DALLAS (AP) -- A federal judge on Tuesday blocked the Dallas suburb of Farmers Branch from enforcing a voter-approved law prohibiting apartment rentals to illegal immigrants until a legal challenge is resolved.
U.S. District Judge Sam Lindsay had previously issued a temporary restraining order in May, blocking the law a day before it was to take effect. He issued a preliminary injunction Tuesday.
"Farmers Branch, rather than deferring to the federal government's determination of immigration status, has created its own classification scheme for determining which noncitizens may rent an apartment," Lindsay wrote.
The law would have required apartment managers to verify that renters are U.S. citizens or legal immigrants before leasing to them, with a few exceptions. Landlords would have faced fines of up to $500 for violating the measure with each day considered as a separate violation.
"Today's decision should serve as a cautionary tale for other Texas municipalities that have considered similar ordinances," said Lisa Graybill, legal director for the American Civil Liberties Union of Texas, which is suing the city.
Opponents of the law are preparing for a trial, said William A. Brewer III, lead counsel for three apartment complexes suing Farmers Branch. They plan to seek damages in the millions for the business they've lost since the ordinance was announced, plus legal fees, Brewer said.

Voters did just that and some bleeding heart lib. judge decided to enforce his own brand of "justice."
If you ask me the city of Farmers Branch should withhold any/all taxes that normally would go to the Feds until said Feds do their job... they're getting tax receipts from FB citizens and they're not doing their job of enforcing the border/protecting U.S CITIZENS.

This whole bunch of hooey makes me insane. If the same background checks and verifications are done for EVERYONE wanting to rent an apartment, there is no discrimination. The problem is alot of apartment complexes don’t want to do ANY background, criminal or financial checks. They want to keep their apartments occupied at whatever the cost, not pony up a nominal fee that might prevent a lease.
You come to rent an apartment and you are an illegal Hispanic or illegal Canadian..you can’t live here.
I would like to know what THREE complexes in that area have lost millions of dollars. I’d like to see what condition they are in. If an illegal rents from you, they aren’t too likely to gripe when maintenance isn’t a high priority. I’d like to see what their vacancy was prior to their law suit.
I’d like to see the ACLU take a hike.

we are in a tinder box on the immigration issue and sooner or later we are going read one to many stories of good Americans being harmed by illegal immigrants and the crap is going to hit the fan in a big way.
I am for an organized peaceful protest, on the same day , in all fifty state capitals. Purchase a little talk radio time (or just get them on the cheap) get the ball rolling and let’s just see if we can stop traffic in and around the capital complexes of all 50 states for a whole day. The only power our govt. has is the power we give them and we do not need a recall election to take it back.
If we could muster about 50k people per state , in every capital , all day long , on the same day I think our politicians would be mortified. It worked in TN on the state income tax issue and let’s be honest , we are conservatives and in the habit of keeping extra vacation time on the books. What better way to spend it than to stop a bill that is immoral, illegal and just plain wrong.
