to cover up her actions. She'll have the full force of the law to back her up.
Trust me, the Patriot Act will be the gift that keeps on giving. Thanks Jorge!
Boy talk about naivete.
The Bush gang has implemented the state apparatus of spying on who and where? Foreigners in America you say! Oh, no administration in power would ever think to use the state apparatus for its own interests.
It would have been much simpler and cheaper to guard the borders and keep out the enemy. But Bush and his bandit buddies really are promoting uncontrolled immigration. The state apparatus "Homeland Security" has the smell of soviet police state. Its sold as a security blanket to protect us from those whom they let into the country.
Marx sold Communism as anarchy. The masses though they would be in charge and bought the Marxist line. Stalin came along and took care of the anarchy part with his police. Bush comes along and instills anarchy through illegal immigration with help from the leftists. When they think the time is right, Homeland Security is going to fix the anarchy of illegal immigration and a whole lot more.
Your second amendment right will be the right to own a slingshot against the state's combine
I think it’s interesting that you choose to use phrases like “...The Bush gang...” and “...Bush and his bandit buddies...”
It’s interesting because everyone but the most deranged knows that, IF President Bush had ACTUALLY broken any law at all, impeachment proceedings would well be underway by now.
Therefore, the fact that such procedings are NOT underway is PROOF, in itself, that no non-imaginary laws have been broken. The truth of that reality seems to have eluded you.
But maybe you believe in “imaginary laws”, the “tooth fairy”, “equality is happiness” and “global warming”
Hey, since America is still a free country, you are “free” to believe those myths. And you are free to believe that:
(1) Bush “lied” about Saddam’s WMD, but...
(2) Hillary, Reid, Polosi, Durbin et al did NOT “lie”, when they said the exact same things Bush said.
(3) Bush has gotten approval from the Supreme Court, the FISA Court and the Congress to listen in on terrorists’ plots in order to stop them, but...
(4) Bush doesn’t REALLY want to stop more 9/11s (even though that would enhance his legacy), because he really, REALLY just wants to listen in your Aunt Millie to learn her “secret recipe” for bundt cake.
(5) Bush has used his evil powers to catch and imprison all his enemies, who include: Michael Moore, Rosie O’Donnell, George Soros, Barbra Steisand, Dan Rather, Maureen Dowd, but...
(6) Because Bush used his evil powers to replace those “enemies” with identical hot-air-powered “dummies” — NO ONE KNOWS about the “switch”...but you.
You are even “free” to believe that NO illegal aliens entered America before 2001, as demonstrated by your easily disproved comment:
“Bush comes along and instills anarchy through illegal immigration with help from the leftists.”
Such infrequent connections with reality suggest that you would be more “at home” on a fantasy website. Why don’t you flit on over to MoveOn.com?
The whole point is "unreasonable searches" ~ not "reasonable searches".
The second statement concerns warrants, when issued, if needed.
During wartime those engaged in commerce with the enemy wouldn't seem to be within the range of either statement since ANY search would be reasonable, and the Commander In Chief should be about doing it now, not later.
The warrantless search was authorized by Congress when the President was authorized to take all actions necessary.
Those who don't care for the quite reasonable searches necessitated by the war should wait in line for their complaints to be heard AFTER THE WAR.
