GLENN: All right. We have congressman Dana Rohrabacher on with us. Congressman, hello. How are you, sir?
SENATOR ROHRABACHER: Well, I'm doing pretty good today. I'm actually in a shocked mode. We've been denied access to information by the justice department and by the Department of Homeland Security and it proved to be the worst-case scenario which indicates they were trying to stonewall our investigation.

GLENN: Congressman, I made a prediction today and I said this yesterday on my TV program that this thing doesn't smell right and the government has been stonewalling, the Bush administration has been stonewalling us into looking into the Compean and Ramos thing and it may not be that anybody did anything wrong but, boy, it sure seems like it. And I said today that I think that this Compean and Ramos thing, it is beginning to look like this is just the gateway into something really, really bad and it's always the coverup that is worse than any kind of crime.
SENATOR ROHRABACHER: Yeah.
GLENN: It's starting to look like there's a coverup.
SENATOR ROHRABACHER: Yeah, at the very least it's a coverup of wrongdoing or bad decision making. But wrongdoing, and I would hate to say criminal activity on the part of our people, but they were obviously fixated on getting Ramos and Compean, getting them, and they were willing to do things that even common sense would tell you is just unacceptable, and in this case -- and then they covered up those decisions that they made to try to get Ramos and Compean. What we're talking about specifically is they gave a multientry pass to this which we've known to the drug smuggler but now we know -- I've been trying to get my hands on it -- they have been stonewalling our efforts to try to get our hands on those passes and copies of them. Now we know they got the passes but they also issued them even after he was involved with the second drug shipment.
GLENN: Okay. First of all, this is amazing to me. You've got this guy who was involved, who was coming across the border with 700 pounds of dope. He was shot in the butt by Compean and Ramos. He fleece across the border. His mother calls another mother who is the mother of another border agent that grew up with this cartel member
SENATOR ROHRABACHER: Right.
GLENN: This border agent, it's my understanding, still works on the Mexican border even though he has friends who were in cartels. He comes across the border, they nab Compean and Ramos and say that they're going to throw you in jail, and they prosecute him. During that trial Sutton does everything he can to keep out information that they just caught this cartel member yet again bringing a second load of drugs in.
SENATOR ROHRABACHER: Right.
GLENN: Johnny Sutton says to me three, four months ago: Glenn, I can't talk about that. I wish I could, but I can't talk about that because we're still trying to investigate. And I said, is he in jail for that second run? And he said, no, I can't talk about it, but we're still getting this done because I want to nail this guy.
SENATOR ROHRABACHER: Yeah.
GLENN: The last time I talked to Sutton, he said he's not even sure that there even was a second load.
SENATOR ROHRABACHER: Yeah. And now we know that the -- that they actually issued the man a second pass that gave him free access in and out of our country even after the department -- even after the DEA, the drug enforcement agency had issued a report to the justice department saying that he had been identified with that second load of drugs.
GLENN: Do you have that document, sir?
SENATOR ROHRABACHER: Yes, we do.
GLENN: Because Johnny -- may I have a copy of that document?
SENATOR ROHRABACHER: Well, we'll try to work with my staff on that.
GLENN: Okay. Because Johnny Sutton told me that, quote, he's not even sure there was a second load and he was involved.
SENATOR ROHRABACHER: Yeah. Clearly there's -- he is either -- well, I won't say he's lying. I'll just say he is --
GLENN: I'll say he's lying.
SENATOR ROHRABACHER: -- bending over backwards not to recognize the truth in order to continue this prosecution of Ramos and Compean.
GLENN: What -- Compean and Ramos, this is becoming too big. Is this just out of control, cover your butt? Or is there something else bigger in the room besides Compean and Ramos? Well, it could well be that they are simply trying to cover up what was a terribly, an indefensible decision to throw the book at Ramos and Compean and let the drug dealer go and give him immunity. It's very possible they are trying to cover up that horrible, indefensible decision and then it leads them to commit other actions like giving the drug dealer a free pass to come in and out of the country even though he's been identified with a continuing activity in the drug trade.
GLENN: How far does this -- I mean, what bothers me is I talked to Sutton and I said, you answer to Gonzales. Gonzales answers to Bush. It's the three of you. How far up the chain does this go?
SENATOR ROHRABACHER: Well, I'm sure this goes all the way up to the White House. There's no doubt about that. We have to remember this going the other direction, too. The other direction is the jurors, which are just us, you know, we the people make up juries. The jurors in this case, they kept the information about the second drug deal from the jury and they painted the drug dealer as a one-time guy who is trying to sell drugs to raise money for his sick mother and they've been -- Sutton who in testimony says, oh, the judge was the one who determined that that information wouldn't get to the jury. No, no, it was a prosecution motion for the judge not to let the jury hear that and so what we've got is a false picture, a lie being painted to the jury and now during this investigation they've tried to use those same tactics to prevent congress, my investigation, from getting the information that would get to the truth. They were denying us these documents saying, oh, we can't give you -- these are official documents by the department of homeland security. We can't get those. And the Department of Justice and Homeland Security denying this unless Ramos -- excuse me, unless Davila, the drug dealer, signs a waiver, a privacy act waiver. So we're not even supposed to be able to look at official government documents in overseeing the activity of these jokers.
GLENN: Congressman, you know, if this just would have gone away. If they said, you know what, this is a wrong decision and we've got to let these guys a few months ago. If the at the least, compute the sentence like he did for Scooter Libby, but oh, no, there's such a mean spirited, vindictive side of this and now they are going to suffer because of their own mean spirit.
GLENN: And let me ask you. If he decided to come out today and said I'm going to commute the sentences of these guys, would you stop digging into this because I certainly have no intention to stop. There's something else here. There's something wrong.
SENATOR ROHRABACHER: There is something very wrong and unfortunately the President could have laid this to rest. I will tell you that a few months ago right after Ramos was beaten up and severely beaten in prison, I called up a friend of mine in the White House, on the White House staff and said, look, this is going too far; the President's got to deflate this issue before it really hurts everybody. This guy could be murdered in prison. And I said, have the President just announce that they're going to let them out on a pending appeal. Which, criminals are permitted to go out on pending appeal. You know, this is not something that would have -- down the President support that motion. They said everybody off the hook, probably won't happen until the President is out of office anyway. Came back the next day, they announced there will be no letting these guys out on appeal and, of course, that had to have gone directly to the President and he just shows his mean and vindictive side.
GLENN: Congressman, did you ever -- because I did at the very beginning. I hesitated on this story because I don't want bad cops or bad border agents -- if you are doing something wrong, I want you to go to jail.
SENATOR ROHRABACHER: That's correct.
GLENN: Scooter Libby I think should have gone to jail. So --
SENATOR ROHRABACHER: If they went out -- and by the way, if the Department of Homeland Security which is now being investigated for this, was going around and telling everybody that Ramos and Compean had claimed they were going to go out and shoot Mexicans that day, that was a bald face lie. It was a bald face lie and they were presenting that to everybody and in fact, lied to the congressional inquiry about it
GLENN: So you the at any time at the beginning of this say, I don't know, I don't know -- I mean, did you believe that government's side and then you had a moment of action wait a minute, this isn't right; something's wrong here.
SENATOR ROHRABACHER: Well, it's always this, that I clearly, I know that there are police officers in our country that do things that are wrong sometimes. I know that. I'm a former journalist and I've seen it at the local level where a cop will beat somebody up or shoot somebody and you always have to be very aware that that's possible.
GLENN: Yeah.
SENATOR ROHRABACHER: And so I was cautious to begin with in this investigation, but clearly Ramos and Compean, they both have an unblemished record and those are both veterans. These are guys who served our country -- excuse me -- in the military. In fact, Ramos, I believe, is an officer in the Naval Reserve.
GLENN: I believe one of them was the border guard of the year, the year before.
SENATOR ROHRABACHER: He was nominated to be the border guard. The fact that he was nominated shows you they both basically -- and, of course, Johnny Sutton has seen fit to try to smear these guys. One of them had a family altercation two years ago. Sutton had to make that totally public as if the public won't understand that sometimes you have family altercations, they get out of hand. But it doesn't -- it wasn't part of his job. Had nothing to do with part of his job but instead they've been vilifying these men, trying to go out and shoot Mexicans, making sure if there was any blemish that everybody knew about it. That's the type of underhanded thing, and I would say Mr. Sutton and these guys are now in a desperate situation because we now have got -- they are trying to keep from the congress the information that we now have that they gave a free pass to this drug dealer even after he had been fingered for a second drug deal and then, of course, they lied about it to the jury.

Well, if Sutton did not have enough evidence to go after this dirtball the first time (too busy with a creative prosecution of BP agents) then it should not suprise us that he is finding it difficult to find evidence this time.
One factoid that gets little mention is that the drug smuggler was driving a vehicle that had a TX registration. That means, either the vehicle was stolen. or someone on the US side owned it and, thus, permitted the drug smuggler use of it.
It’s becoming more and more apparent that Johnny Sutton has a full-ride scholarship to the Mike Nifong School of Asscovery.

Mr. Sutton and these guys are now in a desperate situation because we now have got -- they are trying to keep from the congress the information that we now have that they gave a free pass to this drug dealer even after he had been fingered for a second drug deal and then, of course, they lied about it to the jury.
It was only last week that nimcompoop POTUS Bush was saying that Sutton is a good friend of mine blah blah blah. Stick to the war George, it's about the only thing we conservatives like about you.
Nothing like a President with a fat head. Release these two agents now.
I am sick of the President and whoever he answers to of literaly forcing the illegals on us. We are the ones that will not benefit. There is already loss of jobs, more crime, more taxing, etc. We don’t want these illegals here. They are a burden to us; not the President and whoever he answers to. I sometimes, wonder if Bush really cares; because he will not speak the truth on this issue. He also hurts innocent people like the border agents who are among the American people he is also hurting.
The drug cartel provided the mule with the van. He crossed the Rio Grande and got into the van on the US side. It's in the transcripts.
