WHITE PLAINS, N.Y. - A suburban parking official is threatening to auction off a Marine Corps recruiter's car tied to nearly $5,000 in unpaid tickets, part of what the city claims is the Corps' roughly $94,000 tab.

"We've tried to be reasonable, but all we've been getting is the run-around," Parking Commissioner Albert Moroni said. The car will be put up for sale in September unless the fines are paid, he said.

The vehicle, bearing U.S. government license plates and a Marine Corps decal, was parked in a city garage without payment, according to Moroni. It has racked up 94 parking tickets worth $4,850 since last year.

Authorities applied a boot — a device used to immobilize vehicles — then towed the car to a city impound lot April 16.

The Corps, which runs a recruiting station in White Plains, owes a total of $93,805 in fines from 2,000 summonses dating to 2001, parking violations supervisor Claudine Ferrarra said.

The recruiting station referred a call Friday to Sgt. Michael Darbouze, a spokesman at the Albany recruiting office. He said he was unaware of the city's plans to sell the car and had no immediate comment.

The city periodically auctions vehicles confiscated from scofflaws, defined as owners who fail to pay fines on three or more tickets issued within 18 months.

Don’t know for sure, but I have a hunch that these idjits in White Plains are about to get a lesson in sovereign immunity — not to mention a lesson from the FBI or DoJ on what happens to too-big-for-their-britches city officials who mess with the feds.

Well, if the law states that the Marines pay for parking their vehicles like anybody else, and they haven’t paid their tickets...shrug. I don’t know what the laws are about Federal government vehicles and local parking ordinances, though. I guess they’re covered by them like anybody else (except the furrin diplomats at the UN).

So the feds pay the $95,000 and deduct that amount from any federal funding to the city until such time as the amount has been recovered.

If I were the recruiter, I would call for a tank to drive through the front of the city impound garage, preferably doing a few million in damage, and recover the car. The way New Yorkers feel about the parking Mafia, this action would generate a huge wave of new recruits for the Corps.

I'd bet that His Highness and Exalted Royal Commissioner of Parking drives around in a taxpayer-provided car and free parks wherever he wants to. Hey Albert! In the interests of accuracy you should drop the "i" from your last name.

The states and local government have no authority to seize federal property, based on SCOTUS interpretation of the Supremacy Clause. Federal officers acting in the line of duty also have limited immunity from prosecution under state law, even for murder. A hard learned lesson of an Idaho prosecutor stemming from Ruby Ridge.

True but laws must in conformance with the Constitution, which is the highest law in the land. This law, or at least the way it's being applied, is not.

If it what you say were true then you get the law changed through appeal, if it is unconstitutional, or through legislation if it is just bad law.

You don't just ignore it.

I am not a lawyer. But, I can not believe a city traffic cop would write a parking ticket for a vehicle parked on privately owned or U.S. Government owned property. I also do not believe the U.S. government can ignore laws of state or municipal governments.

If the military wants to be able to ignore local law, they need to acquire a parking lot through lease, purchase, or establishment by condemnation, of space for a “White Plains, NY marine recruitment base”.

I don’t believe the US Government has more legal power than does the UN to ignore local law in areas subject to local government authority.

The parking commission guys where I live are a nightmare. I basically stopped going downtown in the car, because no matter what you do you are in violation of something. I went in with a friend to get a piece of pizza.. came out and had a 150$ parking ticket.. which wasn’t the first, and I’ve been actively trying to follow all the rules.

So I bus in to the downtown, which is actually faster and nicer. I’d hate to have some types of businesses down there.. because the reality is by not being able to drive there you go there a lot less.

On the other hand in private shopping malls.. lots of parking free of charge, with no chance that you are in violation of some rule.

Actually you almost have to. It's very difficult to get an abstract case to the supreme court. There must be "case or controversy" as they say. That usually means someone must violate the law so it can be challenged in court. Might not apply to the government, which the Marines are part of.
