FORT LAUDERDALE, Florida, July 11, 2007 (LifeSiteNews.com) - Following a heated controversy between Mayor Jim Naugle and members of the homosexual community last week, the city commission approved the opening of a gay and lesbian library on public property.

The commissioners voted 3-2 yesterday to allow the Stonewall Library collection of gay and lesbian materials to be moved from its present location at the Gay and Lesbian Community Center to the more spacious, county-run ArtSpace library at Holiday Park.

Jack Rutland, Executive Director of the Stonewall Library and Archives, told LifeSiteNews.com that the 20,000-volume library, which has been in existence for 35 years, is the largest circulating gay and lesbian library in the country. It also has a huge historical archive that is accessible by appointment only because of its adult content. Listing the library's content, he stated, "Literature, history, religion, psychology, law, fine art-you name it, if it relates to the lives of gay or lesbian people, we have it."

According to Rutland, the library has a policy allowing only people of 18 years and older to use the library because it contains adult material. He stated that it is becoming "a public networking area which sponsors programs, speakers, exhibitions, art openings, book discussion groups, film series." The number of people who attend these events is also growing larger.

Mayor Naugle, who voted against the library along with Commissioner Christine Teel, was already under fire for comments he made last week that sparked homosexual activists to a fury. On July 4 the Miami Herald published an interview with the mayor regarding the proposal of a new robotic toilet to be installed along the Florida beaches. The facility would have a security feature limiting occupant time by automatically opening its doors after a certain period. Naugle supported the new idea, saying, "Sometimes (public washrooms) are used for sexual activity-most of it is men meeting men because it's same-sex people in the bathrooms." Naugle also made the following comment, "I don't use the word 'gay.' I use the word 'homosexual.' Most of them aren't gay. They're unhappy."

Naugle regretted the fact that the proposal for the new library came at such an inopportune time. He stated, "I had no idea this was what the homosexual book collection was all about. It's a shame it had to come out during this whole toilet controversy. They'll think it's some anti-gay thing-um, anti-homosexual."

Mayor Naugle told LifeSiteNews.com that he opposed the project for two reasons. "Number one the city needs the space," he said. Secondly, the morning of the vote, it came to his attention that the Stonewall collection contained hard-core pornographic material depicting men committing anal intercourse. He commented, "I fear that we're the first city that has a hard-core porn collection in our public library." In addition, "it is housed in our main children's park."

He concludes, "I'm shocked that a commission majority has approved it and I'm hoping that they'll reconsider, but we'll have to see." Although the library will not be moving within the near future, it will likely open before the end of the year.

At what point does maintenance of the porn museum/collection constitute a sexually oriented business (which are typically restricted in access and location by city ordinance)?

Also the American Library Association's (ALA) stated policy is that anything in a public library collection should be accessible by anyone with a library card, regardless of age (including R and NC-17/X-rated films). This should open the librarians to prosecution for corrupting a minor. If an adult bookstore knowingly sold pornographic materials to a minor, the vice squad would crack down on the owner/clerk.

The collection is "legal" but it's placement (in a children's park) is not and neither is the ALA's "access" policy.

Thank goodness that is not going on in our local libraries. Originally, the homosexual library said that only those over 18 could enter due to content. Here they are, though, moving this homosexual library into the main library. This is the problem when one declares something like porn to be free speech! Now there are going to perverts inside the library getting all aroused while children are a section over reading books. It also seems odd that they wish to pick a library right in the middle of a CHILDREN’S PARK! Perverts could get aroused, come out, and attack kids.

Dear Mayor Naugle,

Regarding the hard core p()rn collection in your public library, it is silly that the library will restrict access to people over 17 years old. Libraries already allow and even encourage access to children of all ages to all sorts of sexually inappropriate material via the Internet. I do not see why the library should discriminate against printed material when children are allowed full access to online material.

Therefore, I predict once the printed material is in your library, the argument will be made that librarians are mere collectors of "information," and, as the "Library Bill of Rights" says, it would be "age" discrimination to keep children out of the Stonewall collection.

Mayor, I want you to consider something. You have more power than your commissioners think. Look at the enabling statute for the library or libraries generally in your state. I'll bet that statute defines what libraries may contain, and I'll bet hard core p()rn is not within that definition. Therefore, library trustees or city commissioners for that matter may be violating the law by allowing or approving material for the library that is implicitly or explicitly excluded by the law.

You, Mayor, are there to enforce the law. You have the executive power to do that. Your commissioners or your librarians do not have the executive power to violate the law. Please consider if any action may be taken along these lines, depending, of course, on the wording of the actual laws involved. The public runs the library, not the few people who willingly circumvent the law for political gain.

By the way, p()rnography may be constitutionally protected, but that does not mean public libraries must allow it. Indeed the US Supreme Court in US v. ALA specifically said, in the context of filtering Internet access, filters may be used to block it out, and especially from children: "The interest in protecting young library users from material inappropriate for minors is legitimate, and even compelling, as all Members of the Court appear to agree." All members. Unanimous. What part of that do your commissioners or your librarians not understand when the librarians continue to decry "age" discrimination in their vaunted "Library Bill of Rights"?
